CITY OF THE COLONY, TEXAS
HELD ON
JANUARY 7, 1983
A SPECIAL EMERGENCY SESSION of the City Council of the City of
The Colony, Texas, was called to order at 2:20 p.m. with the
following members present:
Gene Pollard Mayor
Norman Adeler Councilman
Charlie Parker Councilman
Marlene Poole Councilman
and with Councilmen Scott North, Larry Sample and Charles Dodds
not in attendance due to business commitments; however, a quorum
was established.
1. CONSIDERATION OF ORDINANCE ANNEXING A 82.974 ACRE TRACT
GENERALLY LOCATED ON THE WESTERN CITY LIMITS OF STEWARTS
CREEK PARK NORTH ONE MILE TO THE WYNNEWOOD PARK PENINSULA
Mayor Pollard read aloud the following caption of the annexation
ordinance (legal. description attached as Exhibit A, map attached
as Exhibit B):
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ANNEXING THE HEREINAFTER
DESCRIBED TERRITORY TO THE CITY OF THE COLONY, TEXAS, AND EXTENDING
THE BOUNDARY LINES OF SAID CITY SO AS TO INCLUDE SAID HEREINAFTER
DESCRIBED TERRITORY WITHIN SAID CITY LIMITS; GRANTING TO ALL
INHABITANTS AND OWNERS OF PROPERTY ALL OF THE RIGHTS AND PRIVILEGES
OF OTHER CITIZENS AND BINDING THE INHABITANTS BY ALL THE ACTS,
ORDINANCES AND REGULATIONS OF SAID CITY; PROVIDING A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
Councilman Poole moved to approve this ordinance as presented.
The motion was seconded by Councilman Adeler. Prior to voting,
Councilman Parker asked Mayor Pollard to review the legal status
of the City at this time. Mayor Pollard did explain that the
temporary restraining order filed against the City of The Colony
by the Town of Frisco was removed at 9:00 a.m. on this date.
Councilman Adeler clarified that the judge could extend that
or renew that temporary restraining order. Mayor Pollard agreed
that yes this could be done by the judge hearing this particular
case, but as of this time, it has not been done. Mayor Pollard
then called for a vote on the motion on the floor. The motion
carried by the following roll call vote:
Ayes: Ail members present voted aye
Noes: None
2. CONSIDERATION OF ORDINANCE ANNEXING A 258.488 ACRE TRACT
GENERALLY LOCATED ON THE NORTHEAST BOUNDARY OF THE CITY AT
THE INTERSECTION OF SQUIRES STREET AND UNDERWOOD DRIVE
Mayor Pollard read aloud the following caption of the annexation
ordinance (legal description attached as Exhibit C, map attached
as Exhibit D):
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ANNEXING THE HERE-
INAFTER DESCRIBED TERRITORY TO THE CITY OF THE COLONY, TEXAS,
AND EXTENDING THE BOUNDARY LINES OF SAID CITY SO AS TO INCLUDE
SAID HEREINAFTER DESCRIBED TERRITORY WITHIN SAID CITY LIMITS;
GRANTING TO ALL INHABITANTS AND OWNERS OF PROPERTY ALL OF THE
RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING THE INHABITANTS
BY ALL THE ACTS, ORDINANCES AND REGULATIONS OF SAID CITY; PROVIDING
A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.

Councilman Adeler moved to approve this annexation ordinance
as presented. Seconded by Councilman Poole, the motion was passed
by the following roll call vote:
Ayes: Ail members present voted aye
Noes: None
There being no further action to be taken by the Council, Councilman
Parker moved that the meeting be adjourned. Seconded by Councilman
Poole, the motion was passed by the following vote:
Ayes: All members present voted aye
Noes: None
Mayor Pollard adjourned the meeting at 2:30 p.m.
