MINUTES OF THE CITY COUNCIL
OF THE
CITY OF THE COLONY HELD ON
JANUARY 7, 1983
A SPECIAL EMERGENCY SESSION of the City Council of the City of
The Colony, Texas, was called to order at 3:00 p.m. with the
following members present:
Gene Pollard Mayor
Norman Adeler Councilman
Charlie Parker Councilman
Marlene Poole Councilman
and with Councilmen Scott North, Larry Sample and Charles Dodds
not in attendance due to business commitments; however, a quorum
was established.
1. CONSIDERATION OF CALLING A PUBLIC HEARING TO CONSIDER THE
ANNEXATION OF A LAND TRACT LOCATED NORTH AND EAST OF THE
NORTHEAST BOUNDARY OF THE CITY LIMITS UPON THE PETITION OF
UNDERWOOD FINANCIAL CORPORATION
Janice Carroll, City Secretary, advised the Council that it was
necessary for the Council to accept the petition, receive the
service plan and call two Public Hearings, one on the property
and one at City Hall, to begin this annexation procedure. Mayor
Pollard read aloud the following letters:

Re: Request for Annexation
Dear Mayor and Council Members:
Attached hereto are descriptions of various tracts owned
by Underwood Financial Corporation, represented by the under-
signed. By copy, this letter is being presented to Ms.
janice Carroll, City Clerk for The Colony and is intended
to be the undersigned's request for voluntary annexation
into the city of The Colony. The undersigned is the sole
owner of the property which is described in the attachment,
and as to the land described therein, I believe no additional
signatures are necessary for this request.
Please advise if additional steps are necessary to perfect
my request under applicable statutes. I shall await council
action.

Request for Annexation
Dear Mayor and Council Members:
Attached hereto are descriptions of various tracts owned
by Underwood Development Corporation, represented by the
undersigned. By copy, this letter is being presented to
Ms. Janice Carroll, City Clerk for The Colony and is intended
to be the undersigned's request for voluntary annexation
into the city of The Colony. The underwigned is the sole
owner of the property which is described in the attachment,
and as to the land described therein, I believe no additional
signatures are necessary for this request.

Mr. Johnny Sartain, City Manager, presented the following service
plan to the Council:
Service Plan for a 69.360 acre land tract located northeast
of the City limit boundary to be annexed upon the petition
of Underwood Development Corporation and Underwood Financial
Corporation.
In accordance with 970A Section 10B VACS the following is
a statement of governmental service that must be provided
in sixty days and capital imaprovements that must be provided
in two and one-half years.
1. Presently the City does have a contract with Denton
County to provide fire protection to this area and this
service will be continued. The Town of Frisco also provides
service to this area. Ambulance service can be provided
immediately. This land is not developed or inhabited and
a large number of medical calls is not expected.
2. The Police Department will review immediately the
provision of a new district which will provide for patrol
of this area based upon need.
3. Waste collection is presently not needed as there
are no inhabitants.
4. Road and park maintenance can be maintained. There
ae no recreational facilities on this land.
5. No capital improvements, i.e., streets, fire station,
etc., are needed until the land is subdivided and consequently
developed.
6. Water and sewer service is not provided by the
City. This area can request to be included into The Colony
#1 Municipal Utility District for these services.
After discussion, Councilman Parker moved that the Public Hearings
on this land (Attachment "A") be conducted on January 24, 1983,
the one on the property to be held at 6:30 p.m. and the one at
City Hall to be held at 7:00 p.m. Seconded by Councilman Poole,
the motion was passed by the following roll call vote:
Ayes: All members present voted aye
Noes: None
2. CONSIDERATION OF CALLING A PUBLIC HEARING TO CONSIDER THE
ANNEXATION OF A LAND TRACT CONTAINING 302.462 ACRES DUE NORTH
FROM THE NORTHWEST CITY LIMIT BOUNDARY ON WYNNEWOOD PENINSULA
Johnny Sartain, City Manager, did advise the Council that this
annexation was a unilateral annexation based upon his recommen-
dation, and he presented the following service plan for this
area:
Service Plan for a 302.462 acre land tract generally located
due north of the northwest City limit boundary on Wynnewood
Peninsula.
In accordance with 970A Section 10B VACS the following is
a statement of governmental service that must be provided
in sixty days and capital improvements that must be provided
in two and one-half years.

1. Presently the Ctiy does have a contract with Denton
County to provide fire protection to this area and this
service will be continued. Ambulance service can be provided
immediately. This land is not developed and has few inhabi-
tants. A large number of medical calls is not expected.
2. The Police Department' will review immediately the
~rovision of a new district which will provide for patrol

3. Waste collection can be provided upon request.
4. Road and park maintenance can be maintained. There

Councilman Parker moved that the Public Hearinvs for this property
(Attachment "B") be conducted on January 24, 1983, the first
hearing to be held on the property at 5:30 p.m. and the second
hearing to be held at 7:00 p.m. at City Hall. The motion was
seconded by Councilman Adeler and passed by the following roll
call vote:
Ayes: All members present voted aye
Noes: None
3. CONSIDERATION OF CALLING A PUBLIC HEARING TO CONSIDER THE
ANNEXATION OF 220.165 ACRES LOCATED DUE NORTH OF THE NORTHEAST
BOUNDARY OF THE CITY AT THE INTERSECTION OF SQUIRES DRIVE
AND UNDERWOOD ROAD
At this time, City Manager Johnny Sartain stated that this would
be a unilateral annexation based upon his recommendation and
presented the service plan for this area as follows:
Service Plan for a 220.165 acre land tract generally located
on the northeast city limit line due north of the intersec-
tion of Squires and Underwood and west of the existing County
Road.
In accordance with 970A Section 10B VACS the following is
a statement of governmental service that must be provided
in sixty days and capital improvements that must be provided
in two and one-half years.
1. Presently the City does have a contract with Denton
County to provide fire protection to this area and this
service will be continued. The Town of Frisco also provides
service to this area. Ambulance service can be provided
immediately. This land is not developed or inhabited and
a large number of medical calls is not expected.

Councilman Poole then moved to conduct th Public Hearings on
this property (Attachment "C") on January 24, 1983, at 6:00 p.m.
on the property and 7:00 p.m. at City Hall. Seconded by Councilman

Adeler, the motion was passed by the following roll call vote:
Ayes: All members present voted aye
Noes: None
Mayor Pollard stated that, based upon this agenda item which
represents annexation into land area now involved in litigation,
the Council would meet in a closed door session. The Council
went into a closed door session at approximately 3:30 p.m.
Upon reconvening in open session, Mayor Pollard announced that
no decisions were made at this time. There being no further
action to be taken by the Council, Councilman Parker moved that
the meeting be adjourned. Seconded by Councilman Poole, the
motion was passed by the following vote:
Ayes: All members present voted aye
Noes: None
Mayor Pollard adjourned the meeting at 5:12 p.m.
