HINUTES OE THE CITY COUNCIL
OF THE
CITY OF THE COLONY HELD ON
SEPTEMBER 24, 1982
An EMERGENCY SESSION of the City Council of the City of The Colony,
Texas, was called to order at 10:00 p.m. at City hall with the
following members present:
Gene Pollard Mayor
Scott North Councilman
Larry Sample Councilman
Norman Adeler Councilman
Charlie Parker Councilman
Charles Dodds Councilman
Marlene Poole Councilman
and with no members absent, thus a quorum was established.
1. CONSIDERATION OF AN ORDINANCE ANNEXING A FIFTY ACRE LAND TRACT
GENERALLY LOCATED NORTH OF THE INTERSECTION OF SQUIRES DRIVE
AND TAYLOR STREET UPON TEH PETITION OF LISD
Mayor Pollard stated that this action was subject to litigation
as Mayor John Clanton had presented a letter to that effect at
the hearing conducted on August 23, 1982, and the Council would
now retire to a closed door session as authorized by Article 6252-17
of VACS to discuss the pending litigation.
Upon reconvening in open session, Mayor Pollard read aloud the
following ordinance caption:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ANNEXING THE HEREINAFTER
DESCRIBED TERRITORY TO THE CITY OF THE COLONY, DENTON COUNTY,
TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO
INCLUDE SAID PROPERTY WITHIN SAID CITY LIMITS AND GRANTING ALL
PRIVILEGES OF OTHER CITIZENS AND BINDING ALL INHABITANTS BY ALL
THE ACTS, ORDINANCES AND REGULATIONS OF SAID CITY; PROVIDING FOR
THE EXTENSION OF THE EXTRATERRITORIAL JURISDICTION OF THE CITY;
PROVIDING AN EMERGENCY CLAUSE; PROVIDING SEVERABILITY; AND PROVIDING
FOR AN EFFECTIVE DATE OF SAID ORDINANCE.
Councilman North moved to approve this emergency ordinance to
annex the B. B. Owens 50-acre land tract generally located north
of the intersection of Squires Drive and Taylor Street. The motion
was seconded by Councilman Poole. Mayor Pollard did note that
the City Council was concerned with the acquisition of extraterritorial
jurisdiction by the Town of Frisco and the protection of The Colony's
future jurisdiction. Mayor Pollard then called for a vote on
the motion on the floor. The motion carried by the following
roll call vote:
Ayes:Councilmen North, Sample, Adeler, Parker,
Dodds and Poole
Noes:None
Abstention: Mayor Pollard
There being no further action to be taken by the Council at this
time, Councilman North moved that the meeting be adjourned.
Seconded by Councilman Dodds, the motion carried by the following
vote:
Ayes: Ail members present voted aye
Noes: None
Mayor Pollard adjourned the meeting at 11:00 p.m.
