HomeMy WebLinkAbout08/23/1982 City Council-SS 001251 MINUTES OF THE CITY COUNCIL OF THE CITY OF THE COLONY HELD ON AUGUST 23, 1982 A SPECIAL SESSION of the City Council of the City of The Colony, Texas, was called to order at 7:00 p.m. at the B. B. Owens land site generally located at the intersection of Taylor Street and Squires Drive, with the following members present: Gene Pollard Mayor Scott North Councilman Norman Adeler Councilman Charlie Parker Councilman Charles Dodds Councilman Marlene Poole Councilman and with Councilman Larry Sample not in attendance; however, a quorum was established. 1. PUBLIC HEARING REGARDING ANNEXATION OF A 50-ACRE TRACT OF LAND GENERALLY LOCATED ON THE NORTHERN BOUNDARY OF THE CITY AT THE INTERSECTION OF SQUIRES DRIVE AND TAYLOR DRIVE Councilman Parker moved to open the Public Hearing. Seconded by Councilman Adeler, the motion was passed by the following vote: Ayes: Ail members present voted aye Noes: None At this time, Mayor Pollard read aloud the legal notice published to conduct this Hearing. City Manager Dan Savage referred to the letter from Dr. V. M. Burkett, Superintendent of the Lewis- ville Independent School District. He explained that this letter served as a petition requesting that the City of The Colony annex this property within their City limits. He advised that the desccription of this property, as contained in records at the Denton County Courthouse, Denton, Texas, is that tract and parcel of land situated in the M. Hunt Survey, Abstract No. 624, Denton County, Texas, and the part of the tract of land described in the deed from Raymond Reeves to B. B. Owen, recorded in Volume 539, Page 378, of the Deed Records of Denton County, Texas. Further, Mr. Savage advised the Council that the City would have no problem providing services to this land area and that presently fire and ambulance protection was being provided through Denton County contracts. He also stated that water and sewer services could be supplied by the Municipal Utility District. Mayor Pollard then asked for comments for or against this annexation from those present. Gerald Van Meter of 5605 Squires stated that he was against the school being built in this location, primarily due to traffic. Kris Thomas of 5612 Terry also stated that she was against the high school being built in this area. Mrs. Joseph Einig of 5600 Treese said that she also was against a high school in this area. Robin Robertson of 5705 Squires was recognized and asked if it was better to fight the building of a high school in that location if the land were annexed into the City. Mayor Pollard answered that he and the Council felt that this was a better course of action to take and that the City did feel an obligation to provide the services to a high school or any school built on that site Joe Robertson of 5705 Squires asked if the zoning could be used to prohibit the building of a school on this site. Mayor Pollard answered that, although this had not been studied in detail, he felt that it would be difficult for the City to deny zoning to a school in a residential area. Mayor Pollard also gave those present a brief background of the City's potential problems -1- 0012 ;2 in annexing this land. He advised them of Frisco's five-foot strip of extraterritorial jurisdiction which the City would be violating. This could cause some of these questions to be settled in court. Mark Spittel stated that he would recommend that the City refuse to provide any service to that area if this would keep a high school from being built. Elaine Schmidt of 5205 Cook Circle stated that she also was against the high school being located on this site, even though she does not live close to this property. The Council did explain to those present that the school site was donated land to the School District, and if it were not used for a public school, it would revert back to the B. B. Owens trust fund. Councilman Parker also stated that there were other factors involved than just the annexation of this site and urged all of these people in attendance to vote next April for a School Board representative who could adequately represent The Colony. Mr. Spittel asked if pressure could be put on the Utility District to deny service to this area. Sandra Shearer, President of the MUD Board, advised that LISD has petitioned MUD for service. She also stated that the MUD is presently involved in a suit with Frisco for service to the entire area. She stated that a public hearing will be held in the third week of September, which will be open to the public regarding this petition by LISD. There being no further comments for or against this annexation, Councilman North moved to close the hearing. Seconded by Councilman Adeler, the motion was passed by the following roll call vote: Ayes: All members present voted aye Noes: None Councilman North moved that the meeting be adjourned.
