MINUTES OF THE CITY COUNCIL
OF THE
CITY OF THE COLONY HELD ON
MAY 11, 1981
A SPECIAL SESSION of the City Council of the City of The Colony, Texas
was called to order at 7:30 p.m. with the following members present:
Richard Turner Mayor
Scott North Councilman
Norman Adeler Councilman
Gary Shipman Councilman
Dave Brown Councilman
and a quorum was established. ,
1. CANVASS OF MUNICIPAL BOND ELECTION HELD ON MAY 9, 1981
Mr. Dan Almon with the firm of Rauscher, Pierce Refsnes was present to
answer any questions that the Council might have regarding the bond sale
procedure. He advised the Council that the bond market in May was
at 10.9% and that it was difficult to forecast interest rates in the
future. Regarding the sale of bonds, Councilman Shipman felt that it
was imperative to clarify the date that the city must deposit their
funds in an escrow account according to the state. He also asked
Mr. Almon if he felt the interest rate would be lower during the summer
months. Mr. Almon advised the Council that at this time the financial
market could not be predicted but that he did recommend that if possible
the Council should wait for a dip in the market prior to selling these
bonds. At this time the Council considered the following Canvass of
the Municipal Bond Election held on May 9, 1981:
THE STATE OF TEXAS, COUNTY OF DENTON, CITY OF THE COLONY
WHEREAS, the City Council of said City ordered an election
to be held in said City on May 9, 1981, on the PROPOSITION hereinafter
stated; and
WHEREAS, said City Council has investigated all matters
pertaining to said election, including the ordering, giving notice,
officers, holding and making returns of said election; and
WHEREAS, the election officers who held said election have
duly made the returns of the result thereof, and said returns have been
duly delivered to said City Council.
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY:
1. That the City Council officially finds and determines
that said election was duly ordered, that proper notice of said election
was duly given, that proper election officers were duly appointed prior
to said election, that said election was duly held, that due returns of the
result of said election have been made and delivered, and that the City
Council has duly canvassed said returns, all in accordance with law and
the Ordinance calling said election.
2. That the City Council officially finds and determines
that the following votes were cast at said election, on the submitted
PROPOSITION by the resident, qualified electors of said City, who
voted at the election: PROPOSITION
504 VOTES: FOR ) THE ISSUANCE OF $290,000
) STREET IMPROVEMENT TAX
50 VOTES: AGAINST ) BONDS (FOR F.M. 423)

3. That the City Council officially finds, determines and
declares the result of said election to be that the PROPOSITION so sub-
mitted has received a favorable majority vote in all respects and has
carried.
4. That the aforesaid bonds may be issued, and the aforesaid
bond tax may be levied, assessed and collected annually, as voted and
as provided by law.
5. That it is hereby officially found and determined that
a case of emergency or urgent public necessity exists which requires the
holding of the meeting at which this Ordinance is passed, such emergency
or urgent public necessity being that the proceeds from the sale of the
proposed bonds are required as soon as possible and without delay for
necessary and urgently needed public improvements; and that said meeting
was open to the public, and public notice of the time, place and purpose
of said meeting was given, all as required by Vernon's Ann. Civ. St.
Article 6252-17.
6. That a copy of this Ordinance was posted on the bulletin
board at the City Hall 72 hours prior to the meetings at which it was
read.

Councilman Shipman moved to approve this canvass. Seconded by Councilman
North, the motion passed by the following roll call vote:

2. CANVASS OF CITY OFFICER RUNOFF ELECTION HELD ON MAY 9, 1981
CANVASS OF RETURNS AND DECLARATION OF RESULTS OF ELECTION
BE IT REMEMBERED THAT on this the 11 day of May, 1981, at
a meeting of the City Council of the City of The Colony, Texas, a quorum
being present, the meeting was called to order and the following business
transacted.
Upon motion of Councilman Brown and seconded by Councilman
North, it was unanimously ordered that the City Council consider the
official returns of a run-off election held in the City on the above
mentioned date, for the election of City Officers.
WHEREUPON said official returns were opened, examined,
canvassed and the results declared as follows:
CANVASS OF RETURNS AND DECLARATION OF RESULTS
WHEREAS, heretofore, the City Council of the City of The
Colony, Texas, called a run-off election to be held in the City on
May 9, 1981, for the purpose of electing one Councilmember for Place
No. 2, to serve for a two-year term, and one Councilmember for Place
No. 5 to serve for a one-year term;
WHEREAS, immediately after said run-off election the Presiding
Judge and other officials holding said election made their returns of
the results thereof to the City Council as follows, and said returns
being made according to law, and duly authenticated, and it being shown
that written notice of said election was posted for the time and in the

manner provided by law and all other proceedings pertaining to said
election having been shown to have been done and performed at and within
the time and in the manner provided by law, and all papers pertaining
thereto having been returned and filed with the City Council and no
protest or objection being made to or regarding any matter pertaining
to said election;
NOW, THEREFORE, be it resolved by the City Council of the
City of The Colony, Texas, after examining said returns and opening and
canvassing the votes of said run-off election, that the results of said
election are as follows:
That the following number of votes were cast for the following
named candidates for the office of City Councilmember, Place 2, to wit:

Freeman Upchurch 282
That the following number of votes were cast for the following
named candidates for the office of City Councilmember, Place 5, to wit:

Charles T. Dodds 243
P. Dave Brown 266
It appearing that Freeman Upchurch received the highest
number of votes for the office of Councilmember, Place 2, and he is
hereby declared to be elected to the office to serve after qualifying
for a two-year term commencing April, 1981; and
It appearing that P. Dave Brown received the highest number
of votes cast for the office of Councilmember, Place 5, and he is
hereby declared to be elected to the office to serve after qualifying
for a one-year term commencing April, 1981.
IT IS FURTHER ORDERED that this canvass and declaration of
results of said election be entered in the Minutes of the City Council
and that said officers, after they have qualified and taken their oaths,
shall serve during the term commencing April, 1981, and thereafter until
their successors are duly elected and qualified.
That this Resolution, declaring the results of the run-off
election called for May 9, 1981, shall become effective immediately
after its passage.
DULY PASSED by the City Council of the City of The Colony,
Texas, this the 11 day of May, 1981.

Councilman North moved to approve the foregoing canvass. Seconded by
Councilman Adeler, the motion was passed by the following roll call vote:

Mayor Turner stated that the City Council would now meet in a closed-door
session dealing with personnel matters and litigation as authorized by
Article 6252-17 of Vernon's Ann. Civ. Statutes.
Upon reconveni~ in open session, Mayor Turner announced that no
action will be taken on these matters at this t~e. Councilman North
moved to adjourn the meeting. Seconded by Councilman Adeler, the motion
was passed by the following roll call vote:
Ayes: Ail members present voted aye
Noes: None
Mayor Turner adjourned the meeting at 12:15 a.m.
