MINUTES OF THE CITY COUNCIL
OF THE
CITY OF THE COLONY HELD ON
MARCH 30, 1981
A REGULAR MEETING of the City Council of the City of The Colony, Texas
was called to Order at 7:30 p.m. with the following members present:
Richard Turner Mayor
William J. Longo Councilman
Norman Adeler Councilman
Gary Shipman Councilman
Dave Brown Councilman
and with no members absent, a quorum was established.
1. BRIEFING SESSION
The Council did meet in a briefing session for a short period of time to
discuss the following agenda items. No action was taken at this time.
2. APPROVAL OF MINUTES
Councilman Adeler moved that the minutes of March 2, 9, 16 and 23 be
approved as corrected. Seconded by Councilman Brown, the motion was
passed by the following roll call vote:
Ayes: All members present voted aye
Noes: None
3. CONSIDERATION OF FIRST READING OF ORDINANCE CALLING MUNICIPAL
BOND ELECTION FOR MAY 9, 1981
Mr. Tom Hart, City Manager, reported to the Council regarding the cost
of this bond election and how this cost was prorated among the various
entities involved. Mr. Hart then introduced Mr. Dan Almon to brief the
Council on the procedure for calling this bond election, the ten-year
debt schedule and to answer any questions that they might have. The
Council was informed that this proposed bond election would be 1.61¢ on
the present tax rate for the individual homeowner. Councilman Longo
questioned the advisability of using existing bond money to supplement
the cost of this road improvement. After discussion, Mayor Turner asked
what would be other needs that these funds could be appropriated for.
Mr. Hart did advise that, in the summer of 1982, these funds must be
used or we would get into arbitrage problems and that he was of the
opinion that their primary use would be for signalization, which could
run at a cost of $60,000 to $70,000 for one signal. After discussion,
Councilman Brown did note that be was not in favor of using these existing
bond funds to supplement the cost of widening FM 423. The Council did
request a report from the city engineers at the next meeting. Mr. Hart
at this time did read the following ordinance in its entirety:
ORDINANCE CALLING AN ELECTION. THE STATE OF TEXAS, COUNTY OF DENTON,
CITY OF THE COLONY
WHEREAS, this City Council of said City deems it advisable to call
the election hereinafter ordered; and
WHEREAS, it is hereby officially found and determined said meeting
was open to the public, and public notice of the time, place and
purpose of said meeting was given, all as required by Vernon's Ann. Civ.
St. Article 6252-17.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY:

1. That an election shall be held on May 9, 1981, in said City, at
the following designated polling place:
CAMEY ELEMENTARY SCHOOL GYMNASIUM, THE COLONY
Said City shall constitute a single election precinct for said election,
and the following election officers are hereby appointed to hold said
election:
Presiding Judge: Diane Kruzich, Alternate Presiding Judge: Virginia Steward
2. That absentee voting shall be conducted by the City Secretary,
Janice Carroll, at the City Secretary's Office at the City Hall, The
Colony, Texas.
3. That the Presiding Judge shall appoint not less than two qualified
election clerks to serve and assist in conducting said election; provided
that if the Presiding Judge actually serves as expected, the Alternate
Presiding Judge shall be one of such clerks.
4. That by approving and signing this Ordinance the Mayor of said
City officially confirms his appointment of the aforesaid election
officers to serve at said election; and by passing this Ordinance the
governing body of said City approves and concurs in the appointment of
the aforesaid election officers.
5. That all resident, qualified electors of said City shall be
entitled to vote at said election.
6. That notice of said election shall be given by posting a sub-
stantial copy of this Ordinance at the City Hall and at three other places
in said City, not less than 15 days prior to the date set for said election;
and a substantial copy of this Ordinance also shall be published on the
same day in each of two successive weeks in a newspaper of general circula-
tion published in said City, the date of the first publication to be not
less than 14 days prior to the date set for said election.
7. That at said election the following PROPOSITION shall be
submitted in accordance with law:
PROPOSITION: Shall the City Council of said City be authorized to issue
the bonds of said City, in one or more series or issues, in the aggre-
gate principal amount of $290,000 with the bonds of each such series or
issue, respectively, to mature serially within not to exceed 40 years
from their date, and to be sold at such prices and bear interest at such
rates as shall be determined within the discretion of the City Council,
for the purpose of improving the City's streets, and shall said City
Council be authorized to levy and cause to be assessed and collected
annual ad valorem taxes in an amount sufficient to pay the annual interest
on said bonds and provide a sinking fund to pay said bonds at maturity;
8. That the official ballots for said election shall be prepared
in accordance with the Texas Election Code so as to permit the electors
to vote "FOR" or "AGAINST" the aforesaid PROPOSITION, with the ballots
to contain such provisions, markings and language as required by law, and
with such PROPOSITION to be expressed substantially as follows:

9. That a copy of this Ordinance was posted on the bulletin board at
the City Hall 72 hours prior to the meetings at which it was read.

Before passage, the Council did ask Mr. Almon if it would be possible to
clarify the bond proposition by limiting these funds to street improvements
on specifically FM 423. He did advise this could be done if it was the
intent of the political body. At this time, Councilman Shipman did move
to approve the first reading of this ordinance calling a bond election
for May 9, 1981, with the discussed amendment on the wording of the proposi-
tion. Seconded by Councilman Adeler, the motion was passed by the following
roll call vote:

4. CONSIDERATION OF ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER
INTO A CONTRACT WITH RAUSCHER, PIERCE, REFSNES, INC.
Mr. Hart advised the Council that we have previously had a 36-month
contract with the firm of Rauscher, Pierce, Refsnes, Inc. and that prior
to the bond issuance, this contract must be renewed if the Council
so desired. Mr. Almon did advise the Council that it was standard and
that nothing had been changed significantly from the first contract and
that the fee paid is based on the amount of bonds sold. At this time,
Mayor Turner read aloud in its entirety the following captioned ordinance:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING THE CITY
MANAGER TO ENTER INTO A CONTRACT FOR FINANCIAL ADVISORY SERVICES WITH
THE FIRM OF RAUSCHER PIERCE REFSNES, INC.; ATTACHING THE APPROVED FORM
OF THE CONTRACT AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE.
Councilman Shipman moved to approve this ordinance upon first reading.
Seconded by Councilman Brown, the motion was passed by the following roll
call vote:

5. CONSIDERATION OF SECOND READING OF THE FOLLOWING ORDINANCES REGARDING THE TMRS BENEFIT PROGRAM
A. PARTICIPATION IN THE TEXAS MUNICIPAL RETIREMENT SYSTEM
Mayor Turner read aloud the following caption:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, PROVIDING FOR PARTICIPATION
IN THE TEXAS MUNICIPAL RETIREMENT SYSTEM BY THE CITY OF THE COLONY, TEXAS.
Councilman Longo moved that this ordinance be approved upon second reading.
Seconded by Councilman Adeler, the motion was passed by the following roll
call vote:
Ayes: Ail members present voted aye
Noes: None
B. PARTICIPATION IN SUPPLEMENTAL BENEFITS FUND OF TMRS
Mayor Turner read aloud the following captioned ordinance:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, PROVIDING FOR PARTICIPATION
IN THE SUPPLEMENTAL BENEFITS FUND OF THE TEXAS MUNICIPAL RETIREMENT SYSTEM
BY ALL DEPARTMENTS OF THE CITY GOVERNMENT WHICH NOW PARTICIPATE IN THE
TEXAS MUNICIPAL RETIREMENT SYSTEM; AND PROVIDING FOR PAYMENT OF THE CITY'S
CONTRIBUTIONS ON ACCOUNT OF SUCH PARTICIPATION.
Councilman Brown moved to approve this ordinance upon second reading.
Seconded by Councilman Shipman, the motion was passed by the following roll
call vote:

Mayor Turner read aloud the following captioned ordinance:

Councilman Brown moved to approve this ordinance upon second reading.

Mayor Turner read aloud the following captioned ordinance:

POLICIES ~NUAL; ATTACHING THE ~AL AS EXHIBIT "A"; PROVIDING A

Councilman Adeler moved that this ordinance be approved upon second
reading. Seconded by Councilman Lo~o, the motion was passed by the
following roll call vote:

Noes: None
There being no further action to be taken by the Council, Councilman
Shipman moved that the meeting be adjourned. Seconded by Councilman
Brown, the motion was passed by the following roll call vote:
Ayes: All members present voted aye
Noes: None
Mayor Turner adjourned the meeting at 8:30 p.m.
