MINUTES OF THE CITY COUNCIL
OF THE
CITY OF THE COLONY HELD ON
FEBRUARY 23, 1981
A REGULAR MEETING of the City Council for the City of The Colony, Texas
was called to order at 7:30 p.m. with the following members present:
Richard Turner Mayor
William J. Longo Councilman
Linda A. Adams Councilman
Norman Adeler Councilman
Dave Brown Councilman
and with Councilman Gary Shipman absent due to business; however, a quorum
was established.
1. BRIEFING SESSION
The briefing session was held by the Council from 7:30 until 8 p.m. to
discuss the following agenda items No action was taken.
2. APPROVAL OF MINUTES
Councilman Adams moved that the minutes of February 2, February 9 and
February 16 be approved as presented. Seconded by Councilman Adeler, the
motion was passed by the following roll call vote:
Ayes: All members present voted aye
Noes: None
EMERGENCY ITEM--RECEIVED REQUEST FROM COLONY YOUTH BASEBALL ASSOCIATION
REGARDING THE USE OF CITY HALL
Mayor Turner stated that the CYBA had requested to use the City Hall
additionally on Saturday, February 28 for additional registration pro-
cedures. He did add that while they had used the City Hall on previous
Saturday, they had left everything in perfect order and this was appre-
ciated by City Hall staff. Councilman Longo then moved to approve the use
of City Hall by the CYBA on February 28, 1981. Seconded by Councilman
Adams, the motion was passed by the following roll call vote:

3. CONSIDERATION OF ORDER CALLING MUNICIPAL ELECTION FOR APRIL 4, 1981
Mayor Turner read aloud the following order:
ELECTION OF MUNICIPAL OFFICERS
The City of The Colony, Texas
April 4, 1981
ELECTION ORDER
BE IT REMEMBERED THAT on the 23 day of February, 1981, at
a meeting of the City Council of the City of The City of The Colony,
Texas, a quorum being present, the meeting was called to order and the
Council issued the following order:
IT IS ORDERED that an election be held in the City of
The City of The Colony, Texas, on the 4th day of April, 1981, the same
being the first Saturday of said month for the following purpose:
To elect a Mayor for a two year term; one Councilmember
for Place Number 1 for a two year term; one Councilmember for Place
Number 2 for a two year term and one Councilmember for Place Number 5
for a one year term.
The candidate for each such office receiving a majority of
all votes cast for all candidates for such office shall be elected for
such term.

In the event any candidate for any one of said offices
fails to receive a majority of all votes cast for all the candidates for
such office, a run-off election shall be called as provided for by the
Charter of the City.
The polling place for said election shall be The Camey
Elementary School.
The polls shall be open from 7:00 o'clock a.m. to 7:00
-o'clock p.m.
None but legally qualified voters of the City shall be
entitled to vote at said election.
Notice of said election shall be posted in three public
places within the limits of the City at least thirty (30) days prior to --'
the election day. A return of such posting shall be made by affidavit
of the City Secretary.
A Presiding Election Judge and an Alternate Presiding
Election Judge shall be appointed to serve at each polling place by written
order of the Mayor, approved or signed by at least a majority of the members
of the governing body of the municipality.
The Presiding Judge for each polling place shall appoint
two Election Clerks and as many additional Clerks as are necessary for the
proper conduct of the election. Provided, however, ten shall be the
maximum number of Clerks which may be appointed to serve at any polling
place. All Judges and Clerks shall be qualified voters in the City.
Absentee voting for the above designated election shall be
held at the regular office of the City Secretary at the City Hall Building,
in said City, and said place of absentee voting shall remain open for at
least eight (8) hours on each day of absentee voting which is not a
Saturday, Sunday or an official State holiday, beginning on the 20th day
and continuing through the 4th day preceding the date of said election.
Said place of voting shall remain open between the hours of 8:00 o'clock
a.m. and 5:00 o'clock p.m.
After holding said election, the Election Judges shall
promptly make their returns to the City Secretary and to the Mayor, and
the Secretary shall thereafter present such returns to the City Council for
the canvassing of said election. The Presiding Election Judge shall be
paid the sum of $3.00 per hour, plus an additional sum of $20.00 for his ._.
services in delivering the returns of the election. The Alternate Presi-
ding Election Judge shall be paid the sum of $3.00 per hour and each
Election Clerk shall be paid the sum of $3.00 per hour for their services
in holding the election. Such payments shall not exceed the maximum
amounts set out in Article 3.08, Texas Election code, to-wit: $3.00
per hour for each election official, plus an additional amount paid to
the Presiding Judge for delivering the returns, not to exceed $20.00.

Councilman Adams then moved that the Election Order be approved as read, with
the clarification on the amount to be paid the election clerks hourly. Secon-
ded by Councilman Longo, the motion was passed by the following roll call vote:
Ayes: All members present voted aye

4. PRESENTATION BY PARK & RECREATION DEPARTMENT TO NICK OPREA
Rick Herold, Director of Park & Recreation, presented a plaque to Nick
Oprea for his contribution to The Colony Men's Flag Football Association.
Mayor Turner did present the award on behalf of the City and added that
the Council did appreciate the contributions Mr. Oprea had made to providing
recreation within The Colony.

5. CONSIDERATION OF AUTHORIZING THE EXPENDITURE OF CITY FUNDS FOR THE
DEVELOPMENT OF SPORTS FIELDS AT "NORTH COLONY PARK"
Mr. Herold reviewed for the Council the fact that on August 8, 1980, they
did approve the expenditure of $3,952.81 for the purpose of various items
to complete the construction of fields on North Colony. At this time, he
would like to ask the Council to reinstate that amount that has not already
been purchased and add an additional sum of $1,000 to make an amended total
of $3,565 to have the fields ready for spring and fall seasons. Councilman
Longo explained that these monies were not included in the 1980-81 budget
and he felt like there must be an amendment before the monies could be
spent by the City. Mr. Herold further explained that these monies would be
used for six baseball fields, two football fields, seven soccer fields,
plastic bags for additional litter control and a simple parking area. The
City Council did concur that these expenditures should be made by the City
and that the City Manager should check on the most expedient legal procedure
for the expenditure of these funds, and bring it back to the Council at
the next regular meeting.
6. CONSIDERATION OF FIRST READING OF ORDINANCE AUTHORIZING CITY MANAGER
TO ENTER INTO TWO CONTRACTS FOR THE PURCHASE OF COMMUNICATION EQUIP-
MENT FROM MOTOROLA AND GENERAL ELECTRIC
Mayor Turner read aloud in its entirety the following captioned ordinance:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING THE CITY
MANAGER TO ENTER INTO TWO PURCHASE ORDERS FOR COMMUNICATION EQUIPMENT
WITH THE FIRMS OF MOTOROLA AND GENERAL ELECTRIC, ATTACHING THE APPROVED
PURCHASE ORDERS AS EXHIBITS "A" AND "B"; AND PROVIDING AN EFFECTIVE DATE.
After a brief discussion,Councilman Adams moved that the ordinance be
approved relating one correction that the Civil Defense radio proposed to
be purchased from General Electric in the amount of $1,075 be removed,
making the total sum on the budget for General Electric $7,497. The motion
was seconded by Councilman Adeler. Councilman Longo stated that this Civil
Defense radio should be placed in the next budget as it was certainly needed
but not budgeted at this time. Mayor Turner then called for a vote on the
motion on the floor. The motion was passed by the following roll call vote:

7. CONSIDERATION OF FIRST READING OF ORDINANCE AMENDING COMPREHENSIVE
ZONING ORDINANCE CHANGING DUPLEX REQUIREMENTS
Mayor Turner read aloud in its entirety the following captioned ordinance:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING THE COMPREHENSIVE
ZONING ORDINANCE OF THE CITY OF THE COLONY BY AMENDING SECTION 11-201 TO
PROVIDE A MINIMUM LOT WIDTH IN THE DUPLEX DISTRICT OF SIXTY FEET (60');
AMENDING SECTION 11-301 TO PROVIDE A MINIMUM FLOOR AREA PER DWELLING UNIT
IN THE DUPLEX DISTRICT OF EIGHTEEN HUNDRED SQUARE FEET (1,800 sq. ft.);
AMENDING SECTION 11-702 TO PERMIT A CARPORT TO BE CONSTRUCTED IN A DUPLEX
DISTRICT A MINIMUM OF TEN FEET (10') FROM THE SIDE STREET OR ALLEYWAY;
PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED
DOLLARS ($200.00) FOR EACH OFFENSE; PROVIDING A SEVERABILITY CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
Councilman Adams moved to approve this ordinance upon first reading. Coun-
cilman Brown seconded this motion. Prior to passage, Councilman Longo stated
that he did feel that it was a priority item that a definition of carport
be established and incorporated into the zoning ordinance. At this time,
Mayor Turner called for a vote on the motion on the floor. The motion was
carried by the following roll call vote:

8. CONSIDERATION OF FIRST ~ADING OF O~INANCE AMENDING CO~REHENSIVE
ZONING ORDINANCE ~LOWING A SPECIFIC USE/CHURCH ZONING
Mayor Turner read aloud in its entirety the following captioned ordinance:
AN O~INANCE OF THE CITY OF THE COLO~, TEXAS, AMENDING THE COMPREHENSIVE
ZONING ORDINANCE OF THE CITY OF THE COLO~ SO AS TO CHANGE THE PROPER~
DESCRIBED HEREIN AS FOLLOWS:
Being a tract of land situated in the James L. Sparks Survey,
Abstract No. 1179, Denton County, Texas, and being located in the City
of The Colony, Texas, and being more particularly described as follows:
BEGINNING at the intersection of the west line of Anderson Drive
and the north line of Keys Drive;
THENCE in a westerly direction along the north line of Keys Drive
with a curve to the left, Chord Bearing N 85 degrees 51' 59" W, said
curve having a central angle of 08 degrees 49' 58" and a radius of
800.00 feet, and arc distance of 123.33 feet;
THENCE S 89 degrees 43' 02" W continuing along said north line,
50.78 feet;
THENCE N 00 degrees 59' 58" W, 533.02 feet;
THENCE N 89 degrees 00' 02" E, 669.50 feet to a point in the west
line of Anderson Drive;
THENCE S 43 degrees 43' 35" W along said west line, 631.85 feet;
THENCE in a southerly direction continuing along said west line
with a curve to the left, said curve having a central angle of 33 degrees
01' 39" and a radius of 191.16 feet, an arc distance of 110.19 feet to
the place of beginning and containing 5.000 acres of land.

PERMIT FOR A CHURCH; PROVIDING FOR SPECI~ CONDITIONS; PROVIDING FOR THE

Councilman Adams moved that this ordinance be approved upon first reading.
Councilman Brown seconded this motion. Councilman Longo stated that he
was concerned regarding parking requirements. Councilman Adams advised
that this could be covered on site plan. There being no further discussion,
Mayor Turner called for a vote on the motion on the floor. The motion was
carried by the following roll call vote:
Ayes: All members present voted aye
Noes: None
There being no further action to be taken by the Council, Councilman
Adeler moved that the meeting be adjourned. Seconded by Councilman Adams,
the motion was passed by the following roll call vote:
Ayes: All members present voted aye
Nones: None
Mayor Turner adjourned the meeting at 8:35 p.m.
