MINUTES OF THE CITY COUNCIL
OF THE
CITY OF THE COLONY HELD ON
OCTOBER 27, 1980
A REGULAR SESSION of the City Council of The City of The Colony
was called to order at 7:30 p.m. with the following members
present:
Richard Turner Mayor
William J. Longo Councilman
Norman Adeler Councilman
Gary Shipman Councilman
Greg Norwood Councilman
and with Councilman Linda A. Adams not in attendance, as she
was attending a Methodist Hospital Board meeting as official
representative of the city; however, a quorum was established.
1. BRIEFING SESSION
The Council did meet in briefing session from 7:30 to 8 p.m.
to discuss the following agenda items. No action was taken
at this time.
2. CONSIDERATION OF SITE PLAN APPROVAL FOR THE COLONY PARK
BAPTIST CHURCH PERMANENT BUILDING PLANS
Rev. Bill Tinsley and Rev. David Bird did present to the
Council the site plans as prepared for future growth of the
Colony Park Baptist Church. The first phase, Rev. Bird
explained, woUld accommodate approximately 200 people
and would eventually be used only for Sunday School. The
second phase, which would be the permanent sanctuary, would
accommodate 300 people. The projected construction date is
January of 1982. This date is dependent upon outside finan-
cial support and the existing interest rates, but Rev. Bird
did assure the Council that he and his congregation were
anxious to begin construction as soon as possible. Coun-
cilman Adeler asked what type of construction would be
implemented by the church. He was advised that this is a
prefabricated structure at a cost to the church of approxi-
mately $180,000. After discussion, Councilman Longo was
concerned that the agenda item was not worded adequately
to allow the Council to approve an extension of the use of
the portable building. Mr. Bradburry, Director of Community
Development, did advise the Council that the portable buil-
dings were now meeting city codes, and he saw no problem
with their continued use. It was agreed that this would
be put back on the agenda for further action.
3. CONSIDERATION OF SECOND READING OF ORDINANCE AMENDING THE
COMPREHENSIVE ZONING ORDINANCE TO CHANGE THE PROPERTY
DESCRIBED AS 1.838 ACRE TRACT LOCATED AT PAIGE ROAD AND
KISOR DRIVE TO OFFICE DISTRICT ONE CLASSIFICATION
Mayor Turner read aloud the following captioned ordinance:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF THE COLONY
SO AS TO CHANGE THE PROPERTY DESCRIBED AS A 1.838 ACRE
TRACT OF LAND AT THE CORNER OF PAIGE ROAD AND KISOR DRIVE
TO OFFICE DISTRICT ONE CLASSIFICATION; PROVIDING FOR THE
AMENDMENT OF THE ZONING DISTRICT MAP; PROVIDING FOR A
PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS
($200.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE.

Councilman Shipman moved to approve this ordinance upon
second reading. The motion was seconded by Councilman
Longo. Mr. Hart stated that he had discussed with the city
attorney the problem of placing private racquetteball Courts
within an Office One Zoning Classification. He told the
Council the attorney did advise that this area be zoned
as a Planned Development District. Mr. Hart requested that
the Council waive conditional application fee for Dr.
Seidler but that the zoning change procedure be implemented
a second time to change the classification of this 1.838
acre land tract to a Planned Development District. Mayor
Turner then called for a vote on the motion from the floor.
The motion was passed by the following roll call vote:
Ayes: All members present voted aye
Noes: None
At this time Councilman Shipman made a second motion that
the Council waive all permit fees for Dr. Seidler for a
second zoning application. Seconded by Councilman Norwood,
the motion was passed by the following roll call vote:
Ayes: All members present voted aye

4. CONSIDERATION OF SECOND READING OF ORDINANCE AMENDING THE
COMPREHENSIVE ZONING ORDINANCE TO CHANGE THE PROPERTY DES-
CRIBED AS A TWO ACRE LAND TRACT LOCATED ON CAMEY ROAD TO
A GENERAL RETAIL CLASSIFICATION
Mayor Turner read aloud the following captioned ordinance:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF THE COLONY
SO AS TO CHANGE THE PROPERTY DESCRIBED AS 2.00 ACRES OF LAND
OUT OF THE BBB & CRR COMPANY SURVEY, ABSTRACT 172, DENTON
COUNTY, TEXAS AND BEING THE SAME PROPERTY CONVEYED TO J.
Y. EBERHART AND VERA M. EBERHART BY DEED DATED FEBRUARY 21,
1978, RECORDED IN VOLUME 876, PAGE 25, OF THE DEED RECORDS
OF DENTON COUNTY, TEXAS TO "GR" GENERAL RETAIL DISTRICT
CLASSIFICATION; PROVIDING FOR THE AMENDMENT OF THE ZONING
DISTRICT MAP; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED
THE SUM,OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE;
AND PROVIDING AN EFFECTIVE DATE.
Councilman Norwood moved that this ordinance be approved
upon second reading. Seconded by Councilman Shipman,
the motion was passed by the following roll call vote:
Ayes: Ail members present.voted aye

5. CONSIDERATION OF SECOND READING OF ORDINANCE AMENDING
THE CITY ORDINANCE NO. 38 REGARDING FENCE PERMIT FEES
Mayor Turner read aloud the following captioned ordinance:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING
SECTION 4 OF ORDINANCE NO. 38; PROVIDING A MINIMUM COST OF
PERMIT FEE FOR A FENCE OF TWELVE DOLLARS ($12.00) FOR EACH
PERMIT; AND PROVIDING AN EFFECTIVE DATE.
Councilman Shipman moved that this ordinance be approved
upon second reading. Seconded by Councilman Adeler, the
motion was passed by the following roll call vote:
Ayes: Councilmen Adams, Adeler, Shipman and Norwood
Noes: Councilman Longo

6. RECEIVED REPORT REGARDING NERVE PROGRAM MEETING
Councilman Adeler advised the City Council and members
of the audience that he did attend the meeting at Lewis-
ville High School, and representatives from Flower Mound,
Lewisville and Highland Village were also present. The
Carrollton Youth Program was explained in detail, however,
the realistic cost figure for such a program seemed to
be from $50,000 to $80,000, and it was Councilman Adeler's
opinion that The Colony should not be involved at this
time in such an expensive program but should initiate an
internal city youth program working in conjunction with
the Ministerial Alliance and other city organizations.
Police Chief Ristegno further explained that the Carrollton
program was geared for first and second-time offenders
and that The Colony crime problem was not with initial
youth offenders but chronic offenders. He further stated
that geography would in actuality create a problem for
The Colony in participating in this'type of combined
program and that the expense was prohibitive. He did
advise the Council that he did have a meeting scheduled
with Ron Salfen, and he did expect to meet at a later
date with the Ministerial Alliance. After a lengthy
discussion Councilman Longo did state he felt that the
city staff or Council should meet with other members of
the community to devise The Colony's own youth program.
Chief Ristagno stated that he would meet with the Ministerial
Alliance and report back to the City Council regarding the
progress.
7. CONSIDERATION OF ESTABLISHING NOVEMBER 10 AS A REGULAR
MEETING DATE
Janice Carroll, City Secretary, advised the Council that
this was a necessity in order that the second reading
of the Tax Levy Ordinance be approved as soon as possible.
Councilman Longo moved that November 10 be established as
a regular City Council meeting date. Seconded by Council-
man Adeler, the motion was passed by the following roll
call vote:

8. PUBLIC HEARING ON AD VALOREM TAX RATE INCREASE AS PROPOSED
BY THE MUNICIPAL BUDGET 1980/81
Councilman Shipman moved that the Public Hearing be
opened. Seconded by Councilman Norwood, the motion was
passed by the following vote:
Ayes: Ail members present voted aye
Noes: None
Mayor Turner then stated that the tax rate was proposed
to be increased from the existing 19 cents to 37 cents.
This represented an average total cost per home of $11.70,
Mr. Hart advised. There being no comments from the mem-
bers of the audience for or against this tax increase,
Councilman Norwood moved that the hearing be closed. Seconded
by Councilman Shipman, the motion was passed by the following
roll call vote:
Ayes: Ail members present voted aye

9. CONSIDERATION OF PERMIT FEE POLICY AS AUTHORIZED BY THE
UNIFORM BUILDING CODE
Mr. Hart presented to the Council' for their review the

following survey of cities regarding the charging of
school districts on permits.
Anna No Charge
Allen No Charge
Arlington Permit Fees
Frisco Permit Fees
Flower Mound No Charge
Grapevine Permit Fees
Hurst Permit Fees
Lewisville No Charge
There followed a lengthy discussion regarding this
permit fee. Councilman Longo felt very strongly that
the city should consider the advisability of charging
when the city was dependent on the use of the schools
for various activities. Councilman Norwood stated that
he had no problem with charging the Lewisville Independent
School District a permit fee. It was noted by Councilman
Adeler that the surveys need to point out that large
cities without revenue problems did not charge school
districts, however small cities with a lack of substantial
revenue did charge. It was concurred by the Council
that The Colony did need an additional revenue source.
Mr. Hart did agree that the school district probably should
have been notified earlier of this plan to charge a permit
fee, however, he did note that all contractors had been
notified of this. After further discussion, Councilman
Adeler moved that the city no longer waive permit fees to
any government entities building within the city limits
of The Colony. Seconded by Councilman Norwood, the
motion was passed by the following roll call vote:
Ayes: All members present voted aye
Noes: None
There being no further action to be taken by the Council,
Councilman Norwood moved that the meeting be adjourned.

Mayor Turner adjourned the meeting at 8:45 p.m.
