MINUTES OF THE CITY COUNCIL
OF THE
CITY OF THE COLONY HELD ON
SEPTEMBER 15,1980
A Regular Meeting of the City Council was called to order at
7:30 p.m. with the following members present:
Gary Shipman Mayor Pro Tem
Linda A. Adams Councilman
Norman Adeler Councilman
Greg Norwood Councilman
and with Mayor Richard Turner out of town and not able'to
attend; and Councilman William J. Longo also was not in att-
endance dhe!~to a prior commitment.
1. BRIEFING SESSION
The Council met in a briefing session from 7:30 to 8:00 p.m.
to discuss the items under consideration. No action was taken
on this agenda item.
2. APPROVAL OF MINUTES
Councilman Adams moved that the minutes of the Regular Session
held on August 18, August 25, September I and September 6 be
approved with the following corrections: the September 6
minutes should reflect 1¢ rather than 1.5¢ transferred from
the bond account; and it should be noted that at that meeting
a 38.24 tax rate was figured which did not include the library
package, but now was figured at 38¢ which does include the
library package. Seconded by Councilman Adeler, the motion
was carried by the following roll call vote:
Ayes: All members present voted aye
Noes: None
3. CONSIDERATION OF REPLAT ON SECTION 22
Mr. Chuck Sidor, Fox & Jacobs presented to the Council the
correditions technical corrections to be made to show the
proper easement along the alleyways. Mr. Bradburry, Director
of Community Development, advised that the changes were nece-
ssary. After brief discussion, Councilman Norwood moved that
the corrected replat be approved for filing in Denton County
reco~s. Seconded by Councilman Adams, the motion was passed
by the following roll call vote.
Ayes: All members present voted aye
Noes: None
4. CONSIDERATION OF PROPOSED SOUTHWESTERN BELL FRANCHISE
ORDINANCE
The Council reviewed the standard Franchise Ordinance provided
to them by Southwestern Bell. Councilman Adams noted that the
previous CityAttor'~ey. Bill D avis had prepared this ordinance
for passage by The Colony with various changes relating to
underground wiring and tree triming. Councilman Shipman
requested that the staff obtain copies of franchise ordinance
adopted by other cities for the Councils use during further
review and study. Councilman Adans did maintain that she was
against charging Southwestern Bell as this franchise tax was
a direct passthrough to the citizens. Councilman Norwood
maintained that this was a more equitable tax to the citizens
The Council did concur that H. Louis Nichols should review
this ordinance and prepare it for passage.

5. CONSIDERATION OF FIRST READING OF ORDINANCE ESTABLISHI-
ng over 65 exemption
Janice Carroll, City Secretary, requested that the passage of
this ordinance be tabled in order that the attorney have
sufficient time to prepare a ordinsnce awarding this exemp-
tion and a disability exemption in the amount of $10,000.
Coucilmen Norwood so moved. Seconded by Councilman Adams, the
motion was passed by the following roll call vote:
Ayes: All members present voted aye
Noes: None
There being no further action to be taken by the CounCil,
Adams moved that the meeting be adjourned. Seconded by Coun-
cilman Adams, the motion was passed by the following roll call
vote:
Ayes: All members present voted aye
Noes: None
Mayor Pro Tem Shipman adjourned the meeting at 8:50 p.m.
