MINUTES OF THE CITY COUNCIL
OF THE
CITY OF THE COLONY~ HELD ON
NOVEMBER 26, 1979
A REGULAR ~ETING of the City Council of the City of The Colony
was called to order with the following members present:
Richard Turner Mayor
William J. Longo Councilman
Linda A. Adams Councilman
Sandra Shearer Councilman
Gary Shipman Councilman
and with Councilman Chris Fabian absent due to illness; however, a
quorum was established.
1. APPROVAl. OF ~INUTES
Councilman Shipman moved that the minutes of the Regular Meeting
held on November 5, 1979 be approved. Seconded by Councilman Shearer,
the motion was passed by the following roll call vote:
Ayes: Councilmen Adams, Shearer and Shipman
Noes: None
Abstention: Councilman Longo
Councilman Adams moved to approve the minutes of the Regular Meeting
held on November 12, 1979. Seconded by Councilman Longo, the motion
was passed by the following roll call vote:
Ayes: Councilmen Longo, Adams
Noes: None
Absention: Councilmen Shearer, Shipman
8. CONSIDERATION OF PEPLAT OF COLONY FINAL PLAT #24
Mayor Turner then moved to item Number 8 as Mr. Cravens with Fox and
Jacobs did have to leave the meeting Mr. Cravens explained that
the one hundred twenty feet (120') allowed at the intersection of
North Colony and F.M. ~423 was not adequate right of way and should
be widened by twenty (20') feet. After a brief discussion, Council-
man Shearer moved to approve this replat of Final Subdivision
Plat #24. Seconded by Councilman Shearer, the motion was passed by
the following roll call vote:
Ayes: All members present voted aye
Noes: None
2. PUBLIC HEARING ON ANNEXATION OF SEVEN TP~CTS OF LAND BY
PETITION INTO THE CITY, SIX TRACTS BY FOX & JACOBS, INC.
AND ONE BY COLONIAL BAPTIST CHURCH, A CORPORATION
Councilman Shearer moved to open the Public Hearing. Seconded by
Councilman Adams, the motion was passed by the following roll call
vote:
Ayes: All members present voted aye
Noes: None
Mr. Hart presented a map showing the location of the five tracts
being petitioned in by Fox & Jacobs and one land tract being peti-
tioned in bv Colonial Baptist Church, a Corporation. There were no
statements for or against this annexation. Councilman Longo moved
to close this Public Hearing. Seconded by Council Adams, the motion
was passed by the following roll call vote:
Ayes: All members present voted aye

3. CONSIDERATION OF FIRST READING OF ORDINANCE UNILATERALLY
ANNEXING A .499 ACRE TPgCT, SAID OW~..E~, BEI~G LIBBY PEARSON
Mayor Turner read aloud the following captioned ordinance:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ANNEXING THE
HERINAFTER DESCRIBED TERRITORY TO THE CITY OF THE COLO~]Y, DENTON
COUNTY TEXAS AND EX_EMDI~G THE BOUNDARY LIMITS OF SAID CITY SO
AS TO INCLUDE SAID PROPERTY ~ITHI~ SAID CITY LI~ITS AND GRANTING
ALL PRIVILEGES OF OTHER CITIZENS AND BINDING ALL INHABITANTS BY
ALL THE ACTS, ORDINANCES AND ~£GULATION? OF SAID CITY: PROVIDING _.

Councilman Longo moved that this ordinance be approved on first
reading. The motion was seconded by Councilman Adams. Prior
to voting it was noted that the legal specified that the land
tract was located in the City of Frisco which was incorrect.
Councilman Shipman asked that this be clarified by the attorney.
The motion was passed by the following roll call vote:

4. CONSIDERATION OF SECOND READING OF CITY ORDINANCE i~81 AN~EX-
ING IN A SIX ACRE TRACT AND A THP~E ACRE TRACT LOCATED WEST
OF F.M. #423, O~']ED BY MARK KENNING D~D VIRGIL ETCHIESON
RESPECTIVELY
Mayo~ Turner read aloud the following caption:

Councilman Adams moved that City Ordinance #81 be approved on
second reading. The motion was seconded by Councilman Shipman.
Prior to voting, Mrs. Kenning, owner of one of the land tracts,
asked what services the City would provide The Council advised
that Fire and Police services would be provided by the City. The
motion was then passed by the follcwing vote:
Ayes: All members present voted aye

5. CONSIDERATION OF FIRST READINC OF O~DINANCE AUTHORIZING
SIGNATURES FOR ALL FINANCIAL VOUCHERS AND WARRANTS FOR THE
CITY
Mr. Hart advised the Council that an ordinance establishing
signature authorization on all warrants for the City must be passed
in accordance with the Home Rule Charter. It is the Council's
decision regarding the bookkeeper signing checks and the number ~
of signatures required on warrants over ONE THOUSAND ($1,000.00)
DOLLARS stated Mr. Hart. After the discussion, the Council agreed
that a Councilmember should sign checks rather than the bookkeeper.
and that all warrants above ONE THOUSAND ($1,000.00) DOLLARS
should have three signatures. Mr. Hart read the following captioned
ordinance aloud with these corrections:

Councilman Shipman moved that this ordinance be approved on first
reading. Seconded by Councilman Adams, the motion was passed by
the following roll call vote:

6. CONSIDERATION OF A CITY DEPOSITORY CONTRACT
Prior to discussion, Councilman Longo removed himself from the
Council table and stated that he would not vote on this contract
as he owned stock in the bank. Mr. Hart introduced the contract
with The Colony Bank for their review and comments. Councilman
Adams was concerned with the time period prescribed in Section 5
pertaining to overdrafts. Mr. Hart stated that it would be three
days per the proposals. Councilman Adams then moved to authorize
Tom Hart to enter into this contract with The Colony Bank. Seconded
by Councilman Shipman, the motion was passed by the-following roll
call vote:
Ayes: All members present voted aye

7. CONSIDEP~TION OF FIRST READING OF ORDINANCE AUTHORIZING A ROAD
MAINTENANCE AGREEMENT WITH THE TEXAS DEPARTMENT OF HIGh, JAYS AND
PUBLIC TRANSPORTATICN
Mr. Hart read aloud the following captioned ordinance:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, PROVIDING FOR
THE EXECUTION BY THE >~YOR OF THE CITY OF A MUNICIPAL MAINTENANCE
AGREEMENT WITH THE STATE OF TEXAS; ATTACHING THE FOP~ OF SUCH
AGREEMENT AS EXHIBIT "A~'. PROVIDING FOR AN EFFECTIVE DATE.
Councilman Adams moved to approve this ordinance on first reading.
Seconded by Councilman Shearer, the motion was passed by the following
roll call vote:
Ayes: All members present voted aye
Noes: None
Mayor Turner called a ten minute recess prior to proceeding to
Agenda Item #9, Executive Session dealing with personnel as authorized
by Article 6252-17 VACS.
There being no further action to be taken by the Council, Councilman
Adams moved to adjourn the meeting. Seconded by Councilman Shearer,
the motion was passed by the following roll call vote:
Ayes: Ali members presented voted aye
Noes: None
The meetipg was adjourned by Mayor Turner at 10:30 P.M.
