HomeMy WebLinkAbout08/27/1979 City Council 000 2 MINUTES OF THE CITY COUNCIL OF THE CITY OF THE COLONY HELD ON AUGUST 27, 1979 A REGULAR MEETING of the City Council was called to order with the following members present: Richard Turner Mayor William J. Longo Councilman Linda A. Adams Councilman Sandra Shearer Councilman Gary Shipman Councilman Chris Fabian Councilman and with no members absent; thus a quorum was established. 1. EXECUTIVE SESSION - PERSONNEL Mayor Turner announced that the Council would meet in Executive Session dealing with personnel as authorized by Article 6252-17, Section 2 VACS. 2. CONSIDERATION OF THE FIRST READING OF ROAD ABANDONMENT ORDINANCE Mr. Tom Hart, City Manager, read the following captioned Ordinance in it's entirety: AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS ABANDONING PORTIONS OF GRIFFIN ROAD (ALSO KNOWN AS CAMEY ROAD), AND FOURTH AP~ MEMORIAL ROAD IN FAVOR OF ABUTTING PROPERTY OWNER, INTER- NATIONAL BUSINESS MACHINES CORPORATION FOR AND IN CONSIDERATION OF THE SUM OF $ 117,529.00 ; PROVIDING THAT SUCH ABANDONMENT SHALL BE ALL THE INTEREST WHICH THE CITY MAY LEGALLY AND LAWFULLY ABANDON; PROVIDING THAT SAID ORDINANCE SHALL CONSTITUTE A QUICK CLAIM DEED THAT MAY BE RECORDED WITHIN THE COUNTY CLERK OF DENTON COUNTY, TEXAS; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Tom Hart stated that this Ordinance does leave Fuqua Road open to State Highway #121 and will not be closed until Paige Road is widened. The money to be received by the City is a pro- rata portion of the total amount to be paid to the City for the abandonment of these roads. At this time Mr. Medeley, a member of the audience was recognized by Mayor Turner. Mr. Medeley told the Council that he was a landowner on Camey Road east of the St. Louis San Francisco Railroad tracks and he was opposed to through traffic on Camey Road. However, he also opposed the use of the portion of Fourth Army Memorial road located east of the railroad for through traffic. Council- man Longo assured Mr. Medeley that this would be taken into consideration. After further discussion, Councilman Shearer moved to approve the first reading of the road abandonment Ordinance. Seconded by Councilman Shipman, the motion was passed by the following roll call vote: Ayes: All members present voted aye Noes: None 3. RECEIVE A REPORT ON THE RECREATION PROGRAM FOR THE CITY Councilman Shipman moved to table this item until the next scheduled meeting. Seconded by Councilman Fabian, the motion was passed by the following roll call vote: Ayes: All members present voted aye Noes: None 4. CONSIDERATION OF SECOND READING OF BOND ISSUANCE ORDINANCE Mayor Turner read the following caption: · 000424 AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS THE STATE OF TEXAS : SERIES 1979 COUNTY OF DENTON : DATE AUGUST 1, 1979 IN THE C%TY OF THE COLONY : PRINCIPAL AMOUNT OF $805,000. WHEREAS, the bonds hereinafter authorized were lawfully and favorably voted at an election duly held in said City on April 7, 1979; and WHEREAS, none of the general obligation bonds voted at said __ election has been authorized, issued or delivered; and WHEREAS, it is necessary and advisable to authorize, issue and deliver an installment or series of said bonds; WHEREAS, the bonds hereinafter authorized and designated were voted and are to be issued and delivered pursuant to Article 1175 V.A.T.C.S. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY. Councilman Shipman moved to approve the bond issuance Ordinance on second reading. Seconded by Councilman Fabian, the motion was passed by the following roll call vote: Ayes: Ail members present voted aye Noes: None 5. CONSIDERATION OF SECOND READING OF ORDINANCE CALLING A PUBLIC HEARING FOR THE PROPOSED BUDEGT FY 1979/80 Mayor Turner read the following caption: AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS PROVIDING --- FOR A PUBLIC HEARING ON THE MUNICIPAL BUDGET FOR THE FISCAL YEAR OCTOBER 1, 1979 THROUGH SEPTEMBER 30, 1980; PROVIDING A i TIME AND PLACE FOR SAID PUBLIC HEARING, TO-WIT: ON THE 10 DAY OF SEPTEMBER, 1979, AT 7:30 P.M. AT THE COLONY CITY HALL; PRO- VIDING FOR NOTICE; AND DECLARING AN EFFECTIVE DATE. Councilman Fabian moved to approve the budget hearing Ordinance on second reading. Seconded by Councilman Adams, the motion was passed by the following roll call vote: Ayes: All members present voted aye Noes: None 6. CONSIDERATION OF SECOND READING OF ORDINANCE AMENDING ORDINANCE #11, 12 & 23 Mayor Turner read the following caption: AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING ORDINANCES 11, 12 & 23 TO PROVIDE INDEFINITE TERMS OF OFFICE FOR THE CITY SECRETARY, THE CHIEF OF POLICE AND THE MUNICIPAL JUDGE; AMENDING ORDINANCE # 15 TO PROVIDE FOR FIVE (5) MEMBERS OF THE PARK AND RECREATION BOARD AND TO PROVIDE TWO (2) YEAR TERMS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFEC- --~ TIVE DATE. Councilman Shearer moved to approve this Ordinance on second reading. Seconded by Councilman Shipman, the motion was passed by the following roll call vote: Ayes: All members present voted aye Noes: None 7. CONSIDERATION OF SECOND READING OF ORDINANCE AMENDING ORDINANCE #38 Mayor Turner read the following caption: AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AMENDING 0004 5 ORDINANCE #38 BY AMENDING SECTION 6 (c) REGULATING FENCES IN THE FRONT YARD BUILDING SET-BACK AREAS; AMENDING SECTION 9 (a) 2 TO PROVIDE A MINIMUM HEIGHT OF FOUR FEET (4') FOR FENCES AROUND SWIMMING POOLS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Councilman Adams moved that this captioned Ordinance be approved on second reading. Seconded by Councilman Shipman, the motion was passed by the following roll call vote: Ayes: Councilman Longo, Councilman Adams, Councilman Shipman, Councilman Fabian Noes: Councilman Shearer 8. REVIEW AND STUDY OF THE PROPOSED BUDGET FY 1979/80 The Council discussed the use of the money to be received from International Business Machines for the abandonment in relation to the budget. Mr. Hart recommended that a portion of this money be used to purchase a portable building to be used for Municipal offices and the balance to be used for capital ex- penditures. The Council felt that they must consider the use of this money in the budget to keep the tax rate as low as possible. Councilman Fabian stated that he feels that the tax-payers money should not be used in a contigency reserve. Councilman Longo urged the Council to make a decision regarding a Municipal building, the sharing of this building with the utility district, and the specific use of the balance of the road abandonment monies. Mayor Turner stressed that the Council must have cost figures on a building before any decisions can be made. 9. OTHER MATTERS THAT MAY COME UP BEFORE THE COUNCIL Municipal Utility District board member, Wes Grey, stated that they were having a meeting Thursday evening regarding the cross training of their employees for fire and ambulance emergencies. Mr. Jerry Wise, owner of a shop in The Colony Shopping Center, stated that he was concerened about the children riding bicycles on the sidewalk and wanted to know if this could be controlled. The Council did direct the staff to investigate this request. · Mr. Hart then briefed the Council on the following subjects: (1) IPA Grant (2) Juvenile Grant (3) City Limit Signs (4) Reduced Speed Limits on SH 121 and F.M. 423 (5) Widening of F.M. 423 (6) Parks & Recreation (7) School Crosswalk Guards and Signs (8) Annexation (9) Lone Star Gas Gate Rate Increase Request There being no further action to be taken by the Council, Councilman Longo moved to adjourn.
