HomeMy WebLinkAbout05/25/1979 City Council 000,382 MINUTES OF THE CITY COUNCIL OF THE CITY OF THE COLONY HELD ON MAY 2S, 1979 A Special Session of City Council was held on May 2S, 1979 with the following members present: Sandra Shearer Mayor Pro Tem Bill Longo Councilman Linda Adams Councilman Chris Fabian Councilman and with Councilman Gary Shipman absent; however, a quorum was established. 1. CANVASS OF RECOUNT OF RETURNS OF THE ELECTION HELD MAY 19, 1979. After reviewing the report presented by the recount committee, Mayor Pro Tem Shearer read aloud the following canvass: CANVASS OF RETURNS AND DECLARATION OF RESULTS OF THH RECOUNT OF PAPER BALLOTS IN MUNICIPAL RUN-OFF ELEC- TION OF THE CITY OF THE COLONY, MAY 19~ 1979 BE IT REMEMBERED that on the 25 day of May, 1979, at a meeting of the City Council of the City of The Colony, Texas, a quorum being present, the meeting was called to order and the following business was transacted. WHEREAS, on the 21st day of May, 1979, the City Council of the City of The Colony, Texas, passed a canvass of returns and declara- tion of results of election with regard to the run-off election for municipal officers held on May 19, 1979, and WHEREAS, two of the candidates in said run-off, namely Virginia McCollum and Bill Gagan, made due application for a full recount of the paper ballots used therein in accordance with Article 9.38a, Texas Election Code, and WHEREAS, the City Council forthwith appointed Wanda Gall and Connie Belote as a recount committee under the provisions of said Article, and appointed Glenda Davis as Chairman thereof, set the 24th day of May at 1:00 p.m. at the City Hall as the time and place for such recount, and WHEREAS, the committee has conducted such recount as directed, has made out its report and delivered it to the Mayor Pro Tem along with the locked ballot boxes with the original contents intact and the ballot box keys to the Chief of Police, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, after examining the report of the recount committee, not later than two (2) days after receiving such report, the results of the election for the office of Mayor and for the office of Council Member, Place 2 (for a two (2) year term), on the basis of the revised returns, are as follows: That the number of votes were cast for the following named candi- dates for the office of Mayor, to-wit: NAME NUMBER OF VOTES Richard Turner 201 Virginia McCollum 200 That the following number of votes were east for the following named candidates for the office of City Council Member, Place 2 (for a two (2) year term), to wit: NAME NUMBER OF VOTES Linda A. Adams 203 Bill Gagan 199 000383 It appearing that Richard Turner received the highest number of votes for the office of Mayor on the basis of the revised re- turns, he is hereby declared to be elected to the office to serve after qualifying for a two (2) year term commencing April, 1979; and It appearing that Linda A. Adams received the highest number of votes for the office of Council Member, Place 2, she is hereby declared to be elected to the office to serve after qualifying for a two (2) year term commencing April, 1979; IT IS, FURTHER ORDERED that this canvass and declaration of results of the recount of said election be entered in the minutes of the City Council and that said officers, after they have quali- fied and taken their oaths, shall serve during the term commencing April, 1979, and thereafter until their successors are duly elected and qualified. That this resolution declaring the results of the recount of the run-off election called for May 19, 1979, shall become effective immediately after its passage. Dillard III CITY ATTORNEY Councilman Longo moved to approve this canvass of the recount of the returns of the run-off election held on May 19, 1979. Seconded by Councilman Fabian, the motion was passed by the following roll call vote: Ayes: Ail members present voted aye. Noes: None 2. ADMINISTER OATHS OF OFFICE Mayor Pro Tem Shearer administered the oaths of office to Richard Turner as Mayor of the City of The Colony and to Linda A. Adams as Councilman Place Two. There being no further action to be taken by the Council, Councilman Fabian moved that the meeting be adjourned. Seconded by Councilman Adams, the motion was passed by the following roll call vote: Ayes: Ail members present voted aye.
