000356 MINUTES OF THE CITY COUNCIL OF THE CITY OF THE COLONY HELD ON APRIL 9, 1979 A SPECIAL SESSION of the City Council was called to order with the following members present: William J. Longo Mayor Linda A. Adams Councilman Sandra Shearer Councilman Gary Shipman Councilman and Councilman Clint Davis was not in attendance due to a business commitment; however, a quorum was established. 1. APPROVAL OF MINUTES Councilman Shipman moved that the minutes of the Regular Session held on January 15, 1979, the Special Session held on March 26, 1979 and the Regular Session held on April 2, 1979 be approved, as pre- sented. Seconded by Councilman Adams, the motion was passed by the following vote: Ayes: All members present voted aye Noes: None 2. OFFICIAL CANVASS OF THE CITY OFFICIAL ELECTION HELD ON APRIL 7, 1979 The Council then proceeded to canvass the election results as follows: ELECTION OF MUNICIPAL OFFICERS The Colony, Texas April 7, 1979 CANVASS OF P~TURNS AND DECLARATION OF RESULTS OF ELECTION BE IT REMEMBERED THAT on this the 7th day of April, 1979, at a meeting of the City Council of the City of The Colony, Texas, a quorum being present, the meeting was called to order and the following business was transacted. Upon motion of Councilmember Sandra Shearer and seconded by Councilmember Gary Shipman, it was unanimously ordered that the City Council consider the official returns of an election held in the City on the above mentioned date, for the election of City Officers. WHEREUPON said official returns were opened, examined, can- vassed and the results declared as follows: CANVASS OF RETURNS AND DECL~RATI©N OF ~$ULTS I~EREAS, heretofore, the City Council of the City of The Colony, Texas, called an election to be held in the City on April 7, 1979, for the purpose of electing a Mayor, one Councilmember for Place No. 1 and one Councilmember for Place No.2, each to serve for two-year terms and also to elect one Councilmember for Place No. 5 to serve for a one-year term; and WHEREAS, immediately after said election the Presiding Judge and other officials holding said election made their returns of the results thereof to the City Council as follows, and said re- turns being made according to law, and duly authenticated, and it being shown that written notice of said election was posted for the time and in the manner provided by law and all other proceed- ings pertaining to said election having been shown to have been done and performed at and within the time and in the manner pro- vided by law, and all papers pertaining thereto having been re- turned and filed with the City Council and no protest or objection · 000357 being made to or regarding any matter pertaining to said election; NOW, THEREFORE, be it resolved by the City Council of the City of The Colony, Texas, after examining said returns and opening and canvassing the votes of said election, that the results of said election are as follows: That the number of votes were cast for the following named candidates for the office of Mayor, to-wit: NAME NUMBER OF VOTES Virginia McCollum 183 Norman H. Adeler 154 Sandra Shearer 55 Richard Turner 351 That the following number of votes were cast for the following named candidates for the office of City Councilmember, to-wit: Councilmember, Place 1 (for a two-year term): NAME NUMBER OF VOTES Bill Longo 465 H. Clint Davis 284 Councilmember, Place 2 (for a two-year term): NAME NUMBER OF VOTES Eddie Toms 186 Linda A. Adams 274 Bill Gagan 287 Councilmember, Place 5 (for a one-year term): NAME N~4BER OF VOTES James Bonds 190 Lowell O. Tullis 121 Chris Fabian 410 It appearing that no candidate received the highest number of votes cast for the office of Mayor, and a runoff is required; and It appearing that Bill Lon~o received the high- est number of votes cast for the office of Councilmember, Place 1, and he is hereby declared to be elected to the office to serve after qualifying for the term commencing April, 1979; and It appearing that no candidate received the highest number of votes cast for the office of Councilmember, Place 2, and a runoff is required; and It appearing that Chris Fabian received the highest number of votes cast for the office of Councilmember, Place 5, and he is hereby declared to be elected to the office to serve after qualifying for a one-year term commencing April, 1979: IT IS, FURTHER ORDERED that this canvass and declaration of results of said election be entered in the Minutes of the City Council and that said officers, after they have qualified and taken their oaths, shall serve during the term commencing April, 1979, and thereafter until their successors are duly elected and qualified. -2- 000358 That this Resolution, declaring the results of the election called for April 7, 1979, shall become effective immediately after its passage. OFFICIAL CANVASS OF THE MUNICIPAL BOND ELECTION HELD ON APRIL 7, 1979 The Council then proceeded to canvass the Bond Election results as follows: P~SOLUTION CANVASSING ELECTION RETURNS THE STATE OF TEXAS : COUNTY OF DENTON : CITY OF THE COLONY : WHEREAS, the City Council of said City ordered an election to be held in said City on April 7, 1979, on the PROPOCITIONS hereinafter stated; and ~IE~A$, said City Council has investigated all matters pertaining to said election, including the ordering, giving notice, officers, holding and making returns of said election; and ~EKEA$, the electio~ officers who held said election have duly made the returns of the result thereof, and said returns have been duly delivered to said City Council. BE IT P~.v. SOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY: 1. That the City Council officially finds and determines that said election was duly ordered, that proper notice of said election was duly given, that proper election officers were duly appointed prior to said election, that said election was duly held, that due returns of the result of said election have been made and delivered, and that the City Council has duly canvassed said re- turns, all in accordance with law and the Ordinance calling said election. 2. That the City Council officially finds and determines that the following votes were cast at said election, on the - 3 - 000359 submitted PROPOSITIONS by the resident, qualified electors of said City, who voted at the election: PROPOSITION NO. 1 355 VOTES: FOR ) THE ISSUANCE OF $810,000 ) MUNICIPAL AND POLICE BUILDING 420 VOTES: AGAINST ) TAX BONDS PROPOSITION NO 2 545 VOTES: FOR ) THE ISSUANCE OF $480,000 ) FIRE STATION TAX BONDS 235 VOTES: AGAINST ) PROPOSITION NO 3 496 VOTES: FOR ) THE ISSUANCE OF $155,000 ) PARK TAX BONDS 280 VOTES: AGAINST ) PROPOSITION NO 4 274 VOTES: FOR ) ) THE ISSUANCE OF $305,000 496 VOTES: AGAINST ) SWIMMING POOL TAX BONDS PROPOSITION NO 5 435 VOTES: FOR ) ) THE ISSUANCE OF $25,000 335 VOTES: AGAINST ) ANIMAL SHELTER TAX BONDS PROPOSITION NO 6 610 VOTES: FOR ) ) THE ISSUANCE OF $145,000 175 VOTES: AGAINST ) STREET IMPROVEMENT TAX BONDS 3. That the City Council officially finds, determines and declares the result of said election to be that the PROPOSITIONS NOS. ~ , ~ , >, 6 , , , so submitted have received a favorable majority vote in al-l--respects and have carried, and PROPOSITION NOS. 1 , 4 , , , , , have failed. 4. That the aforesaid bonds may be issued, and the afore- said bond tax may be levied, assessed and collected annually, as voted and as provided by law. 5. That it is hereby officially found and determined that a case of emergency or urgent public necessity exists which re- quires the holding of the meeting at which this Ordinance is passed, such emergency or urgent public necessity being that the proceeds from the sale of the proposed bonds are required as soon as possible and without delay for necessary and urgently needed public improve- ments; and that said meeting was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Vernon's Ann. Civ. St. Article 6252-17. APPROVED AS TO LEGALITY OF FORM: CITY ATTORNEY - 4 - 000360 Councilman Shipman moved to approve said canvass. Seconded by Councilman Shearer, the motion was passed by'the following roll call vote: Ayes: Ail members present voted aye Noes: None 4. REVIEW AND STUDY OF THE PROPOSED ORDINANCE ADOPTING THE MECHANICAL, ELECTRICAL AND PLUMBING CODES Mr. Hart, City Manager and Mr. Bradburry, Director of Community Development presented the ordinance adopting the Uniform Mechanical. National Electrical and Uniform Plumbing Codes for the City of The ' Colony for the Council's review and study. After discussion, Mr, Hart stated that this would be on next week's agenda for consideration of passage. There being no further action to be taken by the Council, Councilman Shipman moved that the meeting be adjourned. Seconded by Councilman Adams, the motion was passed by the following role call vote: Ayes: Ail members present voted aye Noes: None Mayor Longo adjourned the meeting at 8:30 P.M.
