MINUTES OF THE CITY COUNCIL
OF THE
CITY OF THE COLONY, TEXAS HELD ON
MARCH 19, 1979
A Regtular Meeting of the City Council was called to order with the
following members present:
William J. Longo Mayor
Clint Davis Councilman
Linda A. Adams Councilman
Sandra Shearer Councilman
Gary Shipman Councilman
and with no members absent; %bus, a quorum was established.
V MINUTES OF PREVIOUS COUNCIL MEETINGS
Councilman Davis moved to approve the minutes of the Special Session held
on March 12, 1979. Seconded by Councilman Shearer, the motion was passed
by the following roll call vote:
Ayes: Councilman Davis, Shearer and Shipman
Noes: None
Abstention: Councilman Adams
VIII NEW BUSINESS
1. CONSIDERATION OF STREET LIGHTING ON THE EXTENSION OF NORTH COLONY BOULEVARD
Councilman Davis stated that based on the additional information presented in
Mr. Bradburry's memo, he moved that the street lighting on the extension of
North Colony Boulevard be approved as presented by Texas, Power and Light.
Seconded by Councilman Shearer, the motion was passed by the following roll
call vote:
Ayes: All members present voted aye
Noes: None
2. CONSIDERATION OF A SECOND READING OF THE PROPOSED HEALTH ORDINANCE
Tom Hart, City Manager read the following caption:
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, REGULATING
THE FOOD HANDLING AND FOOD SERVICE AND SUPPLY ESTABLISHMENTS;
PROVIDING DEFINITIONS; PROVIDING A SEVERABILITY CLAUSE; PRO-
VIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED
DOLLARS ($200.00) FOR EACH OFFENSE, AND PROVIDING AN EFFECTIVE
DATE.
He paraphrased the Health Ordinance for the benefit of the members of the
audience. He did note that on Page 12 on the fee schedule that it should
reflect a twenty dollar fee for one half of a year rather than fifteen
dollars. Councilman Davis moved to approve the second and final reading
of the Health Ordinance. The motion was seconded by Councilman Shearer.
After a brief discussion, the motion was passed by the following roll call
vote:
Ayes: All members present voted aye

3. CONSIDERATION OF A SECOND READINC OF THE ORDINANCE CALLING A MUNICIPAL
BOND ELECTION FOR APRIL 7, 1979.
Mr. Hart, City Manager, read the following caption of the ordinance calling
the bond election for April 7, 1979:
WHEREAS, IT IS DEEMED NECESSARY AND ADVISABLE TO CALL THE
ELECTION HEREINAFTER ORDERED; AND
WH~AS, IT IS HEREBY OFFICIALLY FOUND AND DETERMINED THAT
SAID MEETING WAS OPEN TO THE PUBLIC, AND PUBLIC NOTICE OF THE
TIME, PLACE AND PURPOSE OF SAID MEETING WAS GIVEN, ALL AS RE-
QUIRED BY VERNON'S ANN. CIV. ST. ARTICLE 6252-17.

Councilman Adams moved to approve this ordi~anee on the second and final
reading. The motion was seconded by Councilman Shipman. In discussion,
Lowell Tullis was recognized and asked what decision had been made regarding
the emergency clause. Janice Carroll, City Secretary, stated that the emer-
gency' clause had been removed,typographical errors corrected, attendance
corrected on the certification and Proposition I changed to reflect that
the building will be used for the police department as well as administrative.
Mayor Longo called for a vote on the motion on the floor. The motion was
passed by the following roll call vote:

CONSIDERATION OF AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO
A CONTRACT WITH THE FIRM OF THOMPSON PARKEY, ASSOCIATES.
Mr. Hart, presented the following ordinance to the City Council.
ORDINANCE
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS AUTHORIZING THE
CITY MANAGER TO ENTER INT0 TWO CONTRACT FOR ARCHITECTURAL
SERVICES WITH THE FIRM OF THOMPSON/PARKEY, ASSOCIATES, INC.
ATTACHING THE APPROVED FORMS OF THE CONTRACTS AS EXHIBITS
"A" AND "B"; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. That the City Manager of the City of The Colony,
Texas, is hereby authorized to execute on behalf of the City
two ~ontracts for architectural services with THOMPSON/PARKEY,
ASSOCIATES, INC. for the design of a municipal building and
fire station for the City. The approved forms of such contracts
are attached hereto as Exhibits "A" and "B", and made a part for
such purposes.
SECTION 2. This ordinance shall take effect immediately from
and after its passage and publication of caption in official
newspaper.

Mr. Hart also presented the contracts to the Council for their review.
Councilman Davis asked if the contracts had been reviewed by the attorney.
Mr. Hart stated that the attorney would review these contracts prior to
the second reading of this ordinance. Mr. Hart explained that two contracts
were needed in the event that one of the propositions, Municipal Building or
Fire Station, fails. There followed a review and discussion regarding interior
design being included, an eight month completion date excluding construction
phase, fees (Section 15.3) being due only after the sale of the bonds, difference
in basic and additional services. Councilman Davis moved to approve the first
reading of this ordinance. The motion was seconded by Councilman Adams. After
a brief discussion, the motion was passed by the following roll call vote:

5. RECEIVE A STATUS REPORT FROM CITY MANAGER
Mr. Hart reported that he attended the Denton County Commissioners meeting
and the CommisSioners did agree to pay one half of the repair bill for the
Dodge Ambulance that the City recently acquired from the County. The am-
bulance is now in service and the engine is under a three month warranty
stated Mr. Hart.

Janice Carroll, City Secretary, gave a brief report on the organizational
meeting of the Fourth of July Celebration Committee. '-
6. ANY OTHER MATTERS THAT MAY COME BEFORE THE COUNCIL
Janice Carroll gave the Council members a memo on the results of the swimming
pool newspaper survey. Out of twenty-four responses, twelve were in favor
of a swimming pool, while tennis courts were requested in seventeen responses.
?. EXECUTIVE SESSION - PERSONNEL
Mayor Longo stated that the City Council would now meet in EXECUTIVE SESSION
dealing with Personnel.
Upon reconvening in open session and their being no further action to be
~ken by the Council, Councilman Davis moved that the meeting be adjourned.
Seconded by Councilman Adams, the motion was passed by the following roll
call vote:
Ayes: Ail members present voted aye
Noes: None
