MINUTES OF THE CITY COUNCIL
OF THE
CITY OF THE COLONY, TEXAS HELD ON
FEBRUARY 27, 1979
An Emergency Called Session of City Council of the City of The Colony,
Denton County, Texas was called to o~der with the following members present:
William J. Longo Mayor
Linda A. Adams Councilman
Sandra Shearer Councilman
Gary Shipman Councilman
and with Councilman Davis and Councilman Pollard not in attendance; however,
a quorum was established.
1. RECEIVE AND ACCEPT THE RESIGNATION OF COUNCILMAN GENE POLLARD
Mayor Longo read the following resignation letter presented to the Mayor
and Councilmen by Councilman Gene Pollard:
TO: The Colony City Council and Mayor
FROM: Gene Pollard

EFFECTIVE
DATE: March 7, 1979
Due to the demand on my time to fulfill my business responsibilities,
I regretfully submit my resignation as Place Five City Council member.
This decision, as you are aware, was not made in haste, but was post-
poned until such time as the voters would have an opportunity to elect
another individual to fill my position.
Although I will no longer be serving as an elected official, my interest
in The Colony and its future has not diminished. I will continue to be
as active in City affairs as time permits, but only as an interested
citizen.
Councilman Shipman moved to accept the resignation of Councilman Gene
Pollard. Seconded by Councilman Adams, the motion was passed by the
following roll call vote:
Ayes: Ail members present voted aye
Noes: None
2. CALL ADDITIONAL SPECIAL ELECTICE TO FILL THE EXISTING VACANCY
(COUNCILMAN - PLACE 5)
Mayor Longo presented the following order to the Council:
BE IT REMEMBERED THAT on this 27 day of February, at a meeting of
the City Council of the City of The Colony, Texas a quorum being present,
the meeting was called to order and the Council issued the following order:
IT IS ORDERED that an election be held in the City of The Colony,
Texas, on the 7th day of April, 1979, the same being the first Saturday
of said month for the following purpose:
"To elect one Councilmember for Place Number 5 to fill an unexpired
term of one year, commencing in April, 1979, until the next regular City
election on the first Saturday in April, 1980."
"The candidate for such office receiving a majority of all votes cast
for all candidates for such office shall be elected for the unexpired term
for Place Number 5."
In the event any candidate for any one of said offices fails to receive
a majority of all votes cast for all the candidates for such office, a run-
off election shall be called as provided for by the Charter of the City.
The polling place for said election shall be the Camey Elementary
School Gymnasium.
The plolls shall be open from 7:00 o'clock a.m. to 7:00 o'clock p.m.
None but legally gualifed voters of the City shall be entitled to

vote at said election.
Notice of said election shall be posted in three public places within
the limits of the City at least thirty (30) days prior to the election day.
A return of such posting shall be made by affidavit of the City Secretary.
The absentee voting for the above designated election shall be held
at the r. egular office of the City Secretary at the City HaL1 Building,
in said City, and said place of absentee voting shall remain open for at
least eight (8) hours on each day of absentee voting which is not a
Saturday, Sunday or an official State holiday, beginning on the 20th day
and continuing through the 4th day preceding the date of said election.
Said place of voting shall remain open between the hours of 8:00 o'clock a.m.
and 5:00 o'clock p.m.
After holding said election, the Election Judges shall promptly make
their returns to the City Secretary and to the Mayor, and the Secretary
shall thereafter present such returns to the City Council for the canvassing
of said election. The Presiding Election Judge shall be paid the sum of
$2.50 per hour, plus an additional sum of $10.00 for his services in delivering
the returns of the election. The Alternate Presiding Election Judge shall
be paid the sum of $2.50 per hour and each Election Clerk shall be paid the
sum of $2.50 per hour for their services in holding the election. Such
payments shall not exceed the maximum amounts set out in Article 3.08,
Texas Election Code, to-wit: $2.50 per hour for each election official,
plus an additional amount paid to the Presiding Judge for delivering the
returns, not to exceed $15.00.
ORDERED this the 27 day of February, 1979.
Councilman Shearer was concerned that Fiscal Impact should be attached.
It was noted that this is an order passed by a Resolution of the Council and
does not require a fiscal impact statement. At this time, Council Shipman
resolved that a Special Election be held on April ?, 1979 to fill the unexpired
term of Councilman Pollard, Place five as outlined in the Election Order.
The Resolution was seconded by Councilman Shearer. A brief discussion was
held regarding the filing deadline. The Council decided that the deadline
should not be extended, but remain March 7, 1979 which corresponds with
the Regular Election deadline. The motion was then passed by the following
roll call vote:

Noes: None
There being no farther action to be taken by the Council, Councilman Adams
moved to adjourn. Seconded by Councilman Shipman, the motion was passed
by the following roll call vote:
Ayes: Ail members present voted aye
Noes: None
Mayor Longo adjourned the meeting at 4:45 P.M.
