OF THE
CITY OF THE COLONY, TEXAS HELD ON
APRIL 3, 1978
A regular meeting of the board of Alderman of the City of
The Colony, Denton County, Texas was called to order by
the Mayor Pro Tem with the following members present
Linda A. Adams Mayor Pro Tem
Cathy Bock Alderman
Dave Dall Alderman
Joe Gau lden Alderman
Sandr a Shearer Alderman
with no members absent.
Item 1. Alderman Shearer moved that the minutes of the reg-
ular meeting held on the 20 day of March, 1978 be approved.
Alderman Gaulden seconded the motion. The motion carried by
the following vote:
Ayes: All member present voted aye
Noes: None
Alderman Bock moved that the minutes of the Joint City Council
and Planning and Zoning Commission Public Hearing and Special
Session held on the 23 day of March, 1978 be approved. Alder-
man Dall seconded the motion. The motion was carried by the
following vote:
Ayes: All members present voted aye
Noes: None
Item 2. The Colony Police Chief, Jim Beltran, was given
the floor to introduce to the members of the audience and
alderman, William Devlin, as the second patrolman on his
force. He stated that Officer Devlin is presently attending
the Council of Governments Police Academy in Arlington,
Texas which he will complete this month. Officer Devlin
thanked Chief Beltran and the Council for the opportunity to
serve the community in this capacity.
Item 3. Mayor Pro Tern Adams introduced and read the following
ordinance:
ORDINANCE #0028
AN ORDINANCE CHANGING THE DESIGNATION OF CERTAIN PROPERTY
FROM RESIDENTIAL TO COMMERCIAL
WHEREAS, the landowners of two tracts, such tracts
being described in Exhibit "A" attached hereto and incor-
porated herein by reference, Tract One containing 5.056
acres of land more or less, and Tract Two containing 10.813
acres of land more or less, both tracts being property
located in The City of The Colony, Texas, having duly re-
quested through zoning request changes procedures to change
the zoning designation of such property from residential
to commercial;
WHEREAS, notice of a public hearing to consider
such zoning change was given in accordance with and in
compliance with the laws of this state, particularly Article
1011d, Vernon's Annotated Civil Statutes, and notices in
accordance with Article 1011e, Vernon's Annotated Civil Sta-
tutes, was given:

WHEREAS, a public hearing to consider the change
of the zoning designation of the land described in Exhibit
"A" attached hereto was held at the City Hall of The City
of The Colony, on March 23, 1978 at 7:30 p.m. and such
public hearing was conducted in accordance with and in com-
pliance with law;
WHEREAS, the Planning and Zoning Commission of
The City of The Colony has recommended to the City Council
of The City of The Colony that such zoning designation be
changed in accordance with the request;
WHEREAS, it is the opinion of the City Council
of The City of The Colony, Texas, that such change is in
the interest of the safety, welfare, morals, and in the
general interest of the citizens of The Colony, Texas;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS
1. That the zoning designation of the land des-
cribed in Exhibit "A" attached hereto be changed from res-
idential to commercial.
2. That this change is a change to the temporary
zoning ordiance which is in effect in The City of The Colony,
Texas.
PASSED AND APPROVED this 3 'day of April ,
1978.

Alderman Bock moved that the above captioned ordinance be
approved. Alderman Dall seconded the motion. The motion
was carried by the following vote:
Ayes: All members present voted aye
Noes: None
Item 4. Alderman Sandra Shearer introduced and briefly re-
viewed a Personnel Manuel to be considered for adoption by,
the Council. Alderman Dall moved that the Personnel Manual
be approved by the Council. Alderman Bock seconded the motion.
Prior to voting Mayor Pro Tern Adams asked for comments. Al-
derman Gaulden was concerned that Item D on page twenty-three
(23) relating to employees involvement in city political act-
ivities was vague and too restrictive. Mayor Pro Tern Adams
~ated that this section was in accordance with the Hatchet
Act. A member of the audience, Gary Shipman, asked if this
manual could be amended. This is only a policy and can be
changed at any time by a motion and vote of the Council,
Mayor Pro Tem Adams answered. There being no further comments,
Mayor Pro Tem Adams called for a vote. The motion was carried
by the following vote:

There came on to be considered the returns of
an election held on the 1 day of April, 1978, for the
purpose of electing the hereinafter named officials, and
it appearing from said returns, duly and legally made,
that there were cast at said election 758 valid and legal
votes; that each of the candidates in said election received

THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL/COMMISSION OF
THE COLONY , TEXAS:
That said election was duly called; that notice of said
election was given in accordance with law, and that said election
was held in accordance with law, and that WILLIA~ J. LONGO was
duly elected Mayor of said City at said election~ and CLINT DAVIS,
SANDRA SHEARER, GARY SHIPMAN, and GENE POLLARD were duly
elected Alderman of said City at said election, and that the

1% Sales Tax Proposition was duly elected by a majority vote,
and said above named parties are hereby declared duly elected
to said respective offices, subject to the taking of their oaths
and filing bond as provided by the laws of the State of Texas.
It is further found and determined that in accordance with
the order of this governing body the Secretary/Clerk posted
written notice of the date, place and subject of this meeting
on the bulletin board located in the City Hall, a place con-
venient and readily accessible to the general public, and said
notice having been posted and remaining posted continuously
for at least 72 hours preceding the scheduled time of said
meeting. A copy of the return of said posting shall be
attached to the minutes of this meeting and shall be made a part
thereof for all intents and purposes.

Alderman Dall seconded the motion. The motion was carried by

Mayor Pro Tem Adams introduced the Mayor and the new members
of the Council and announced that a Special Session to admin-
ister to the newly elected officials the oath of office would
be held on Friday, April 7, 1978 at 8:00 p.m. at the Colony
United Methodist Church.
There being no further agenda items, Mayor Pro Tern Adams asked
for comments from the members of the audience. Bob Brown was
recognized and stated that he was concerned that in City Or-
dinance #9, Section ~2B it states:
(b) The Fire Marshal in charge of the Bureau of Fire
Prevention shall be appointed by the Board of Directors
of The Colony Volunteer Fire Department on the basis of
examination, education and experience to determine his
qualifications.
Mayor Pro Tem Adams answered that the Ordinance must be re-
vised to omit this section which is in error.
Gene Pollard stated that upon review of the city ordinances
he found numerous errors and inconsistencies and asked if
the city attorney had reviewed all ordinances. Mayor Pro
Tern Adams replied that this had not been a consistant practice
in the past, but would be consistently done in the future.
At this time Mary Hundt was recognized by Mayor Pro Tem Adams
and stated that she would like to publicly thank Linda A.
Adams, Mayor Pro Tern, Janice Carroll, and Sandra Shearer for
their cooperation and assistance regarding her interest in
obtaining metro telephone service for the City of The Colony.
Gene Pollard asked when a dog registration drive could be
held. Alderman Shearer replied that one is being planned
for the month of June.
There being no further action to be taken by the Council,
Alderman Bock moved that the meeting be adjourned. The
motion was carried by the following vote:
