MINUTES OF REGULAR MEETING
THE CITY OF THE COLONY
DENTON COUNTY, TEXAS

The City Council of the City of The Colony, Denton County, Texas
convened in regular session open to the public at the First
Baptist Church in the City of The Colony, Denton County, Texas
at 7:30 P.M., Monday October 3, 1977, and the roll was called
of the members of the Council, to wit:
Luis Guerrero Mayor
Linda Adams Alderman
Dave Dall Alderman
Joe Gaulden Alderman
Sandra Shearer Alderman
All members except Alderman Adams were present. Mayor Guerrero
noted that Alderman Adams was visiting her family in Westerville,
Ohio and would return to the Colony this week. Also present
were Bill Davis, Attorney for the City; Janice Carroll, City
Secretary; and members of the audience.
The first agenda item was the approval of the minutes for the
regular meeting of September 19, 1977. There being no corrections,
Alderman Dall moved to accept the minutes as written. Alderman
Shearer seconded the motion. The motion was carried by the
following vote:
Ayes: All members present voted aye
Noes: None
The acceptance of two resignations from the Planning and Zoning
Commission was agenda item two. Mayor Guerrero explained
briefly the circumstances involved. Chairman Mansfield has
bought property outside of The Colony and will be moving in the
near future. Vice Chairman Art Welty, the second resignation,
was asked by the Council to resign due to his appointment to

the Board of Directors of The Colony Municipal Utility District.
Mayor Guerrero stated that Attorney Davis advised the Council
an incompatibility between the two positions could develop.
Mayor Guerrero thanked them for the many long hours of hard
work they had contributed. The Mayo~ then asked for a motion
to accept the resignations. Alderman Shearer made the motion
to accept the resignations of Mike Mansfield and Art Welty
from the Planning and Zoning Commission. Alderman Gaulden
seconded the motion. The motion was carried by the following
vote:
Ayes: All members present voted aye
Noes: None
The third agenda item was the postponement of the October 17
regular Council Session. Mayor Guerrero explained that himself,
Alderman Gaulden, Atderman'~Shearer, and Janice Carroll, City
Secretary plan to attend the Texas Municipal League Annual
Conference being held in San Antonio, Texas on October 15
through October 18. Mayor Guerrero stated that this is the
most important conference of the year for city officials, and
it will be a Valuable source of,i~nformation ~i. Th~s,~.c'o~f, er:ence
will also count towards the certification as a City Secretary
for Janice Carroll, who has begun a two year certification
program. Mayor G uerrero opened the subject for comments by
the Council. After a brief discussion it was decided to post-
pone the regular council meeting until Monday, October 24,
at which time the Council can report on the TML Conference.
Alderman Gaulden moved that it be resolved by the City Council
to postpone the regular meeting of October 17 to OctO. ber 24.
Alderman Dall seconded this motion. The motion was carried
by the following votes:
Ayes: All members present voted aye
Noes: None
The fourth and final agenda item was the appointment of a

Council member to the place vacated by Alderman Weaver's
resignation. Mayor Guerrero asked if the members of the
Council had any comments. Alderman Dall did comment as to
his disagreemnt with the methods used by the Council to
determine the best qualified person in their Executive
Sessions. He emphasized that this pertains to the Council
members only and not to the appointees considered. He felt
that too much political consideration and deceit was involved
in the decision making process. Therefore, he stated that
he would abstain from voting. Mayor Guerrero stated that an
appointment could not be made at this time due to his
abstention from voting. Alderman Dall said he had been advised
that a majority of the members present could approve the
appointment. Attorney Davis asked for a recess to make a
ruling on this. Mayor Guerrero recessed the meeting.
Upon reconvening, Attorney Davis read the portion of Statute
989 that pertains to this situation. It was Attorney Davis'
opinion that the key phrase was "...the majority of the
remaining members of the Council." Therefore, two affirmative
votes could not elect a council member. It must be three out
of four to elect. At this point, Alderman Dall stated that
his comment and subsequent abstention was based on the advice
that this action would not hinder the election procedure.
Alderman Dall felt that it was important to appoint a Council
member at this regular council meeting and moved to appoint
CathyBock as member of the City Council of the City of The Colony.
Alderman Gaulden seconded the motion. The motion was carried
by the following vote:

Mayor ] uerrero then opened the floor for comments from the

audience. Ida Longo was recognized and asked why the procedure
used for the appointment of Alderman Dall was not followed at
this time. Mayor Guerrero stated that the Council felt there
were many qualifed persons to be considered and the previous
procedure does not apply at this point in time. Mayor
Guerrero reminded Ida Longo that Dave Dall's appointment was
made shortly after the election, and the Council felt that
the recent election was a "mandate of the people" and should
be followed. However, the Council had no intention of setting
a precedent at that time. Mayor G uerrero further stated that
it is the general opinion of the Council that Bill Longo is
presently doing excellent job as Chairman of the MuniCiPal
DisaSter ~E~er~gency~Services Committee. Ida Longo stated that
she personally disagreed with the method used and would also
like to know the qualifications of Cathy Bock. Mayor Guerrero
answered by stating that he cannot describe or defend the
methods used by the Council under a closed door session, but
he can tell of Ms. Bock's qualifications. He briefly stated
that her primary accomplishments are in the realms of Planning
and Zoning and Civil Defense. Again, Ida Longo stated that
she did not think it was fair-. She asked Attorney Davis if
he felt a precedent had been set at the time of Alderman Dall's
appointment. Attorney Davis replied that he did not feel that
a precedent had been set. Ida Longo asked if Alderman Adams
had voted on this matter. Mayor G uerrero stated that she had
been consulted but that she did not vote.
Mayor Guerrero then asked if there were any further comments.
Alderman Gaulden was recogninzed. He told the members of the
audience of the formation of a Youth Services Commission and
requested those interested in s~rving on this commission to
contact Janice Carroll at City Hall. He further stated that
several community service organizations had contacted him and
expressed an interest in coming to our city, but these services

must be coordinated.
There being no further action to be taken by the Council,
Alderman Dall moved that the meeting be adjourned. Alderman
Shearer seconded the motion. The motion was carried by the
following vote:
Ayes: All members present voted Aye
Noes: None
The meeting was adjourned by Mayor Guerrero.
