MINUTES OF REGULAR MEETING
CITY OF THE COLONY

The City Council of the City of The Colony, Denton County, Texas
convened in regular session, open to the public, at the First
Baptist Church in the City of The Colony, Denton County, Texas
at 7:30 P. M., Monday, September 19, 1977 and the roll was
called of the members of the Council, to wit:
Luis Guerrero Mayor
Linda Adams Alderman
Dave Dall Alderman
Joe Gaulden Alderman
Sandra Shearer Alderman
All members were present and a quorum was established. Also
present were Bill Davis and John Freeman, attorneys for the
city, Janice Carroll, City Secretary, and members of the
audience.
The meeting was called to order by Mayor Guerrero. The Mayor
explained the evenings format in that an executive session
under closed door will be held.
The first agenda item was the approval of the minutes submitted
for the regular meeting of September 12, 1977. Alderman Dall
moved to accept the minutes as written. Alderman Shearer
seconded the motion. The motion was carried by the following
vote:
Ayes: All members present voted aye

The levying of a fifteen cent Ad Valorum tax was agenda item
number two. Mayor Guerrero emphasized that this is not a tax
increase. The homeowner's mortgage payment will remain the same.
Of the eighty-five cents per one hundred dollar evaluation
presently used, the Municipal Utility District will receive
only seventy cents and the City will receive the additional
fifteen cents. After reading the ordinance aloud, Mayor
G uerrero stated that the tax rolls were approved on June 27,
1977 at the Board of Equalization. All regulations as
stipulated by law have been met. Mayor Guerrero further stated
that the present tax base is $44,700,000. He then asked for
comments. Colonel Gray was recognized and asked if, in fact,
our evaluation would remain the same. Mayor Guerrero and
Alderman Gaulden assured him that the tax rate of eighty-five
cents per one hundred dollar evaluation would remain the
same. Mayor Guerrero explained that the mortgage company that
services the homeowner's loan will_handle this - not the homeowner.
Colonel Gray proceeded to ask another question pertaining to
an exemption allowed for disabled veterans. He has filed this
with the Municipal Utility District and should he refile with
the City? Frank Graham answered that the tax role should reflect
this filing. There being no further comments, Alderman Dall
moved that the fifteen cents per one hundred dollar property
tax be approved by the City. Alderman Adams seconded the
motion. The motion was passed by the following vote:

Prior to recess, Mayor Guerrero asked for nominations for an
appointed council member from the members of the audience;
there were none. Before recess, Attorney Davis asked if he may
explain briefly the taxing timetable. He stated that the 1977
taxes are based on an evaluation completed prior to January 1,
1977. The taxes are due on October 1, 1977 and past due on

January 31, 1978. During the months of January through April
of 1978 all property will be reassesed. This greatly effects
the tax value o6 a new home. Frank Graham noted that Fox &
Jacobs pays the largest port ion~ of the yearly taxes on a
new home.
There bei~ no further comments, Mayor Guerrero recessed the
meeting to reconvene at City Hall in a closed door session.
After the closed door session~,~ Mayor Guerrero reconvened the
regular council meeting. No decisions had been made under the
closed door session and their were no further comments from
the Council or the members of the audience. Mayor Guerrero
asked for a motion to adjourn. Alderman Adams moved that the
meeting be adjourned. Alderman Dall seconded the motion. The
motion was carried by the following vote:
Ayes: All members present voted aye
Noes: None
Mayor ~Guerrero adjourned the meeting at 8:40 P.M.
