MINUTES OF REGULAR MEETING

The City Counc~of the City of The Colony, Denton County,
Texas convened in regular session, open to the public, at the
First Baptist Church in the City of The Colony, Denton County,
Texas at 7:30 P.M., Monday, August 1, 1977, and the role was
called:
Luis Guerrero Mayor
Linda Adams Alderman
Dave Dall Alderman
Joe Gaulden Alderman
Sandra Shearer Alderman
Dick Weaver Alderman
Mayor Guerrero and Alderman Dall were not in attendance; however,
a quorum was established. Also present were John Freeman,
attorney; Janice Carroll, City Secretary; and members of the
audience.
The meeting was called to order by Linda Adams, Mayor Pro
Tem, and members of the audience welcomed.
The first item considered was approval of the minutes sub-
mitted for the regular meeting of July 18, 1977. Mayor Pro
Tem Adams asked for corrections. No corrections being made by
the alderman, Mayor Pro Tem made note that on page four, Linda
Doughty's name was misspelled and should be corrected. Alderman
Weaver moved that the minutes be accepted as corrected. Alderman
Shearer seconded the motion. The motion was carried by the

following vote.
Ayes: Ail members present voted aye
Noes: None
Mayor Pro Tem Adams read aloud the second agenda item, the
Animal Shelter Resolution, which in effect gives the City of
The Colony's approval of the construction of a County Animal
Shelter to be used by small towns in the County of Denton.
Mayor Pro Tem Adams asked the Council if there were any com-
ments. Alderman Weaver voiced the only objection, and this
related to unnecessary legal phrases; the word "whereas" being
the specific example. Alderman Shearer made the motion that
this Resolution be passed. Alderm~:r, Weaver made a second motion
that the resolution be tabled and the format changed. There
was no second to this motion. At this point Alderman~ Gaulden
second, ed the original motion made by Alderman Shearer. The
motion was carried by the following vote.
Ayes: Alderman Gaulden and Alderman Shearer
Noes: Alderman Weaver
Mayor Pro Tern Adams stated that this Resolution will be sent to
the Commissioners' Court of Denton County.
The Social Security Benefits for City Employees Ordinance
was the third item of the Agenda. Mayor Pro Tern Adams read
aloud the ordinance. After completing this reading, Mayor Pro
Tem Adams asked for comments from the Council. There were none.
She then ask~ for comments or questions from the floor regarding
this ordinance and/or the Animal Shelter Resolution. Joe
Murphy was recognized, and he asked how the Shelter would be
financed. Mayor Pro Tem Adams answered that the county would
finance the shelter. At this time Alderman Shearer moved that
the Social Security Ordinance be adopted. Alderman Weaver

seconded the motion. The motion was passed by the following
vote.
Ayes: All members present voted aye
Noes: None
The Ordinance which forms the Park and Recreation Board,
the fourth Agenda item, was paraphrased by Alderman Weaver.
Mayor Pro Tem Adams asked for comments from the Council. There
were none. Mayor Pro Tem Adams then asked if the members of
the audience had any comments or questions. After all questions
concerning this ordinance were answered to the satisfaction of
the members of the audience, Alderman Shearer moved that the
Park and Recreation Ordinance be adopted. Alderman Weaver
seconded the motion. The motion was carried by the following
vote.

A General Nuances Ordinance to be considered was agenda
item number five. Mayor Pro Tem Adams read the ordinance
aloud and then asked for comments from the Council. Alderman
Shearer made note that in item number three of Section Two,
the word "or" should be changed to the word "of". At this
time, Mayor Pro Tem Adams asked for comments from the audience.
A lengthy discussion of this ordinance followed. Jim Stewart
asked that the churches be included in the excessive noise
section of the Ordinance. This correction was agreed upon
by the Council. Judy McConologue asked if the Council was out-
lawing all use of fireworks. After discussion, particularly
as this relates to the Uniform Fire Code, it was decided that
the Council will take this problem into consideration. Frank
Ruth asked that the Council consider a twenty-two hour rather

than a seventy-four hour limit for abandoned vehicles. The
Council concurred with this change. Bill Longo was recognized
and asked if there was anything in this ordinance that pertains
to the blocking of sidewalks. Mayor Pro Tem Adams answered
that there was not and this would be taken into consideration.
There being no further discussion, Mayor Pro Tem Adams asked
for a motion. Alderman Shearer moved that the ordinance be
adopted as amended. Alderman Gaulden seconded this motion.
The motion was carried by the following vote.

Noes: None
Mayor Pro Tem Adams announced that a ten minute recess
would be held before continuing to the next agenda item.
Mayor Pro Tern Adams called the meeting to order and pro-
ceeded with item six of the agenda, an ordinance making unlaw-
ful cer. tain offenses in the City of The Colony. Mayor Pro
Tem Adams read the ordinance and asked for comments from the
Council. Mayor Pro Tem Adams felt that the descriptive word
"officer" should be further defined. Attorney Freeman assured
the Council that this was their perogative. It was so noted
that the Ordinance would be corrected to read "peace officer,
officer of the city or fireman". Mayor Pro Tem Adams then
asked for comments from the audience. A lengthy discussion
was held. Bill Longo stated his concern tha't bow and arrow,
crossbow, and slingshot was not included in this Ordinance.
Attorney Freeman recommended that these weapons be placed in
a separate ordinance because of possible language conflicts,
as this sections is concerned with "firearms" only. Bill
Longo was also concerned that t~ere was nothing included to
require commercial operators to provide litter cans for customers.

Attorney Freeman answered that this Ordinance does not concern
itself with commercial establishments. Mayor Pro Tem advised
Mr. Longo that this item would be taken into consideration at
a later date.
There being no further comments, Alderman Weaver moved
that the ordinance be adopted as corrected. Alderman Shearer
seconded the motion. The motion was carried by the following
vote.

Alderman Gaulden was given the floor to present the
seventh agenda item, the appointment of the Police Chief for
the City of The Colony. Alderman Gaulden stated the main
consideration for this position was a person that would meet
state qualifications as well as the abilities needed to fill
the position of The Colony's Police Chief, and he felt that
Jim Beltran's qualifications met both requirements superbly.
Alderman Gaulden briefed the members of the audience on Jim
Beltran's background and stated that he would be sworn in at
the next Council meeting, August 15, 1977. At this time Alder-
man Gaulden moved that .Jim Be.ltran be appointed as Police Chief
for the City of The Colony to be effective August 15, 1977.
Alderman Weaver seconded the motion. Mayor Pro Tem Adams
asked for questions or comments from the members of the audience.
After all questions were answered, the motion was carried by
the following vote.
Ayes: All members present voted aye

There being nor further business to be considered by the
Council, Mayor Pro Tem Adams opened the meeting for comments

or questions from the members of the audience.
Mrs. Weaver was recognized and she told of an incident
where she was able to dial Dallas numbers as a local call.
She then asked, why can The Colony not have metro lines if
this can be done presently by mistake. Mayor Pro Tem Adams
answered that action is continuing on this matter. Frank
Graham, Fox and Jacobs, further clairified that a new proposal
of $21.00 for a base rate on a metro line will be presented
to the Public Utilities Commission. Fox and Jacob's lawyers
are continually working on this problem on behalf of The Colony.
Frank Ruth asked how the problem of raising money for the
Fire Department can be handled~ Fire Chief Kimberling answered
that they are investigating the possibility of having donations
included with the water bill. However, there are many legal
entanglements that must be considered when contributions are
being sought within a city's limits.
Bill Longo asked if the author of an ordinance could be
shown on the ordinance itself. Mayor Pro Tem Adams said that
this could be done and would be taken into consideration.
There being no further action to be taken by the Council,
Alderman Shearer moved that the meeting be adjourned, and the
motion was seconded by Alderman Gaulden. The motion was carried
by the following vote.

The meeting was adjourned by Mayor Pro Tem Adams.
