HomeMy WebLinkAbout09/28/2004 Capital Improvements Capital Improvements Advisory Committee September 28, 2004 I MINUTES OF THE CAPITAL IMPROVEMENTS ADVISORY COMMITTEE MEETING HELD ON SEPTEMBER 28, 2004 A meeting of the Capital Improvements Advisory Committee of the City of The Colony, Texas was called to order at 6:30 p.m. on the 28th day of September, 2004 at City Hall with the following members present: Bill J am me, Chairman Marlene Milsak DeVille Hubbard Brian Wade Kirk Mikulec Bill Harrison Vernon Jackson Absent: Mike Barrett - Business Staff: I Tony Johnston, Assistant City Manager Harry Persaud, Director of Development Services Gordon Scruggs, City Engineer Fred Ehler, Senior Engineer Lauren Odell, Planner Sandy V ondersaar, Administrative Assistant With seven (7) members present, a quorum was established and the following items were addressed: 2.0 PUBLIC HEARING 2.1 Hold a public hearing and consider making a recommendation to the City Council regarding Land Use Assumptions and Capital Improvements Plan relating to the Update of Roadway Impact Fees Chairman Jamme opened the public hearing at 6:30 p.m. Mr. Persaud reviewed the Roadway Impact Fee schedule with the Committee. He then introduced the team responsible for the study; Tony Johnston; Assistant City Manager, Gordon Scruggs; City Engineer, Fred Ehler; Senior Engineer, Lauren Odell; Planner and Kimley-Horn and Associates, Inc. representatives; Brad Tribble and Aaron Nathan. I Mr. Tribble gave his presentation. He furnished additional handout materials to the - 1 - Capital Improvements Advisory Committee September 28, 2004 Members, including changes made after distribution of the draft report of the Roadway Impact Fee Update in the Capital Improvements Advisory Committee packet. He also reviewed the goals, Impact Fee basics, Land Use Assumptions and Capital Improvement Plan. He then introduced Mr. Nathan. Mr. Nathan explained Service Areas and Land Use Assumptions. He stated the role of the Capital Improvements Advisory Committee is to validate the study and make recommendations to the City Council. It was mentioned that Impact Fees are not charged to Developers if they have financed the construction of a major arterial road. Chairman Jamme wanted to be assured we do not invalidate our ability to charge Impact Fees in Austin Ranch and Wynnewood Peninsula by excluding those areas from the service area map. Mr. Johnston stated the City can activate Impact Fees at any time and the Developer can be charged. Committee Member Jackson asked if through the Developer's Agreement the Developer gets credit for putting in a major arterial road. Mr. Persaud stated yes. The City would consider a credit. Committee Member Jackson also wanted to know if State law allows the collection of only 50 percent of the road construction costs from the Developer, where does the additional 50 percent come from? Mr. Johnston stated the additional money is obtained from the taxpayer usually through a bond issue. No one else came forward to speak for or against this item. Chairman Jamme closed the public hearing at 7:05 p.m. A motion to make a recommendation to the City Council regarding Land Use Assumptions and Capital Improvements Plan relating to the Update of Roadway Impact Fees, Committee Member Jackson; second Committee Member Wade.
