HomeMy WebLinkAbout05/15/2013 BOA MINUTES CITY OF THE COLONY BOARD OF ADJUSTMENT Wednesday, May 15, 2013 After determining that a quorum was present, the Board of Adjustment of the City of The Colony, Texas convened into Regular Session which was held on Wednesday, May 15, 2013 at 7:00 p.m. in the City Council Chambers located in City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: Board Members Present: Charles Tredo, Chairman; Donna McCright, Vice Chairman; Constance Yahwak; Gerald Odum and Stephen Edwards, Sr. Board Member Absent: none Present from Staff. J. Michael Joyce, Development Services Director; Brooks Wilson, AICP, Senior Planner; Gordon Scruggs, Engineering Director; and Felicia Campa, Acting Recording Secretary. 1.0 CALL REGULAR SESSION TO ORDER Chairman Tredo called the meeting to order at 7:01 p.m. 2.0 ITEM FOR CONSIDERATION 2.1 Consider approval of the minutes of the regular session of the January 16, 2013 Board of Adjustment meeting. It was moved by Vice Chairman McCright to approve the minutes as written, seconded by Board Member Odum. The motion carried (5-0). 3.0 ITEM FOR CONSIDERATION 3.1 BOA 13-0001 - 7405 Kingsbarns Variance Requests Conduct a public hearing, discuss, and consider approval of a variance to Sections 18- 602 and 18-603 limiting the height of fences in the rear and side yard, respectively, to eight feet six inches and to Section I OB-500(d) that no patio or deck may be closer to a property line than three feet, to allow the construction of a tennis court with associated fence on a residential tract of land at 7405 Kingsbarns in The Tribute. Mrs. Wilson presented the staff report. Board Member Odum asked if the City requires a permit for French drain installation. Mr. Scruggs responded affirmatively. Mrs. Wilson followed up in stating that the applicant has submitted plans to the Building Department for the tennis court which will be reviewed contingent after the outcome of tonight's meeting and the French drains will be reviewed as part of those plans. Mr. Scruggs continued by stating that staff will review to ensure that the French drains will hold the capacity necessary for the site. Board Member Odum asked if the review will take into consideration the possible clogging of the French drains. Board of Adjustment Minutes May 15, 2013 Page 2 of 2 Mr. Scruggs stated that during the review, staff will review the capacity as if the French drains were fifty (50) to sixty (60) percent clogged. Vice Chairman McCright asked if the fence installed at the property line would be allowed to be ten (10) feet in height. Mrs. Wilson responded the ordinance allows for fence height to be no more than eight (8) feet six (6) inches in height. Vice Chairman McCright asked what the zoning is around the property. Mrs. Wilson responded the residence is located in a Planned Development zoning district and that the area directly behind the house is golf course and Lake Lewisville. Chairman Tredo asked where the fence will be located on the property. Mrs. Wilson used the tennis court exhibit to show the board members where the fence is proposed to be located on the property. Chairman Tredo asked if there is concern for the noise factor of a tennis court on the property. Mrs. Wilson responded that there is no restriction to tennis noise in the ordinance. Board Member Yahwak asked if the Tribute HOA held a meeting to discuss this item before preparing the letter submitted to staff. Mrs. Wilson responded that she believes a meeting was held as the letter was from their representative. Chairman Tredo opened the Public Hearing. No one came forward. Chairman Tredo closed the Public Hearing. Board Member Odum moved to recommend approval of Item 3.1; seconded Board Member Edwards. The motion carried (4-0-1, Yahwak abstained).
