MINUTES OF THE BOARD OF ADJUSTMENT MEETING
HELD ON WEDNESDAY, OCTOBER 18, 2006
After determining that a quorum was present, the Board of Adjustment of the City of
The Colony, Texas convened into Regular Session which was held on Wednesday,
October 18, 2006 at 7:00 p.m. in the City Council Chambers located in City Hall,
6800 Main Street, The Colony, Texas, at which time the following items were
addressed:
Board Members present: Chairman Duane Saunders, Vice-Chairman Gerald
Odum, Connie Yahwak, Donna McCright, and Cesar Molina.
Board Member absent: Rolando Reyes
CALL REGULAR SESSION TO ORDER AT 7:07 P.M
12.0 I DISPOSITION OF MINUTES
2.1 Consider approval of the minutes of the January 18, 2006 regular session.
Board Member McCright motioned to approve the minutes. Seconded by
Board Member Odum.
Motion carried (4-0)
13.0 PUBLIC HEARING
3.1 Hold a public hearing and consider a variance request to Section 6-75,
Chapter 6 of the Code of Ordinances, relating to the maximum height of a
fence. The property is located at 5040 Lake Vista Drive (BOA06-0001).
Donna Bateman, Director of Development Services, presented a staff report to the
Board.
Jean Hammer, 5040 Lake Vista Drive, The Colony, explained that the contractor
tried to keep the fence level and did not intentionally make the fence nine feet.
Board Member Saunders asked it there was a fence there before and if so what
was the height.
Ms. Hammer stated that the previous fence was sic feet tall.
Board Member McCright asked if the contract was for an eight foot fence.
Ms. Hammer stated yes.
Board Member Molina asked if the previous fence slopping along the property.
Ms. Hammer stated that is was level.
Board Member McCright asked how many panels were nine feet tall.
Ms. Bateman stated that we would need to go out to the property and measure to
be for sure.
The Board went into executive session.
Board Member Saunders asked Ms. Hammer ifthere were any special
circumstances existing on the property relating to size, shape, area, topography,
surrounding conditions and location that do not generally apply to other property
in the same area and the same zoning district.
Ms. Hammer stated that the steepness of the slope does not apply because her
neighbor has the same slope. She stated that her goal was to hide the view of the
commercial buildings on Main Street.
Board Member McCright motioned to approve the variance allowing the
portion that is over eight feet to be permitted and to stay as built. Seconded
by Board Member Yahwak.
Motion carried (4-0), Board Member Odum, abstained.
Meeting adjourned at 8:00 p.m.
