MINUTES OF THE BOARD OF ADJUSTMENT
A meeting of the Board of Adjustment of the City of The Colony, Texas was called to
order at 7:00 p.m. on the lSth day of June, 200S at City Hall with the following members
present:
Mike Catt, Chairman
Duane Sanders, Vice Chairman
Connie Yahwak
Gerald Odum
Donna McCright
Staff:
Donna Bateman, Planning and Development Services Director
David Dodd, City Attorney
Lauren Odell, Planner
Sandy V ondersaar, Administrative Assistant
With five (S) members present, a quorum was established and the following items were
addressed:

ITEM #2 - Receive a report from the City Attorney regarding policies and procedures of
the Board of Adjustment
City Attorney David Dodd furnished the Board Members with a City of The Colony
Board of Adjustment 200S Handbook. He reviewed the major points associated with
being a member of the Board of Adjustment.
Attorney Dodd suggested a standard meeting day and time be determined for all future
Board of Adjustment meetings. A form stating the deadline for applying for a variance
and the date and time of the monthly meeting should be stapled to the top of
the variance application. This will be advantageous to the applicant, board members
and staff.
He also stated the alternate Board of Adjustment member should be in attendance at all
board meetings. If they are seated at the dais there must be a change made to the rules
and procedures of the BOA.
The biggest difficulty for Board Members is to refrain from giving explanations to the
applicant. Once you start talking you become a witness and can be sued. Do not talk to
the applicant before or after the meeting. Direct the applicant to the attorney. If you
have any concerns ask him prior to the meeting or adjourn to an Executive Session.

If a variance is denied Attorney Dodd will have an order available for the members to
sign. By signing this order the ten (10) day appeal process starts immediately and does
not have to be delayed until after the Board of Adjustment minutes have been approved.

None
With no further business, the meeting adjourned at 7:40 p.m.
