HomeMy WebLinkAbout08/19/1992 BOABOARD OF ADJUSTMENT & APPEALS OF THE CITY OF THE COLONY, DENTON COUNTY, TEXAS HELD ON AUGUST 19, 1992 CASE NO. 92-02 A REGULAR SESSION OF THE BOARD OF Adjustments & Appeals of the City of The Colony, Texas, was called to order at 7:33 p.m. with the following members present: Robert Poynter Chairman Rob Bauman Member Lou Gomez Member Gene Poole Member Tim O'Neill Member Vivian Preston Alternate Alton Paris Alternate Quorum Present Mr. Hall (City Manager) was present as the Liaison for the City in the absence of Mr. van Til who was on vacation. Chairman Poynter read an overview of Variance Procedures and Re- Xuirements. 1. PUBLIC HEARING: Consideration of a request for variance by The Colony Masonic Lodge for the construction of a Masonic Lodge on Lots 8 and 9, Block 7, Garza Lake Estates, in a Plann- ed Development (Single Family) district. Member Poole asked that before they started the Agenda he would like to say that he is a Mason and if a conflict of interest he would abstain. Chairman Poynter asked that member Poole abstain. Chairman Poynter asked the staff member (Mr. Hall) to sign in and give his presentation. Mr. Hall said he would be representing the City for this presenta- tion that Mr. van Til who was City Staff Liaison was on vacation and all notices and information that the Board has received had been prepared by Mr. van Til in coordination with him. As opening comment Mr. Hall discussed the request to the Board of Adjustments and Appeals by The Colony Masonic Lodge. The Appeal is located on Lots 8 & 9, Block 7, Garza Lake Estates more commonly refered to be on W. Lake Highland Drive in the Eastvale addition in the City of The Colony. The request is based on properties >resently in a district zoned Planned Development II. The present zoning ordinance allows this type of construction in a district zoned Planned Development. However in this particular district when the City and Eastvale consolidated an ordinance was written to stipulate that in this P D district the Single Family zone would be kept consistent with other Single Family zones within the City. Under the Single Family designation this type of structure is not allowed, so therefore requires a variance. Mr. Hall said here we have an unusual situation. In the sense of the Planned Development disignation this type of occupancy would be allowed but with the exceptions to that zone it is not allowed. At the present time there are a number of General Retail Businesses ad- jacent to the property in question. Also across the street from this property a Church is located. Under these circumstances the City feels that this request would be consistant with the present occupancies and Staff recommends that this request be spproved. Member Gomez asked Mr. Hall if he felt there would be a problem with the traffic. Mr. Hall replied no. Member Gomez asked if there would be a problem with fire protection and is there a Fire Hydrant in that area. Mr. Hall replied that this particular location is in somewhat of a better posture than the majority of the Eastvale addition and that there is a Fire Hydrant located approximately 300 feet of Main Street and Directly across the East side of 423 is the Utility Building and there is a Fire Hydrant located there. Mr. Hall also mentioned that there is a two to three minute response to fires in the City any where. Member Bauman asked if this request was simply a zoning thing. Mr. Hall replied that was correct. Chairman Poynter asked that the applicant representing the request please sign in and speak. Mike Alianell of 5628 Terry said he was representing the Lodge tonight and he passed around and read to the Board Members for record a letter addressed to The Colony Board of Adjustments & Appeals from the members of The Colony Masonic Lodge #1451 dated August 19, 1992. He then asked if any questions. Member Preston asked if the parking lot was adequate to handle people. Mr. Alianell replied 20 to 25 vehicles and that the Church across the street had given permission to use their parking lot. Chairman Poynter asked how often they met. Mr. Alianell replied once a week on Tuesday nights. Member Bauman asked if they were going to rent the building out or host to any other groups. Mr. Alianell said yes they had discussed it. Member Gomez asked Mr. Alianell to just give us an idea of what the Masonic Lodge was all about. Mr. Alianell spoke of it being the oldest Fraternity around and they have Burn Centers, Eye Foundations, Hospitals, and a Masonic Home in Ft. Worth. Chairman Poynter asked for those in the audience that wish to speak in support of this request. There were none. Chairman Poynter asked for those to speak against the request. There were none. No Rebuttal - Chairman Poynter entertained a motion to Close Public Hearing for discussion. Member Gomez made a motion for discussion. Member Preston Seconded. Carried by all ayes. Discussion was very brief. Member Gomez spoke on the Church Lot being across the street the Lodge would not look out of place. He would be in favor of approving the variance. Kember Bauman wanted on record in case he needed to abstain, that his nephew spent the first six years of his life in a Shriners Hospital and that they helped him and he was very much for the approval of the variance. Chairman Poynter entertained a motion to approve the Variance. Member Gomez motioned to pass it as is. Member Preston Seconded. Carried by all ayes.
