HomeMy WebLinkAbout08/14/1991 BOABOARD OF ADJUSTMENT & APPEALS OF THE CITY OF THE COLONY, DENTON COUNTY, TEXAS HELD ON AUGUST 14, 1991 A REGULAR SESSION OF THE BOARD OF Adjustments & Appeals of the City of The Colony, Texas, was called to order at 7:30 p.m. with the following members present: Roosevelt Johnson Gary LaCrone Robert Poynter Gene Poole Danny Whited Alton Paris Quorum Present Chairman Member Member Member Alternate - Absent Alternate - Absent Bob Hutchison, Building Inspector, Designated Officer of the City Inspections Department was present. Chairman Johnson read an overview of Variance Procedures and Requirements. 1. APPROVAL OF MINUTES: The minutes of Appeal No. 91-01 were approved by all ayes. 2. PUBLIC HEARING: Consideration of a request for variance by Lisa & David Wright, owners of 7161 Fox, to allow the construction of a non -conforming accessory structure. At this time Chairman Johnson asked Bob Hutchison represenative for the City, for his Presentation. Mr. Hutchison entered into record Exhibit A (A) - Permit not approved (B) - Height Regulations (C) - Variance request by Lisa & David Wright (D) - Memorandum - to Bob Van Til, Administrative Staff Planner and drawing showing difference in roof pitch in relation- ship to height of building. Mr. Hutchison said staff had no objection to the request. Chairman Johnson asked for David Wrights Presentation. Mr. Wright entered into record - Exhibit B - Drawing of Site Plan. He spoke on wanting to build a Detached Garage so it would match the existing structure. Chairman Johnson opened the floor for questions. Jeff Small replied he and his Wife Wendy were not there to support or disapprove - just to ask questions. Ms. Small questioned what the Detached Garage would look like and why having one garage did the Wrights want a second one. Mr. Wright replied for storage space of a business planned in the near furture. X s M Member Poynter asked the size of his existing garage. Mr. Wright replied 16' x 24'. Member Poynter asked for height of new garage. Mr. Wright replied 14 feet. Ms Small wanted to know what material it would be of. Mr. Wright said it would match material of his existing garage (Wood Siding). Member Poole asked Bob Hutchison about the requirement for 75% Brick on residential structures in The Colony. Mr. Hutchison replied it only pertains to the main residential building. Accessory structures were excempt. Ms. Small asked Mr. Hutchison why the City was in favor of this request. Mr. Hutchison replied that the staff of the Inspections Department felt that the height limitation for Detached Garages of 101,- feet would detract from over all appearances of the community. Ms. Small asked if the height requirements kept the permit from being approved. Mr. Hutchison replied yes. Ms. Small layed out Mr. Wrights drawing (Exhibit B) and Mr. & Ms. Small pointed out concerns of what the garage would look like - the height and the impact on the neighborhood with views being blocked by something not so pleasing. Member Poynter spoke of attending a Council meeting when Ordinance was passed on height restrictions of accessory structures - he felt intent of Ordinance was designed to control Storage Sheds and Tool Sheds. Chairman Johnson closed Public Hearing then asked for any comments. Member LaCrone made a motion to visit the site (7161 Fox), Motion died for lack of Second. There was no further discussion. Chairman Johnson entertained a motion to grant the variance. Member Poynter motioned to accept. Member Poole Seconded. Carried by all ayes. Meeting adjourned at 8:02 P.M.
