HomeMy WebLinkAbout05/13/03 P&ZPlanning and Zoning Commission May 13, 2003 MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING HELD ON MAY 13, 2003 The Regular Session of the Planning and Zoning Commission of the City of The Colony, Texas was called to order at 6:35 p.m. on the 13th day of May, 2003 at City Hall with the following members present: Deville Hubbard, Chairman Brian Wade Bill Jamme Bill Harrison Absent: DeWayne Snider - Personal Kirk Mikulec - Personal Staff: Harry Persaud, Director of Development Services Chris Spencer, Planner Sandy Vondersaar, Administrative Assistant With four (4) members present, a quorum was established and the following items were addressed: 2.0 DISPOSITION OF MINUTES 2.1 Approval and/or correction of Planning and Zoning Commission Minutes for the meeting held on April 22, 2003. Motion to approve the minutes of the meeting held on April 22, 2003, Commissioner Harrison; second, Commissioner Jamme. Motion carried 4-0. 3.0 CITIZEN INPUT None 4.0 RECEIVE REPORT FROM THE CITY SECRETARY 4.1 Receive a report from the City Secretary regarding the Board Orientation Handbook. Ms. Patti Hicks, City Secretary distributed and reviewed the Board Orientation -1- Planning and Zoning Commission May 13, 2003 Handbook with the Commission. 5.0 PUBLIC HEARING 5.1 Hold a public hearing and consider approval of a Specific Use Permit for the sale of liquor, beer and wine for on-premise consumption in the Tres Amigos Restaurant, located near the Paige/South Colony Boulevard intersection, at 5313 South Colony Boulevard being Lot 1, Block 1, The Eberhart Addition, Abstract No. 172, in the City of The Colony, Denton County, Texas. (2003- SUP004) Commissioner Hubbard opened the public hearing at 6:42 p.m. Mr. Spencer presented the staff report regarding a Specific Use Permit for the sale of liquor, beer and wine for on-premise consumption at the Tres Amigos Restaurant located at 5313 South Colony Boulevard. Ten (10) notices were mailed and by meeting time zero (0) had been returned. Mr. Juan J. Soto owner of Tres Amigos Restaurant, located at 5313 South Colony Boulevard, was present to answer questions. No one stepped forward to speak for or against this item. Commissioner Hubbard closed the public hearing at 6:44 p.m. Staff recommends approval. A motion for approval of a Specific Use Permit for the sale of liquor, beer and wine for on-premise consumption in the Tres Amigos Restaurant, located near the Paige/South Colony Boulevard intersection, at 5313 South Colony Boulevard being Lot 1, Block 1, The Eberhart Addition, Abstract No. 172, in the City of The Colony, Denton County, Texas. 2003-SUP004), Commissioner Jamme; second Commissioner Wade. Motion carried 4-0. 5.2 Hold a public hearing and consider approval of a Specific Use Permit allowing for a dance studio within the Shopping Center "SC" zoning district classification, located on the northwest corner of Main Street and North Colony Boulevard, in the Oaks Village Shopping Center and situated at 6805 Main Street, Suite No. 180, on the southeast corner of Main Street and North Colony Boulevard, located in the City of The Colony, Denton County, Texas. (2003-SUP005) Chairman Hubbard opened the public hearing at 6:45 p.m. Planning and Zoning Commission May 13, 2003 The Commission was informed that the directional location of the dance studio should be changed from the southeast comer of Main Street to the northwest comer of Main Street. Mr. Spencer gave the staff report regarding the request for a Specific Use Permit allowing for a dance studio within the Shopping Center "SC" zoning district classification located at 6805 Main Street, Suite No. 180. Eight (8) notifications were mailed and by meeting time zero (0) had been returned. Ms. Cynthia Shailer owner of Ballet Plus located at 6805 Main Street, Suite #180 was present to answer questions. No one stepped forward to speak for or against this item. Chairman Hubbard closed the public hearing at 6:47 Staff recommends approval. A motion for approval of a Specific Use Permit allowing for a dance studio within the Shopping Center "SC" zoning district classification, located on the northwest corner of Main Street and North Colony Boulevard, in the Oaks Village Shopping Center and situated at 6805 Main Street, Suite No. 180, on the northwest corner of Main Street and North Colony Boulevard, located in the City of The Colony, Denton County, Texas. (2003-SUP005) subject to correction of location error, Commissioner Jamme; second Commissioner Wade. Motion carried 4-0. 5.3 Hold a public hearing and consider approval of a Specific Use Permit for the sale of liquor, beer and wine for on-premise consumption in the Blue Ribbon Sports Bar and Grill Restaurant, located on the northwest corner of Paige and South Colony Boulevard at 5201 South Colony Boulevard, Suite No. 720, located in the City of The Colony, Denton County, Texas. (2003-SUP003) Chairman Hubbard opened the public hearing at 6:50 p.m. At the applicant's request the word "Bar" has been removed from the name of the establishment and the suite number changed from Number 720 to Number 760. Mr. Spencer presented the staff report regarding approval of a Specific Use Permit for the sale of liquor, beer and wine for on-premise consumption in the Blue Ribbon Sports, Food & Fun located at 5201 South Colony Boulevard, Suite Number 760. Three (3) notices were mailed and by meeting time one (1) letter in opposition had been received. Mr. Fred Giliani, 111 Lakehill Court, Lake Dallas, Texas 75065, owner of the Blue Ribbon Sports, Food & Fun was present to answer questions. After extensive discussion it was determined that staff had been given inaccurate -3- Planning and Zoning Commission May 13, 2003 information regarding the suite number of the proposed facility. This item should be tabled in order to give staff more time to re-evaluate their recommendations and discuss the issues with the City Attorney. Chairman Hubbard closed the public hearing at 7:40 p.m. Staff supports tabling the item. A motion to table the request for a Specific Use Permit for the sale of liquor, beer and wine for on-premise consumption in the Blue Ribbon Sports, Food & Fun, located on the southwest corner of Paige and South Colony Boulevard at 5201 South Colony Boulevard, Suite No. 720, located in the City of The Colony, Denton Connty, Texas. (2003-SUP003) until the next Planning and Zoning Meeting scheduled for May 27th, Commissioner Jamme; second Commissioner Wade. Motion carried 4-0. 6.0 ITEMS FOR DISCUSSION 6.1 Discuss attending a seminar on Planning and Zoning for Public Officials and Attorney's at the Center for American and International Law. Mr. Persaud reviewed with the Commission the courses offered on June 26th and June 27th by The Institute for Local Government Studies of The Center for -- American and International Law. If anyone is interested in attending one of these classes please inform Sandy Vondersaar, Administrative Assistant.
