HomeMy WebLinkAbout02/18/1987 BOABOARD OF ADJUSTMENT & APPEALS OF THE CITY OF THE COLONY, DENTON COUNTY, TEXAS HELD ON FEBRUARY 18, 1987 A REGULAR SESSION OF THE BOARD of Adjustment & appeals of the city of The Colony, Texas, was called to order at 19:35 p.m. with the following members present: Roosevelt Johnson Chairman Ralph Sears Member Gary LaCrone Member Gene Poole Member Michael Leddy Member Bob Hutchison of the City Inspections Department was also present. 1. APPROVAL OF MINUTES The minutes of the August 13, 1986, meeting were approved with the correction of the statement by Member Leddy, hardship as written in the ordinance as written - as written was taken out as was repetitive and not intended to be there. 2. PUBLIC HEARING: Consideration of request for variance by Scott Andrews regarding a wall sign at Winn-Dixie 6805 Main. At this time Chairman Johnson presented for the record that a piece of evidence be read regarding Mr. & Mrs. Robert Burke of 4618 Larner, February 9, 1987, unable to attend, agreed with not allowing a sign larger than ordinance allowed. Member Leddy explained to Mr. Andrews the rules of Hardship per City Ordinance. At this time Mr. Andrews presented to the Board his reasons for requesting the variance. He felt that under the present ordinance 100 square feet of signage would be inadequate for the size of the store front and that Winn-Dixie would be at a distinct disadvantage to neighboring businesses of a much smaller size in comparison. At this time Chairman Johnson asked to look at the drawing that would give an idea of how 100 square feet of sign would look. Member Leddy motioned for a 10 minute recess to give Staff time to produce sign ordinance for the Boards review, seconded by Member Sears. Meeting was called to order by Chairman Roosevelt. Sign ordinance was reviewed by the Board. Motion made by Member Leddy to close public hearing and open adjudication, seconded by Member Poole. After brief discussion Member Sears made a motion to accept the variance, no second, notion died. Leddy made motion to deny request and seconded by Member LaCrone. Ayes: Michael Leddy Gene Poole Gary LaCrone Noes: Ralph Sears Roosevelt Johnson cont. of February 18, 1987 At this time Chairman Johnson felt that an impartial vote could not be achieved because of not understanding the 100 square feet per street exposure aspect of the ordinance. Member Poole suggested that meeting was out of order and motion be vetoed. Member Leddy made a motion to continue the hearing on March 4, 1987 so as to allow the City and Winn-Dixie to reach a compromise on the proposed sign.
