OF THE CITY OF THE COLONY HELD ON
MAY 21, 1986
A REGULAR SESSION of the Board of Adjustment & Appeals of the City of
The Colony, Texas, was called to order at 19:30 p.m. with the following
Members present:
Roosevelt Johnson Chairman
Ralph Sears Member
Gary LaCrone Member
Gene Poole Member
1. APPROVAL OF MINUTES
Chairman Johnson asked if the members had read the minutes of the meetings held
on June 19, July 17, and August 21, 1985, to which all answered in the affirmative.
Member Poole then made the motion that the minutes be approved as read; seconded by
Member Sears.
The Motion passed by the following vote:
Ayes: All Members present voted "aye"
Noes: None.
2. PUBLIC HEARING: CONSIDER REQUEST FOR VARIANCE FROM SIGN ORDINANCE,
REQUESTED BY LEWISVILLE INDEPENDENT SCHOOL DISTRICT
All interested parties were asked to sign a sign -in sheet indicating that they
would swear and affirm that all testimony would be the truth.
After briefly explaining the proceedings, Chairman Johnson read the request for
the variance followed by a memorandum from staff.
Malcolm Dennis, Principal, The Colony High School, gave the following reasons for
requesting the variance. Safety of the children --a sign at ground level would block
the view of oncoming traffic and create a safety hazard for children that might be
passing by the sign into the flow of traffic. Vandalism --could easily occur by
students and, being a high school, from other high schools. Cost --proposed sign will
cost approximately $6500, a smaller sign (75 square feet) would add to the cost,
making it approximately $10,000. Visibility of content of sign --sign could be
partially blocked by cars if the sign was ground level.
The sign will be used to announce other events occurring in the city as well as
events of the school. The sign is being paid for by fund raising projects led by
the Chamber of Commerce.
Lavell Garner from Eckerd Drug, Lydia Gober representing the Chamber of Commerce,
and Beke Aldridge of the PTA all expressed their approval of the sign and felt that
It would be an asset for the city.
Bob Hutchison, representing the City, gave some explanation of the setbacks
required for signs to avoid a visibility problem. He indicated it may or may not be
a safety hazard.
A brief discussion followed. Member Poole then made the motion that the public
hearing be closed; seconded by Ralph Sears. The motion carried unanimously.
Gene Poole then made the motion to open adjudication; seconded by Ralph Sears.
The motion carried unanimously.
There was no discussion. Gene Poole then made the motion to approve the variance
as requested; seconded by Ralph Sears. The motion carried by the following vote:

Noes: None
The meeting was adjourned at 19:55.

AUGUST 13, 1986
A REGULAR SESSION of the Board of Adjustment & Appeals of the
City of The Colony, Texas, was called to order at 19:34 p.m.
with the following members present:
Roosevelt Johnson Chairman
Ralph Sears Member
Gary LaCrone Member
Gene Poole Member
Michael Leddy Member
Bob Hutchison of the City Inspections Department was also present.
1. APPROVAL OF MINUTES
The minutes of the May 21, 1986, meeting were approved
as read.
2. PUBLIC HEARING: Consideration of request for variance by
John D. Barnard regarding placement of privacy fence at
4944 Arbor Glen Road
Chairman Johnson read Mr. Barnard's request for variance.
Mr. Barnard, a Carrollton Fireman, stated that he had attempted
to subdue noise to his bedroom as well as make the front (with
the fence) look nice.
Member Leddy explained hardship as written in the ordinance
as written. Chairman Johnson read a memo from Eric Stanton
stating the city's position.
Ralph Sears arrived at 19:45 and was briefed on the discussion
thus far.
After some discussion, the difference in a 4 -man and 5 -man
committee vote was explained to Mr. Barnard. Although Member
Sears arrived late, Mr. Barnard chose the 5 -man vote.
A motion was made, seconded and carried to close the public
hearing also to open adjudication. Both carried by a unanimous
vote.
After a brief discussion, Member Leddy made a motion that
the variance be granted as requested. For lack of a second,
the motion died.
Member Sears then made a motion that the request be denied;
seconded by Member LaCrone. The motion carried with the following
vote:
Ayes: Members Sears, LaCrone, Poole, and Leddy voted
aye
Noes: None
The variance was denied.
Member Poole made a motion to close the meeting; seconded
by Member Leddy. The motion carried with a unani?ous vote
and the meeting was adjourned at 20:00 p.m.
