OF THE
PLANNING & ZONING COMMISSION
MAY 6, 1978
A Public Hearing held by the Planning and Zoning Commission of the City
of The Colony, Denton County, Texas was called to order by Chairman
Harry Hunsicker, with the following members present:

and with Member Bob Brown absent, thus constituting a quorum:
Chairman Harry Hunsicker introduced Frank Graham of Fox & Jacobs, the
present owners of the property. Mr. Graham gave a description of the
10.573 acres of land located on the southeast corner of FM #423 and Colony
Boulevard.
Mr. Graham stated that Fox & Jacobs was requesting that the present residen-
tial zoning be changed to (1) Special Permit-Day Care, (2) Office-1 and
(3) General Retail. As Mr. Graham explained the specific uses of each
tract of land within this zoning change there was lengthy discussion
from the members of the audience. Mr. Graham referred to the City's
Master Land Use Plan to explain why Fox & Jacobs felt that fast food
establishments should not be located within the city. This would create
heavy traffic in residential areas he explained. Residents were concerned
that fast food establishments would create more problems with the summer
lake traffic and a potential health problem.
Regarding the proposed Day Care Center, screening was the primary concern.
There was a brief discussion of the location of the bank and the savings &
loan on the tract located north of the Stop 'N Go access road. One of
the primary concerns of Mr. Grover Yarborough was the increase in traffic
and the inability of the two lane FM #423 to handle it. A major concern
of all citizens was the structure of the proposed car wash to be located
behind the existing Stop 'N Go structure. The members of the audience
experssed three objections: (1) unsightliness, (2) the concern that it
would be unsafe for children and (3) the traffic it would create.
At this time Chairman Hunsicker stated that it was clear that the plans
as presented were not acceptable to the citizens. Glenda Davis, a member
of the audience, said that she and most of the residents close to this
area are aware that it will be eventually zoned retail, but they were
concerned as to what would be in this area. She requested that the citi-
zens see more detailed plans.
Some citizens asked that their names be included in the minutes as voting
against the fast food establishments and the car wash. They are D. J.
Rinier, Barbara Black, Judy Judelson, Bill and Tina Majors, and Bob and
Jean Wilbanks.
There being no further discussion Chairman Harry Hunsicker adjourned
the hearing.
