HomeMy WebLinkAbout10/11/77 P&Z o7 MINUTES OF REGULAR MEETING PLANNING AND ZONING COMMISSION THE CITY OF THE COLONY DENTON COUNTY, TEXAS OCTOBER 11, 1977 STATE OF TEXAS ) ) COUNTY OF DENTON ) The Planning and Zoning Commission of the City of The Colony, Denton County, Texas, convened in a regular session, open to the public, at the City Hall of The Colony, Denton County, Texas, at 7 p.m., Tuesday, October 11, 1977, and the roll was called of the members, to wit: Harry Hunsicker Chairman Cathy Bock Member Bob Brown Member The three present members were in attendance, thus establishing a quorum. Also in attendance were Frank Graham and Wayne Thompson, Fox and Jacobs; Janice Carroll, City Secretary; Mayor Guerrero; and members of the audience. The minutes of the Regular Session of September 13, 1977 and two Work Sessions held September 20, 1977 and September 27, 1977 were read and approved. The further review and study of the Dallas Ordinance was the only agenda item. Chairman Hunsicker led the review of the definitions and classifi- cations included in the Dallas Ordinance. It was noted that some defi- nitions and classifications, though not presently applicable, would be left in for possible future use. There followed a lengthy and detailed discussion of each section. Section #83 relating to Farm and Ranches was discussed in detail. It was agreed that the terms of farm or ranch should be for an area of land larger than three acres. It was discussed that possibly farm livestock should be prohibited entirely. Thompson reminded the Commission that chickens should be prohibited in residential areas. Section #1710 related to horses. It was generally agreed that there should be one horse per one half acre with a maximum of four horses. The stable must be located twenty feet from the property line. Mayor Guerrero mentioned that this area must be coordinated with the City's Animal Con- trol Ordinance at a later date. Chairman Hunsicker stated that he and Mr. Thompson saw no problems in the definitions and classifications of the home and shopping center sections. The sections on a commercial zoo, liquor facilities, air landing facili- ties, and a passenger railroad terminal remain in the ordinance for possi- ble future use. It was agreed that Sections #166 and #168 would be removed. There will be no outside auto repair or outside auto painting within the city limits. Regarding item #174 on parking, Frank Graham asked if a parking lot of more than one level would be allowed. This would be decided at a later date; however, the surface parking item would be left in at this time. The definition of a junk yard will not be removed. Wayne Thompson did state that the section describing open storage with no visual screening applies to a junk yard also. It was agreed by the Commission members that there is a definite need for a Sanitary Land Fill in the future and this definition must remain within the ordinance. Chairman Hunsicker stated that a special committee will be formed to study technical pro- blems when the need arises. Chairman Hunsicker then skipped to the section on a Planned Development District. He stated that he has read this section but no conclusions -1- have been reached at this time. It was agreed that Bob Brown and Janice Carroll would research mobile homes as they relate to zoning. In the area of Community Unit Development, Wayne Thompson presented a plan that is presently in use in some communities. The minimum yard space would be reduced up to 25%, but compensating open space must be provided. This land would be deeded to the City at no cost. It was emphasized that if the City did not want to accept this land, the developer cannot proceed with this plan. If accepted, this open land will be dedicated to the public and filed for record. At the conclusion of this study, Chairman Hunsicker stated that he would be in Europe from October 22 to November 9, and will not be able to attend any work sessions or the November regular meeting. At this time, Chair- man Hunsicker recognized Mayor Guerrero, to discuss the appointment of the new members to the Planning and Zoning Commission. A possible method would be to include on the City Council Agenda for the regular meeting of October 24, 1977, the oath of office for Cathy Bock as Alderman and secondly, the appointment of the new members, Mayor Guerrero said. Mayor Guerrero also presented to the Commission for informal approval the plans for The Colony's first custom home. Chairman Hunsicker set a Work Session for the following Tuesday. It was agreed that Chairman Hunsicker and Wayne Thompson would be responsi- ble for studying Planned Unit Development, Bob Brown and Janice Carroll would research zoning as it relates to Mobile Homes; and Cathy Bock would continue to work on the Sign Ordinance. Chairman Hunsicker recognized Wayne Thompson, who presented his comments and recommendations on the Sign Ordinance. He stated that the section on Directional Signs needs further clarification. The ordinance calls for one sign per mile while the Fox and Jacobs Sales Department asks for a sign every fifty feet. Thompson recommended to the Commission that the ordinance should allow one sign every five hundred feet and at a change of direction. Frank Graham felt that the ordinance should also differentiate between the different types of directional signs. Sub- division directional signs must have teh developer's name included on the sign. Open house directional signs must be in a right-of-way. The size of the signs requiring a permit is presently ten square feet. Frank Graham stated that Mr. Wood, Wood Sign Company, recommended fif- teen square feet as a better size for permit use. Mr. Wood also felt that the $3.00 permit fee was too low. It should be raised to $5.00 or $7.50. There followed a general discussion of the size of different types of signs. Wayne Thompson reminded the Commission that roadway signs that are too small create a traffic hazard. Thompson recommended that the size of temporary signs should be changed from sixty-four square feet to one hundred and fifty square feet. All residential signs should be thirty-two square feet and highway signs should be two hundred fifty square feet. The members agreed to take these recommendations into consideration. Ms. Bock stated that she is looking into permit application forms to be used by the City. There being no further business before the Planning and Zoning Commission, Member Bock made a motion for adjournment which was seconded by Member Brown and unanimously approved.
