HomeMy WebLinkAboutMinutes - Planning and Zoning Commission - 10/22/2024 - RegularMINUTES CITY OF THE COLONY PLANNING AND ZONING COMMISSION TUESDAY, OCTOBER 22, 2024 After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into Regular Session which was held on Tuesday, October 22, 2024 at 6:30 p.m. in the City Council Chambers located at City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: Board Members Present: Karen Hames, Kenneth Flo, Robert Cox, Jeff Baran, and Kirk Varga arrived at 6:45pm Board Members Absent: Brenda Armour and Gary Hulkowich Staff Present: Isaac Williams, Planning Director; Ana Alvarado, Planning Technician; Keyl Groff, Senior Planner; Judy Ensweiler, City Council; Ed Voss, Attorney; Brian Wade, City Council; Naim Khan, Senior Engineer 1.0 1 CALL REGULAR SESSION TO ORDER Chair Hames called the regular session of the Planning and Zoning Commission meeting to order at 6:39 p.m. 2.0 CONSENT AGENDA 2.1 Consider approval of the minutes of the October 8, 2024 Regular Session. Chair Hames read Consent Agenda Item 2.1 into the record. Commissioner Cox made a motion to approve item 2.1, seconded by Commissioner Baran. The motion carried (4-0). 3.0 PUBLIC HEARING ITEMS 3.1 (CONTINUED) PD24-0002 — JumpShot Planned Development 29 (PD29) Conduct a public hearing, discuss and consider making a recommendation to City Council regarding a zoning change from Planned Development 11 (PD 11) to Planned Development 29 (PD29) aka "JumpShot" to establish conceptual layout for an Amusement, Commercial (indoor) Use and development standards. The subject site contains approximately 8.69 acres and is located approximately 330 feet west of the southwest intersection of Memorial Drive and Blair Oaks Drive. Chair Hames read Public Hearing Agenda Item 3.1 into the record. Mr. Williams presented the staff report. Commissioner Cox asked for clarification if the sign that was originally presented in the concept plan was taken out and will pursue a different route for approval. Staff responded that the sign has been removed from the concept plan and any deviation from the Sign Ordinance will go through the appropriate board which is the Sign Board of Appeals for approval. Mr. Brian Birckbickler, president and chief operating officer for JumpShot, spoke in favor of the project and thanked the board for considering this item. Mr. Jonathan Kerby, Kimley-Horn representative for JumpShot, presented a short video illustrating what JumpShot will look like when built. Mr. Kerby outlined the enhancements made from the previous commission meeting. Public Hearing closed at 6:56 pm. Commissioner Baran made a motion to approve item 3.1 with the condition to include language regarding the areas where the Gateway Overlay is silent, seconded by Commissioner Cox. The motion carried (5-0). 3.2 PDA24-0003 — Planned Development-18 Amendment- The Adeline at The Tribute Conduct a public hearing, discuss and consider making a recommendation to City Council for amendments to Planned Development -18 (PD-18) District aka The Tribute, by modifying Exhibit B "Development Regulations for PD-18 and PD-23," updating the Concept Plan illustration, and providing development standards for the "Adeline at The Tribute" consisting of sixty (60) residential lots and eight (8) common areas. The subject site contains approximately 26.388 acres is located west of Lebanon Road and South of Bridge Lane within Planned Development 18 (PD 18). Chair Hames read Public Hearing Agenda Item 3.2 into the record. Mr. Williams presented the staff report. Commissioner Cox asked for clarification of why the main entrance into the new development was not lined up to the established street named Links. Mr. Jerry Sylo, JBI Partners, representative of the project, responded that the reason the street is not lined up with Links is because of the location of the existing detention pond. Developer tried to accommodate to the best of their abilities taking into consideration the detention pond, Bridge Lane being an undivided street, and the new development being a gated community. Commissioner Cox asked if traffic did not have a safety concern with the streets not lining up. Engineering staff responded that there was no concern. Commissioner Cox asked if the ponds will have water features inside. Mr. Sylo responded that they will have water features. They will have aeration to keep the water moving. Commissioner Baran asked who owns the right-of-way parcel that runs through the development and what rights do they have. The developer has worked with the CORE to allow for hike and bike trails in other places of The Tribute; within this development no hike and bike trail is planned since it is a gated community. Commissioner Cox asked if the CORE parcels are in the 100 foot floodplain. Mr. Sylo responded that it is not within the 100 foot floodplain. Public Hearing opened at 7:05 pm. Public Hearing closed at 7:05 pm. Commissioner Cox made a motion approve item 3.2, seconded by Commissioner Varga. The motion carried (5-0). There being no further business to come before the Commission, Chair Hames adjourned the Regular Session of the Planning and Zoning Commission at 7:05 p.m. 3 No Text
