HomeMy WebLinkAboutMinutes - Sign Board of Appeals - 02/16/2022MINUTES CITY OF THE COLONY SIGN BOARD OF APPEALS WEDNESDAY, FEBRUARY 16, 2022 After determining that a quorum was present, the Sign Board of Appeals of the City of The Colony, Texas convened into Regular Session which was held on Wednesday, February 16, 2022 at 6:53 p.m. in the City Council Chambers located at City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: Board Members Present: Constance Yahwak, Chairman; Gerald Odum; Victor Williams (Alternate 1) and Michelle Potts (Alternate 2). Board Members Absent: Dean Byers, Joel Ortega, and Jacob Evans Staff Present: Isaac Williams, Planning Director; Michael L. Martin, City Attorney; Brian Mcnuelty, Engineering Technician. 1.0 1 CALL REGULAR SESSION TO ORDER Chair Yahwak called the Regular Session of the Sign Board of Appeals meeting to order at 6:53 p.m. 2.0 1 CONSENT AGENDA 2.1 1 Consider approval of the minutes o Se tember 15, 2021 Regular Session. Chair Yahwak read Consent Agenda Item 2.1 into record. Member Odom made correction to the minutes. Member Odom made a motion to approve Consent Agenda Item 2.1 with a correction that member Odom's name is removed from member Evans name, seconded by Member Williams. The motion carried (4-0). 3.0 PUBLIC HEARING ITEMS 3.1 SBA20-0001— 3716 Standridge Drive Prohibited Sign Appeal Conduct a public hearing, discuss and consider an appeal of an interpretation that the signage for "Operation Happenis" [sic] is a prohibited sign. (Postponement by Applicant request to 2/16/2022) Mr. Williams provided a discussion that item 3.1 has been open to a public hearing and the item received continuation multiple times. The applicant has not requested a further postponement and is not present at the meeting. City attorney recommended that an executive session should occur first if the board wanted to move forward. At 6:57 p.m. the meeting entered Executive Session after Chair Yahwak stated, pursuant to the Texas Open Meetings Act, Government Code Chapter 551, one or more of the above items may be considered in Executive Session closed to the public, including but not limited to consultation City of The Colony February 16, 2022 Sign Board of Appeals Meeting Minutes Page 2 of 4 with attorney pursuant to Texas Government Code Section 551.071 arising out of the attorney's ethical duty to advise the city concerning legal issues arising from an agenda item. Chair Yahwak reopened the public hearing at 7:10 p.m. No speakers came forward on this item. The public hearing was closed at 7:10 p.m. Chair Yahwak made a motion to deny Agenda Item 3.1, seconded by Member Potts. The variance was denied (4-0). There being no further business to come before the Board, Chair Yahwak adjourned the Regular Session of the Sign Board of Appeals at 7:11 p.m. onstance Y wa , Cha Man Isdac Williams, Planning Director
