HomeMy WebLinkAboutMinutes - Planning and Zoning Commission - 08/13/2024 - RegularMINUTES CITY OF THE COLONY PLANNING AND ZONING COMMISSION TUESDAY, AUGUST 13, 2024 After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into Regular Session which was held on Tuesday, August 13, 2024 at 6:30 p.m. in the City Council Chambers located at City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: Board Members Present: Karen Hames, Brenda Armour, Kirk Varga, Robert Cox, Jeff Baran, and Gary Hulkowich Board Members Absent: Kenneth Flo Staff Present: Ana Alvarado, Planning Technician; Allisen Ducay, Planner; Isaac Williams, Planning Director; Naim Khan, Senior Engineer; Ed Voss, Attorney; Judy Ensweiler, City Council; Brian Wade, City Council 1.0 CALL REGULAR SESSION TO ORDER Chair Hames called the regular session of the Planning and Zoning Commission meeting to order at 6:30 p.m. 2.0 CONSENT AGENDA 2.1 Consider approval of the minutes of the July 23, 2024 Regular Session. Chair Hames read Consent Agenda Item 2.1 into the record. Commissioner Armour made a motion to approve item 2.1, seconded by Commissioner Hulkowich. The motion carried (6-0). 3.0 PUBLIC HEARING ITEMS 3.1 SUP24-0002: 5000 Main Street Suite 100C - The Dog Stop Conduct a public hearing, discuss and consider making a recommendation to City Council regarding the approval of a Specific Use Permit (SUP) to allow an approximately 9,530 sq. ft. Kennel with outdoor runs known as "The Dog Stop." The subject site is located at 5000 Main Street Suite 100C, within the Shopping Center (SC) Zoning District and Gateway Overlay District. Chair Hames read Public Hearing Agenda Item 3.1 into the record. Ms. Ducay presented the staff report. Commissioner Armour asked for clarification on the location of the outdoor dog areas. Staff responded that there are two outdoor areas, one on the south side in the adjacent lot and the other on the rear side on the ramp. Commissioner Varga asked for clarification on the location of the water area. Staff responded that the water area has been removed from this project and SUP request. Commissioner Varga asked for details on the exterior fencing. City of The Colony August 13, 2024 Planning and Zoning Commission Meeting Minutes Page 2 of 2 Staff responded that it will be an eight foot fence, material is undetermined at this time but will be of a material acceptable by the Gateway Standards. Chair Harries asked if there would be shade provided for the animals in the outdoor areas. Staff responded that shade structures are being considered but at this time are not known. Commissioner Cox asked regarding the noise abatement, if it's for the indoor area or outdoor area. Staff responded that the noise abatement is in the interior space of the building. Public hearing was opened at 6:40 pm. Mr. Dennis Hill, representative of The Dog Stop, spoke about planning to provide shade structures for the dogs. Mr. Hill mentioned that the outdoor eight foot fence will provide a noise barrier to when the dogs are outside. The outdoor area will not be used all the time and the number of dogs outside at one time will be minimal about three to four. Public hearing was closed at 6:42 pm. Commissioner Armour made a motion to approve item 3.1 with the condition to exclude breeding operations, animal transportation services, outdoor boarding and commercial sale of domesticated animals from the SUP, seconded by Commissioner Hulkowich. The motion carried (6-0).
