CITY OF THE COLONY
PLANNING AND ZONING COMMISSION
TUESDAY, APRIL 23, 2024
After determining that a quorum was present, the Planning and Zoning Commission of the City of
The Colony, Texas convened into Regular Session which was held on Tuesday, April 23, 2024 at
6:30 p.m. in the City Council Chambers located at City Hall, 6800 Main Street, The Colony, Texas,
at which time the following items were addressed:
Board Members Present: Detrick DeBurr, Jeff Baran, A.B. Martin, Kenneth Flo, and Gary
Hulkowich
Board Members Absent: Karen Hames, Brenda Armour
Staff Present: Isaac Williams, Planning Director; Ana Alvarado, Planning Technician; Keyl Groff,
Senior Planner; Ed Voss, Attorney; Jeromy Lucas, Fire Marshal; Nairn Khan, Senior Engineer; and
Brian Wade, City Council
1.0 1 CALL REGULAR SESSION TO ORDER
Acting Chair DeBurr called the regular session of the Planning and Zoning Commission meeting to
order at 6:34 p.m.

CONSENT AGENDA
2.1
Consider approval of the minutes of the April 9, 2024 Regular Session.
Acting Chair DeBurr read Consent Agenda Item 2.1 into the record.
Commissioner Martin made a motion to approve item 2.1, seconded by Commissioner
Hulkowich. The motion carried (5-0).
3.0
PUBLIC HEARING ITEMS
3.1
PDA24-0001— "JPI Morningstar" — Multi family Development
Conduct a public hearing discuss and consider making a recommendation to City
Council regarding Amendments to Planned Development 16 (PD-16) to reflect the
conceptual layout and development standards for the "JPI Morningstar," a 374-
dwelling unit multi -family development. The subject site contains approximately 10.86
acres and is located at the northwest intersection of Morningstar Drive and SH 121,
(between South Colony Boulevard and Morningstar Drive) within Planned
Development 16 (PD-16).
Acting Chair DeBurr read Public Hearing Agenda Item 3.1 into the record.
Mr. Williams presented the staff report.
Commissioner Baran asked if the applicant is required to concept plan the last two lots that are left
out of the development but existing within the planned development.
Staff responded that the current applicant is not the owner of such lots so the responsibility falls on
the owner of those lots or the entity that develops them to either provide a concept plan or site plan
development for the entitlements that already exist on those sites.

Acting Chair DeBurr opened the public hearing at 6:44pm.
Mr. John Weeks, 5722 SH 121, representative of Abuelo's, spoke in favor of the development.
Ms. Yamini, 5733 SH 121, spoke in favor of the development.
Mr. Mike Gillum, 5733 SH 121 Suite 230, representative of Thirsty Growler, spoke in favor of the
ac v LJOP111cnt.
Mr. Kaden Tran, 5733 SH 121 Suite 240, spoke in favor of the development.
Ms. Whitney Adams, 5701 SH 121 Suite 110, spoke in favor of the development.
Mr. Miller Sullivan, representative of JPI, spoke about the new proposed development.
Mr. Tomi Mann, representative of JPI, spoke about the new proposed development.
Acting Chair closed the public hearing at 7:00pm.
Commissioner Martin asked for clarification if any storage facilities are available for the tenants.
Mr. Sullivan responded that in the hallways there are closets of different sizes that tenants can rent
to keep their belongings.
Commissioner Baran asked for clarification on how trash is handled.
Mr. Sullivan responded that there is valet service for trash. The property management team picks up
the trash daily and discards it. There are no trash shoots.
Commissioner Hulkowich asked for clarification on the mix of apartments and rental prices.
Mr. Sullivan responded that 60% are 1 bedrooms, 35% are 2 bedrooms and 5% are 3 bedrooms.
The rent averages about $2.40/sf per rent. The range from $1,200 to up to $3,000.
Commissioner Baran asked for clarification on why the development is over parked.
Mr. Sullivan responded that they have to get the parking right, at site planning the parking will be
verified but they are confident that they are meet the needs of the development.
Commissioner Hulkowich asked for clarification on where the shared parking is.
Mr. Sullivan responded that it is by the retail and will be use on off-peak hours mostly for guest
parking.
Commissioner Hulkowich asked for clarification on how many apartments The Colony already has.

Staff responded that the multifamily developments exist within the Austin Ranch, Grandscape, and
along SH 121 and Morningstar Drive.
Commissioner Baran made a motion to approve item 3.1, seconded by Commissioner Martin.
The motion carried (5-0).
3.2 SUP24-0001 — 5270 Memorial Drive — Crash Champions - Auto Painting or Body
Rebuilding Shop (inside) — Specific Use Permit
Conduct a public hearing, discuss and consider making a recommendation to City
Council regarding the approval of a Specific Use Permit (SUP) to allow for an Auto
Painting or Body Rebuilding Shop located at 5270 Memorial Drive, The site contains
106,711 sq. ft., (2.45 acres) and located within the Business Park (BP) Zoning District
and Gateway Overlay District.
Acting Chair DeBurr read Public Hearing Agenda Item 3.2 into the record.
Mr. Williams stated that the applicant has requested to postpone consideration of this item until the
May 141h Planning and Zoning Commission meeting. Staff request opening the public hearing and
leaving it open until the May 14th meeting.
Acting Chair DeBurr opened the public hearing at 7:13pm.
Ms. Victoria Morris, representative of Jackson Walker, spoke requesting that the item be postponed
until May 14th
Commissioner Martin asked for clarification if this is an existing site.
Ms. Morris responded that this is the existing Service King building.
Commissioner Baran made a motion to postpone item 3.2 until the May 14, 2024 Planning and
Zoning Commission meeting, seconded by Commissioner Martin. The motion carried (5-0).
4.0
DISCUSSIONITEMS
4.1
SPA24-0005 — Westport Lakeview Villas - Site Plan Amendment
Discuss and consider approval of a site plan amendment application for "Westport
Lakeview Villas," amending landscape and screening for an existing thirty-three (33)
unit Townhome development. The Subject site contains approximately 2.982 acres and
is located at 4900 thru 4969 Blaynes View, within the Townhouse (PD-TH) Zoning
District.
Acting Chair DeBurr read Discussion Agenda Item 4.1 into the record.
Mr. Groff presented the staff report.
Commissioner Flo made a motion to approve item 4.1, seconded by Commissioner Hulkowich.
The motion carried (5-0).

There being no further business to come before the Commission, Acting Chair DeBurr adjourned
the Regular Session of the Planning and Zoning Commission at 7:19 p.m.
