JANUARY 2, 1980
A REGULAR MEETING of the Planning and Zoning Commission was called
to order with the following members present:
Kerry Schuck Acting Chairman
Jim Quevreaux Member
Judy Oaks Member
Greg Norwood Member
and with Member Kathy Bock absent.
i. AGENDA ITEM #1
Tom Cravents gave a presentation to Commission Members showing the
location of Section 28 which contains 196 lots. The members of the
Commission were concerned because the only road to Stuarts Creek
Park is in this location. A motion was made by Judy Oakes and
seconded by Jim Quevereaux that Section 28 be passed subject to
the recommendations of City Council. The motion carried unanimously
with the understanding the Fox and Jacobs follow the placement of
street lights and fire hydrants as was done on the east side of
FM #423 on North Colony Boulevard. This is also subject to the
approval of street design by Sayed Omar.
ii. AGENDA ITEM #2
Member Oakes moved to table this item until the area is rezoned.
Seconded by Member Norwood, the motion carried unanimously.
iii. AGENDA ITEM #3
Member Quevereaux made a motion to open the public hearing. Seconded
by Member Oakes, the motion carried unanimously. Member Schuck noted
that he would be abstaining from the final vote since he lived within
two hundred feet of the property.
Mr. Thomas R. Nuckels, representing Land O'Lakes Christian Church
gave a presentation to the citizens and Commission explaining the
history and goals of the Church. It was the intention of the church
to utilize the existing structure on the property and sometime in
the future build a new structure that would also house educational
facilities. Parking he said would be on the property.
Questions were answered from citizens present regarding the architectural
design of the future building, ingress and egress to the area and
any unusual uses of the building, i.e., day care facilities. Planning
and Zoning members were concerned that no developed plans were available.
at this time and agreedthat some control on future buildings other
than City codes should be submitted. Vance Brown, a resident within
two hundred feet of the structure, stated that speaking for some of
the neighbors it was the general feeling that a church would be a
"plus" to the neighborhood. After further discussion and clarification
by Commission members, Member Oaks moved that the zoning for
this property be changed from residential to Special Use Permit #29 with t~
the following stipulations:
1. The existing structure be brought up to code
2. The parking be brought up to code
3. Ingress and egress be approved by the City staff
4. For any additions to the structure or new facility,
the plans be submitted to the Planning and Zoning
Commission and City Council for their approval
with letters sent to all residents within two
hundred feet.
The motion carried with a vote of three for the rezoning with the
above stipulations and the absention of Mr. Schuck for reasons stated
earlier.
There being no further business to discuss, the meeting was
adjourned at approximately 9:00 P.M.
