MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING
HELD ON JANUARY 13, 2004
The Regular Session of the Planning and Zoning Commission of the City of The Colony,
Texas was called to order at 6:30 p.m. on the 13th day of January, 2004 at City Hall with
the following members present:
Deville Hubbard, Chairman
Marlene Milsak
Michael Barrett
Bill Jamme
Kirk Mikulec
Bill Harrison
Brian Wade
Staff:
Harry Persaud, Director of Development Services
Chris Spencer, Planner
James Hanvey, Staff Engineer
Ids Browder, Chief Code Enforcement Officer
Sandy Vondersaar, Administrative Assistant
With seven (7) P & Z members present, a quorum was established and the following
items were addressed:
Mr. Persaud introduced the City's new Chief Code Enforcement Officer Ids Browder.
He also introduced new Commissioners Marlene Milsak and Mike Barrett.
2.0 DISPOSITION OF MINUTES
2.1 Approval and/or correction of Planning and Zoning Commission Minutes for
the meeting held on December 9, 2003.
Motion to approve the minutes of the meeting held on December 9, 2003,
Commissioner Jamme; second, Commissioner Harrison. Motion carried 5-0
with two abstentions due to Commissioners Milsak and Barrett not being members
of the Commission on December 9, 2003.
3.0 OTHER BUSINESS
3.1 Nomination and election of Chairperson and Vice Chairperson

Commissioner Mikulec nominated Commissioner Jamme for Chairman. Commissioner
Harrison seconded the nomination. Commissioner Jamme was elected by acclamation.
Commissioner Harrison nominated Commissioner Mikulec for Vice Chairman.
Commissioner Jamme seconded the nomination. Commissioner Mikulec was elected by
acclamation.
Commissioner Jamme assumed the responsibilities of the Chairman.

5.0 ITEMS FOR CONSIDERATION
5.1 Consider a request for approval of a Preliminary Plat for Lot 1 & 2, Block A,
CVS Colony Addition, being a 5.124-acre tract situated in the B.B.B. &
C.R.R. Survey, Abstract No. 173, located at the southeast corner of Paige
Road and South Colony Boulevard, in the City of The Colony, Denton
County, Texas. (2003-PP005)
Mr. Spencer presented the staff report regarding a request for approval of a Preliminary --
Plat for Lot 1 & 2, Block A, CVS Colony Addition located at the southeast comer of
Paige Road and South Colony Boulevard.
Mr. Michael Alturk, P.E. with Carter & Burgess, Inc., 777 Main Street, Floor 29,
Fort Worth, Texas 76102, was present to answer questions.
Staff recommends approval withthree (3) stipulation.
A motion for approval of a Preliminary Plat for Lot 1 & 2, Block A, CVS Colony

No. 173, located at the southeast corner of Paige Road and South Colony Boulevard,
in the City of The Colony, Denton County, Texas. (2003-PP005) subject to three (3)
staffstipulations, Commissioner Hubbard; second Commissioner Wade. Motion
carried 7-0.
5.2 Consider a request for approval of a Final Plat for Lot 1, Block A, CVS
Colony Addition, being a 1.931-acre tract situated in the B.B.B. & C.R.1L
Survey, Abstract No. 173, located at the southeast corner of Paige Road and
South Colony Boulevard, in the City of The Colony, Denton County, Texas.

Mr. Spencer presented the staff report for approval of a Final Plat for Lot 1, Block
A, CVS Colony Addition located at the southeast comer of Paige Road and South

Colony Boulevard.
Mr. Michael Alturk, P.E. with Carter & Burgess, Inc., 777 Main Street, Floor 29,
Fort Worth, Texas 76102 was present to answer questions.
Staff recommends approval with three (3) stipulations.

staff stipulations, Commissioner Hubbard; second Commissioner Wade. Motion
carried 7-0.
5.3 Consider a request for approval of a Site Plan for a CVS Pharmacy Store,
located on Lot 1, Block A, CVS Colony Addition, being a 1.931-acre tract
situated in the B.B.B. & C.R.R. Survey, Abstract No. 173, located at the
southeast corner of Paige Road and South Colony Boulevard, in the City of
The Colony, Denton County, Texas. (2003-SP013)
Mr. Spencer presented the staff report for approval ora Site Plan for a CVS Pharmacy
Store, Lot 1, Block A, CVS Colony Addition located at the southeast comer of Paige
Road and South Colony Boulevard.
Mr. Michael Alturk, P.E. with Carter & Burgess, Inc., 777 Main Street, Floor 29,
Fort Worth, Texas 76102, was present to answer questions.
Staffrecommends approval with six (6) stipulations.
The Commission requested two stipulations be added as follows:
1. Landscaping and structures located near driveways must comply with
visibility standards.
2. Correct the direction of traffic flows shown on site plan.
A motion for approval of a Site Plan for a CVS Pharmacy Store, located on Lot 1,
Block A, CVS Colony Addition, being a 1.931-acre tract situated in the B.B.B. &
C.R.R. Survey, Abstract No. 173, located at the southeast corner of Paige Road and
South Colony Boulevard, in the City of The Colony, Denton County, Texas. (2003-
SP013) subject to eight (8) staff stipulations, Commissioner Hubbard. Due to a lack
of a second the motion failed.
The Commission expressed concerns regarding traffic exiting the site and turning left
southbound on Paige Road. After lengthy discussion an additional stipulation was added
as follows:

1. Traffic exiting the site and turning left on southbound Paige Road is __
prohibited. Developer will install a "Right Turn Only" sign and button the
driveway accordingly.
A motion for approval of a Site Plan for a CVS Pharmacy Store, located on Lot 1,
Block A, CVS Colony Addition, being a 1.931-acre tract situated in the B.B.B. &
C.R.R. Survey, Abstract No. 173, located at the southeast corner of Paige Road and
South Colony Boulevard, in the City of The Colony, Denton County, Texas. (2003-
SP013) subject to nine (9) staff stipulation, including the stipulation denying a left
turn from the property south onto Paige Road, Commissioner Mikulec; second
Commissioner Barrett. Motion carried 6-1. Commissioners Milsak, Barrett,
Jamme, Mikulec, Harrison and Wade for; Commissioner Hubbard against.
Mr. Persaud suggested that an orientation meeting be schedule prior to the next Planning
and Zoning Meeting. The Commission agreed to a work session scheduled for January
27, 2004, at 5:00 p.m. in the Main Conference Room.
With no further business, the meeting adjourned at 7:45 p.m.
