HomeMy WebLinkAboutMinutes - Planning and Zoning Commission - 07/25/2023 - RegularMINUTES CITY OF THE COLONY PLANNING AND ZONING COMMISSION TUESDAY, JULY 25, 2023 After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into Regular Session which was held on Tuesday, July 25, 2023 at 6:30 p.m. in the City Council Chambers located at City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: Board Members Present: Karen Haines, Brenda Armour, Kenneth Flo, A.B. Martin, Dan Rainey, Jeff Baran, and Detrick DeBurr Board Members Absent: None Staff Present: Isaac Williams, Planning Director; Ana Alvarado, Planning Technician; Keyl Groff, Planner; Naim Khan, Senior Engineer, Perry Schrag, City Council 1.0 1 CALL REGULAR SESSION TO ORDER Chair Hames called the regular session of the Planning and Zoning Commission meeting to order at 6:30 p.m. 1.1 1 CITIZEN INPUT Chair Harries opened the floor for citizen input at 6:30 p.m. No citizen came forward for input. Citizen input was closed at 6:30 pm. 2.0 CONSENT AGENDA 2.1 1 Consider approval of the minutes of the July 11, 2023 Regular Session. Chair Harries read Consent Agenda Item 2.1 into the record. Commissioner Rainey made a motion to approve item 2.1, seconded by Commissioner Martin. The motion carried (7-0). 3.0 DISCUSSION ITEMS 3.1 EV23-0001 Kroger Fuel - Engineering Design Manual Variance 3.01 Discuss and consider making a recommendation to the City Council regarding an engineering variance to Section 3.01 Driveway Requirements - Engineering Design Manual, to allow a driveway distance at 90.98 feet, where 120 feet is the minimum distance from the driveway to point of intersection, in accordance with the Code of Ordinances Section 6-124 - Variance. The subject site contains approximately 1.15 acres and is located east of the south-east intersection of Main Street and East Lake Highlands Drive within the General Retail (GR) Zoning District and the Heavy Commercial (HC) Zoning District. Chair Harries read Discussion Item 3.1 into the record. Mr. Groff presented the staff report. Commissioner Martin commented that fuel tankers will be coming in off Main Street and that turn will be very tight. City of The Colony July 25, 2023 Planning and Zoning Commission Meeting Minutes Page 2 of 2 Commissioner Martin asked if there had been any conversation with the neighbor to the south about cross access. Staff responded that there has been communication with the neighbor to the south however access has not been granted. Commissioner Baran asked if the fuel tankers will be turning into the site off of the middle lane on Main Street and commented that when exiting the site the tankers will continuously hit the curb on East Lake Highlands. Mr. Clay Cristy, applicant, responded that the fuel tanker will utilize a small portion of the middle lane on Main Street but will not hit the curb on East Lake Highlands. Applicant commented that with Elm Street not being built to hold the big trucks an alternative route was evaluated leading to exiting on East Lake Highlands. Commissioner Martin asked about four barrels that are sitting on the site. Mr. Cristy, responded that there may be soil testing. Commissioner Rainey asked if it would be advisable to place a time limit on the variance if the project does not move forward. Staff responded that the board can stipulate a sunset date and City Council may consider the item with the board's condition. Commissioner Rainey made a motion to approve item 3.1 with the condition that the approval expire in two years, seconded by Commissioner Martin. The motion carried (7-0). There being no further business to come before the Commission, Chair Haines adjourned the Regular Session of the Planning and Zoning Commission at 6:47 p.m. Hames, Williams, Planning 2
