CITY OF THE COLONY
PLANNING AND ZONING COMMISSION
TUESDAY, OCTOBER 24, 2023
After determining that a quorum was present, the Planning and Zoning Commission of the City of
The Colony, Texas convened into Regular Session which was held on Tuesday, October 24, 2023 at
6:30 p.m. in the City Council Chambers located at City Hall, 6800 Main Street, The Colony, Texas,
at which time the following items were addressed:
Board Members Present: Brenda Armour, Dan Rainey, Detrick DeBurr, A.B. Martin, Jeff Baran,
Karen Hames and Kenneth Flo
Board Members Absent: None
Staff Present: Isaac Williams, Planning Director; Ana Alvarado, Planning Technician; Ed Voss,
Attorney; Naim Khan, Senior Engineer; Perry Schrage, City Council
1.0 1 CALL REGULAR SESSION TO ORDER
Chair Hames called the regular session of the Planning and Zoning Commission meeting to order at
6:30 p.m.
1.1 1 CITIZEN INPUT
Chair Hames opened the floor for citizen input at 6:30 p.m. No citizen came forward for input.
Citizen input was closed at 6:30 pm.

CONSENT AGENDA
2.1
Consider approval of the minutes of the October 10, 2023 Regular Session.
2.2
RP23-0007 — Wal-Mart Addition Lots R6A-2 and R"-3, Block I - Replat
Consider approval of a Replat for Lots R6A-2 and R6A-3, Block 1, being an
approximately 2.33 acre tract (101,573 square -feet) in the H. Hedgecoxe Survey,
Abstract No. 533, in the City of The Colony, Denton County, Texas located at 4675
State Highway 121 in the General Retail (GR) Zoning District and the Gateway
Overlay District.
Chair Hames read Consent Agenda Items 2.1 and 2.2 into the record.
Commissioner Armour made a motion to approve items 2.1 and 2.2, seconded by
Commissioner Rainey. The motion carried (7-0).

PUBLIC HEARING ITEMS
3.1
SUP23-0005 — 4805 South Colony Blvd — Colony Air Conditioning & Heating (A/C and
Heating Shop with Outside Storage) — Specific Use Permit
Conduct a public hearing, discuss and consider making a recommendation to City Council
regarding the approval of a Specific Use Permit (SUP) to allow an A/C and Heating Shop
with outside storage use known as "Colony Air Conditioning and Heating," at 4805 South
Colony Blvd, containing approximately 9,310 sq. ft., and located within the Shopping
Center (SC) Zoning District and Gateway Overlay District.
Chair Hames read Public Hearing Item 3.1 into the record.

Mrs. Alvarado presented the staff report.
Public Hearing was opened at 6:36 pm.
No one come forward. Public Hearing was closed at 6:37 pm.
Commissioner DeBurr made a motion to approve item 3.1, seconded by Commissioner
Martin. The motion carried (7-0).
3.2 PDA23-0001— Jefferson Morningstar- Multifamily Development — PD Amendment
Conduct a public hearing discuss and consider making a recommendation to City Council
regarding Amendments to Planned Development 16 (PD-16) to reflect the conceptual layout
and development for an approximately 900-unit multifamily development known as
"Jeffersun Muruingstai." The subject site contains appioxiniaLcly 14.95 acids and is located
at the northwest intersection of Morningstar Drive and SH 121, (between South Colony
Boulevard and Morningstar Drive) within Planned Development 16 (PD-16).
Public Hearing Item 3.2 was withdrawn from the agenda and no action was taken.
14.0 1 DISCUSSION ITEMS
4.1 SPA23-0011- State Farm Office Building — Site Plan Amendment
Discuss and consider approval of the Site Plan Amendment application of "State Farm
Office Building" to reflect amendments to the building square footage, landscape,
parking and circulation for an approximately 7,137 square -foot building within Lot 4R,
Block 1, in the Murchison Addition. The subject site contains approximately 0.4787
acres, and is located at 4654 South Coluny Blvd within the Shopping CCntw' Zuiring
District and the Gateway Overlay District.
Chair Hames read Discussion Ttem 4,1 into the record.
Mr. Williams presented the staff report.
Commissioner Rainey asked for clarification if the development could have both the cross access
and 29 parking spaces.
Staff responded that the site is not large enough to have both the cross access and the required
spaces. The choice came down to what variance to request, the lower number of parking spaces or a
Gateway Standards Waiver to allow no cross access.
Commissioner Rainey made a motion to approve item 4.1, seconded by Commissioner
Armour. The motion carried (7-0).

4.2 SP23-0009 — Club Carwash — Site Plan
Discuss and consider making a recommendation to City Council regarding the Site Plan
application of "Club Carwash," an approximately 4,970 square -foot car wash and auto
laundry building with a single tunnel and approximately 19 vacuum stalls within Lot R6A-3,
Block 1, in the Wal-Mart Addition. The subject site is located at 4675 State Highway 121, in
the General Retail (GR) Zoning District and the Gateway Overlay District.
Chair Haines read Discussion Item 4.2 into the record.
Mr. Williams presented the staff report.
Commissioner Martin made a remark that he is not in favor of another carwash since the city
already has several.
Commissioner Rainey asked for clarification if this is the same project the board had seem before
regarding parking right next to SH 121.
Staff responded that what came before the board was consideration of a Gateway Standards Waiver
to consider how much parking could be in front of the building. The Gateway Overlay has a
maximum depth that a site can utilize for parking in front of the building and the old version of the
project needed the waiver. When the waiver was denied the applicant went back to revise the site
plan accordingly. The site plan before the board today has been updated to not need any waivers.
The City has recently adopted a revision of the ordinance that requires Specific Use Permits (SUP)
for carwashes. This project since it had started its application prior to the ordinance change is vested
under the previous ordinance and therefore does not require a SUP and is allowed by right.
Commissioner Rainey asked if the original plan had the same parking structure as proposed in the
updated site plan.
Staff responded that in the previous version included two lanes of parking in the front of the
building. In the updated site plan as presented today to the board has only one land of parking.
Commissioner Rainey asked if the area between the parking and SH 121 will be landscaped.
Staff responded that it will be landscaping, drive isle, landscaping, and then building.
Commissioner Rainey asked if the turn pocket is consistent with what the City would require.
Mr. Clay Cristy, ClayMoore Engineering, representative of the development, responded that it
meets TXDOT regulations and has worked with City Engineering Department to design it
accordingly. The developer has also enhanced the landscaping on the site to screen from SH 121
and added glazing and architectural features to the tunnel so that it does not look like a long
building.
Commissioner Baran asked if there is a concept plan for the adjacent site considering the size of the
parcel.

Mr. Cristy responded that the developer does not have a tenant lined up yet but has evaluated three
potential different uses for that site including restaurants and medical office building.
Commissioner DeBurr made a motion to approve item 4.2, seconded by Commissioner
Rainey. The motion carried (7-0).
There being no further business to come before the Commission, Chair Flames adjourned the
Regular Session of the Planning and Zoning Commission at 7:02 p.m.
