Assistant City Manager, Tim Miller, gave an overview of this item. Council provided discussion and suggested the retreat be held at the same location as last year, targeting the last two weeks of April. 3.2 Council to provide direction to staff regarding future agenda items. Councilman Marks requested to have a future discussion on Airbnb rentals. 4.0 CONSENT AGENDA Motion to approve all items from the Consent Agenda- Schrag; second by Ensweiler, motion carried with all ayes. 4.1 Consider approving City Council Regular Session meeting minutes from February 7, 2023. 4.2 Consider approving a resolution authorizing the City Manager to execute a renewal contract for services and designating the Dallas Morning News as the city's official newspaper. RESOLUTION NO. 2023-019 5.0 REGULAR AGENDA ITEMS 5.1 Conduct a public hearing, discuss, and consider an ordinance regarding amendments to Appendix A, Section 10 of the Code of Ordinances of the city of The Colony, Texas, by amending Section 10-100, entitled "schedule of uses by 11 City Council – Regular Meeting Agenda February 21, 2023 Page| 4 district,” by amending the use chart by amending or adding uses including “bar, lounge or tavern”, “beverage store”, “church”, “community home”, “convent or monastery”, “institution of a religious, charitable or philanthropic nature”, “school, public denominational”, “smoking lounge”, and “smoking room” uses; and amending Appendix A, Section 10-300, entitled “definitions and explanations applicable to use schedule” by adding and amending definitions for “community home”, “school, public denominational”, “smoking lounge”, and “smoking room” uses; and amending Section 13 entitled “vehicle parking, parking lot and on-site traffic regulations:” by amending Section 13-101(a), entitled “generally”, by repealing the prohibition on parking within setbacks. Director of Planning, Isaac Williams, presented the proposed ordinance amendments to Council. The public hearing opened and closed at 7:10 p.m. with no speakers. Council provided discussion on the item. Motion to approve – Wade; second by Holtz, motion carried with all ayes. ORDINANCE NO. 2023-2504 Executive Session was convened at 7:22 p.m. 6.0 EXECUTIVE SESSION 6.1 A. Council shall convene into a closed executive session pursuant to Sections 551.072 and 551.087 of the Texas Government Code to deliberate regarding purchase, exchange, lease or value of real property and commercial or financial information the city has received from a business prospect(s), and to deliberate the offer of a financial or other incentive to a business prospect(s). B. Council shall convene into a closed executive session pursuant to Section 551.074 of the Texas Government Code to deliberate the evaluation, reassignment, duties, discipline, or dismissal of the Municipal Court Judge. PRIOR ACTION On February 14, 2023, The Colony’s Planning and Zoning Commission voted (6-0) to recommend approval PDA22-0006, regarding amendments to Planned Development -18 (PD-18) aka The Tribute, by modifying Exhibit C “Standards Regulations and Conditions,” by updating Section II, to establish the development standards for “The Tribute Hotel Resort,” a 6-story, 163 guest room hotel, with restaurant, and event space. PROPOSED DEVELOPMENT Mathews Southwest (the master developer) and partner BOKA Powell proposes an amendment to the Tribute Planned Development by establishing an the development standards for a 6— story, 163 guest room hotel, with restaurant, and event space. The proposed development will consist of approximately 7.7 acres, to accommodate the following development and amenities: 163 guest room, 6-story hotel 8,000 square foot ballroom Outdoor event lawn 6,000 square foot meeting space with boardroom 2,300 square foot restaurant and lobby bar with 2,400 square foot lounge 3,800 square foot rooftop bar and outdoor terrace Spa and fitness facility for patrons and Tribute residents and guests 39 The proposed development will be compatible with the aesthetic and context of the architectural requirements within the Tribute’s overall Design Review Guidelines. The conceptual layout and delineation of the proposed development, landscape and architectural elements are reflected in this amendment, a subsequent site plan further refining the overall development will follow the consideration this amendment. Notice for this Public Hearing was published in The Dallas Morning News on February 17, 2023. In addition, Zoning Ordinance also requires notification of property owners located within 200 feet of the subject property a minimum of ten (10) days prior to the public hearing. Public Hearing notices were mailed on February 17, 2023 to adjacent property owners. No comments either for or against the Planned Development Amendment were received as of printing of this packet. Conduct a public hearing, discuss and consider an ordinance regarding amendments to the Comprehensive Zoning Ordinance by amending Appendix A, Section 17A, subsection 17A- 1100 “Recommended Plant List”, and by amending Appendix A, Section 10A, subsection 10A- 800 entitled “Texas SmartScape Plant List”. BACKGROUND During customary staff review and maintenance of the Zoning Ordinance, Staff found the Landscape Ordinance's “Recommended plant list,” drafted and in use since 1997, contained limited options and invasive and problematic species. The City also utilizes a second recommended plant list within the areas of the Gateway Overlay District. The Gateway Overlay District’s “Texas SmartScape®; Plant List” adopted 2013, was also found to have problematic species. Texas SmartScape TM is a program of the North Central Texas Council of Governments that contains over 400 approved plants. Updating the plant lists will remove species considered invasive by the USDA, like Japanese honeysuckle, from the Texas SmartScape Allowable List. Updates also consider removing plants with known longevity and maintenance issues like the Aristocrat pear, and Red tip photinia. The revised lists will also use consistent capitalization of plant names between the plant lists. An additional tree list is maintained by The Tree Board. The Tree Board is an advisory board that develops a work plan each year to assist the City with the care, maintenance, planting, and preservation of trees on public property. The Tree board provided a list of trees to begin from and was consulted on amendments to both tree lists. A recommendation to update plant lists was presented to the Ordinance Review Committee (ORC) on 1/13/2020; the ORC supported an update to the text with two suggestions. Using the Tree Board’s list as the starting point Removing Ash trees from the suggested list due to the Emerald Ash Borer The Planning Department compiled and developed plant lists from multiple regional plant advisory organizations including Texas SmartScape, Trinity Forks Native Plant Society, TAMU Agrilife’s Top 100 Plants for North Texas, TAMU Earth-Kind Plant Selector. Selections were scored by Backland Prairie soils, heat tolerance, water use, drought tolerance and USDA zone. The City’s Parks and Recreation Department suggested additional plantings, solicited comments from the Tree Board for tree changes, considered invasiveness, and provided input on plants based on experience with plants in the field. 53 2 The need for consistent and contemporary plant recommendations and regulations substantiates an update to the “Recommended plant list” and the “Texas SmartScape®; Plant List.” The Planning and Zoning Commission previously considered and recommended approval of a proposed “Recommend plant list” and “Texas SmartScape®; Plant List” on the 5/10/22. SECTION 6.Any person, firm, or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of The Colony, Texas, shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense. Proposed Development Plans Exhibits 68 2 ATTACHMENT 1 Staff Analysis Land Use Analysis The proposed auto repair garage (inside) is located on Main Street at the intersection of West Lake Highlands Drive. in the General Retail (GR) Zoning District and Gateway Overlay District. Auto repair garages (inside) uses are allowed “by–right” within the GR zoning district. All four corners of the West Lake Highlands and Main Street intersection are presently undeveloped. Nearby development consists of a strip retail development, a church, and vacant residential land. Site development considers mitigation of typical auto repair garage sound impacts with specific orientation of the bay doors, landscaped buffers, screen walls, and an acoustically evaluated equipment selection. The applicant has provided a sound study and control plan to reduce sound levels and the impact of an auto repair garage facility. The site is proposed to operate from 8 a.m. to 5 p.m. Monday thru Friday and 8 a.m. to 4 p.m. Saturday, and closed Sunday. Elevations The elevation plan reflects a contemporary aesthetic with elevations consisting predominately of textured masonry and accented materials and colors. The elevation plan reflects facades consisting of an earth tone color pallet. The color selection and percentages are consistent with other projects within the overall development. Each facade contains horizontal and vertical articulations, fenestration and color change to offer visual interest in accordance with the overall development motif. Circulation and Parking An existing driveway stub provides primary access to Main Street. Secondary access to Main Street is available by mutual access north of the property. A new sidewalk connecting the business to the existing public sidewalk on Main Street serves pedestrian connectivity. The site also provides a six-unit (6) bike rack consistent with the Pedestrian and Bicycle Standards of the Gateway. The Site Plan reflects adherence to the Vehicular Parking, Parking Lot, and On-Site Traffic Regulations of the Zoning Ordinance and is consistent with the connectivity intent of the Gateway Overlay District. All eighteen (18) spaces are required for parking and no outdoor storage is requested consistent with allowed uses for the General Retail (GR) zoning district. Landscaping and Buffering The Landscape Plan reflects the planting of various canopy trees, small ornamental trees, shrubs, and ground cover consistent with development within the Gateway Overlay District. The landscape plan reflects planting of Oaks, Cypress, Crape myrtle, Red bud, Vitex and Holly. Landscaping will be irrigated in compliance with City standards. This report summarizes the applicable noise standards, the noise modeling methodology, and expected noise levels at the property line. The analysis is based on the site plan sent December 16, 2022, and interior floor plans and equipment sound level information sent on December 9, 2022. Noise Ordinances The Colony, Texas Code of Ordinances, Chapter 6 – Buildings, Construction, Health and Sanitation, Article IX – Public Nuisances, Sec. 6-192 Noise states that “Any unreasonably loud, disturbing noise which causes material distress, discomfort or injury to persons of ordinary sensibilities in the immediate vicinity thereof is hereby declared to be a nuisance and is hereby prohibited.” Additionally, the use of mechanical devices operated by compressed air are declared to be nuisances “unless the noise to be created is effectively muffled and reduced.” The ordinance does not have a prescribed maximum sound level requirement; this report provides the expected sound levels under a worst-case condition to be compared to the existing noise levels. Noise Modeling Our environmental noise analysis was performed using industry-standard sound prediction software (SoundPlan). The interior Inputs to the model include the following: · The Main Street Auto Repair building, as detailed within the architectural drawings o Interior finishes were assumed to be all hard surfaces (no absorption) o Exterior walls were assumed to be insulated, with either brick veneer (STC 56) or fiber cement board (STC 47) as shown in the elevations o Roof was assumed to be plywood with R19 insulation (STC 38) o Overhead doors into the auto repair bays were assumed to be standard aluminum doors (STC 12) o Standard metal doors and single-pane windows (STC 30) were included as shown in the elevations · Noise Producing Equipment 83 Firestone Complete Auto Care – SP22-0004 Environmental Noise Assessment January 20, 2022 Page 2 of 3 Wrightson, Johnson, Haddon & Williams, Inc. Designers and Planners for Sound, Video, Multi-Media, Telecommunication, Broadcast, Theatre & Acoustics o Air Compressor: includes a sound enclosure, with reported sound levels of 67 dBA (assumed to be measured at 5 ft from the equipment) o Impact Drivers: reported sound levels of 70 dBA (assumed to be measured at 5 ft from the equipment), operating one per auto repair bay · Elevation data from Google Maps GIS Cut sheets of the selected air compressor and impact drivers are attached for your reference. Excluded from the model were the sound from existing mechanical and electrical equipment not listed above, foliage, and variable meteorological effects. Results With the overhead doors to the auto repair bays open (a worst-case operating condition for noise transmission), the sound levels at the property line are calculated to be 60 dBA at the west property boundary (to the existing church) and 55 dBA at the north property boundary (residential). These are shown in Figure 1, below. While we have not performed measurements of the existing ambient conditions, these levels are comparable with a typical quiet urban area during daytime hours (assumed 60 dBA). Figure 1: Predicted Sound Levels with Doors Open With the overhead doors to the auto repair bays closed (from our understanding, this is the typical operating conditions), the sound levels at the property line are calculated to be 45 dBA at the west property boundary and 41 dBA to the north property boundary. This represents nearly a 15 dB reduction in sound level from the condition with the doors open, and the resulting sound levels are most comparable to levels a quiet rural area. These levels are also less than the ambient sound levels provided by the City from another property also located along Main Street. By closing the doors during most operations, noise levels at the property line will be significantly muffled, with most sound being quieter than typical suburban noise levels to the point where it would be nearly inaudible.
