1.0 ROUTINE ANNOUNCEMENTS, RECOGNITIONS and PROCLAMATIONS
1.1 Call to Order
Mayor Boyer called the meeting to order at 6:30 p.m.
1.2 Invocation
Pastor Bruce White with Journey Baptist Church delivered the invocation.
1.3 Pledge of Allegiance to the United States Flag
The Pledge of Allegiance to the United States Flag was recited.
1.4 Salute to the Texas Flag
Salute to the Texas Flag was recited.
1.5 Recognize two City employees, Michael Chesney and Gerardo Vasquez, for their
heroic efforts taken in helping to locate a lost 10 year-old male in the Eastvale
neighborhood on November 24, 2021.
Assistant Chief Jay Goodson presented this item to Council. Engineering
Inspection Team Leader, Tammy Carter, shared insight of their efforts as well. The
pair were given certificates of recognition from The Colony Police Department
Police Chief David Coulon.
1.6 Items of Community Interest
Councilmember Ensweiler announced Deputy City Manager Joe Perez would be
participating in a fundraiser for United Way of Denton County called "Dancing
with Our Stars" on January 15, 2022.

community of The Colony for thirty years.
2.0 CITIZEN INPUT
Mayor Kevin Falconer of the City of Carrollton, 2209 Whitman, Carrollton, spoke
concerning his run for office as Denton County Commissioner Precinct 2.
3.0 WORK SESSION
3.1 Receive a presentation and update from SPAN.
Deputy City Manager, Joe Perez, introduced Diane Beck, Mobility Manager and
Michelle McMahon, Executive Director of SPAN Denton County. Ms. Beck thanked
The Colony for the support to SPAN throughout the year. She shared with Council
a post-holiday SPAN/MOW Employee Extravaganza that will be held on January
29, 2022.
3.2 Discuss Public Information Requests Quarterly Report as presented for Council review.
None
3.3 Council to provide direction to staff regarding future agenda items.

4.0 CONSENT AGENDA
Motion to approve all items from the Consent Agenda- Marks; second by Ensweiler, motion
carried with all ayes.
4.1 Consider approving City Council Regular Session meeting minutes for December
7, 2021.
4.2 Consider approving Council expenditures for the months of October and November
2021.
4.3 Consider approving the Mayor sign the Governors mandated “State of Texas
Department of Emergency Management 147 Notification Form”, that City of The
Colony will continue to operate under the Denton County Emergency Management
system, and that the security advisor will continue to serve as the Mayors
designated Emergency Management Coordinator for calendar year 2022.
4.4 Consider approving a resolution authorizing the City Manager to execute a Real
Estate Sales Contract and complete closing activities for the sale of a portion of

INDEPENDENT CONTRACTOR AGREEMENT
THIS INDEPENDENT CONTRACTOR AGREEMENT (hereinafter referred to as the
“Agreement”) is made and entered to be effective the 1st day of February, 2022, by and between
the CITY OF THE COLONY, TEXAS (hereinafter referred to as the “City”), a Texas home-rule
municipality, and Tod-Co Consultative Services (hereinafter referred to as “Contractor”), both
of which parties hereto understand and agree as follows:
WITNESSETH:
WHEREAS, it is the desire of the City of The Colony, Texas, to engage the services of
Contractor in order to assist in the development of a Hotel/Convention Center (hereinafter referred
to as the “Project”).
NOW, THEREFORE, for and in consideration of the mutual covenants and agreements
herein contained, and hereinbefore stated, the parties hereto agree as follows:
A. Term
This Agreement shall take effect on February 1, 2022 and shall continue until January 31,
2023.
B. Scope of Work
Contractor shall provide the necessary professional services to allow for the development
of a hotel/convention center, manage its employees, negotiate acquisition of required real estate,
maximize available State statutory rebates, coordinate with the hotel developer, and report to the
City regularly on the status of such activities. The policy making and governmental functions
relating to the project shall remain fully vested with the City. Such functions shall include, but
limited to, making decisions regarding significant capital requirements for the project, approving
a major contracting for services or goods; responsibility for the statutory requirements of the State
rebates, funding and the like; and any other significant business or policy decisions related to the
development of the Hotel/Convention Center. From time to time as questions with policy
implications arise, Contractor shall consult with the City to reach agreement on the degree of
involvement the City that may be necessary under this paragraph. In the event the parties are unable
to agree, the matter shall be deemed within the oversight and policy function of the City and the
City’s decision in the matter shall in all events be controlling.
Contractor shall abide by all City rules, regulations and policies as detailed in the City
Charter, the Municipal Code, the City Code of Ordinances, state law and as reasonably directed
by the City.

C. Compensation
Contractor shall be compensated in the amount of one hundred thirteen thousand forty
dollars ($113,040.00) payable in monthly installments of nine thousand four hundred twenty
dollars ($9,420.00). The first payment shall be due and issued on February 26,2021 with each
subsequent payment made on the last Friday of each month until the final payment is made on
January 28, 2022. In addition, the City agrees to provide the Contractor access to City cell phone
services and data plan.
D. Technology Equipment
The City agrees to provide Contractor with technology interface equipment such as cellular
telephone, computing equipment, etc. used in the scope of work as outlined herein. Technology
equipment shall be determined and provided by the City at their sole discretion. Contractor shall
have the right to retain possession as additional compensation upon termination of this contract.
E. Travel Expenses
The City agrees to reimburse Contractor for reasonable travel expenses incurred in the
scope of his work as outlined herein. Travel expenses shall be preapproved by the City prior to
being incurred. Contractor shall request reimbursement by submitting an itemized request,
including receipts, to the City.
Contractor shall receive additional automobile-related reimbursement. The mileage fee
will be equivalent to that established by the Internal Revenue Service.
Reimbursement shall be requested through the Director of Government Relations.
G. Contractor’s Employees
Contractor has and retains full control and supervision of the services performed as
described in the Statement of Work and has full control over the employment and compensation
and discharge of all persons, other than the City employees, assisting in the performance of the
services referenced herein. Contractor shall be solely responsible for all matters relating to
payment of wages to its employees, including but not limited to compliance with social security
payroll tax withholdings and unemployment compensation. Contractor further agrees to be
responsible for its own acts and those of its subordinates, employees and any subcontractors, if
any, during the term of this Agreement. Further, Contractor’s relationship to the City is that of an
independent contractor, and not an agent, employee or servant. Contractor shall have no authority
to bind the City or any of its administrators, officers or employees. In the ordinary course of
business, Contractor may perform services for parties other than the City and is not precluded from
doing so by this Agreement so long as those services do not conflict with the goals and objectives
of the City.

H. Business Expenses
Contractor shall provide any and all supplies, equipment or other business expenses used
for services; however, Contractor shall coordinate with the City the use of any City owned
supplies, equipment or services if same are available.
I. Liability
The City shall not be liable or responsible for any injuries, damages or losses of Contractor
during the course and scope of the services performed by Contractor pursuant to this Agreement.
Independent Contractor shall defend, indemnify and hold harmless the City and its officers, agents
and employees from and against all damages, claims, losses and demands made by Contractor
arising out of or resulting from the performance of her services.
J. Right of Termination
The City reserves the right to cancel this Agreement at any time, with or without notice, to
Contractor, in the City’s sole discretion. Contractor may cancel this Agreement after providing the
City with at least thirty (30) days’ notice. If Contractor engages in any activity that poses an
immediate threat to the health, safety or reputation of Contractor’s or the City’s employees,
residents, invitees, agents or representatives, such termination of this Agreement may be
immediate. Termination of this Agreement under this paragraph shall result in the voiding of any
upcoming payments that may be due.

Contractor Agreement to be signed and executed on its behalf by the City Manager and Contractor
has signed and executed this Independent Contractor Agreement.

found to be acceptable and in the best interest of the City and its citizens, and the City
Manager is hereby authorized to renew the Contract on behalf of the City of The Colony,
Texas, with the terms and conditions as stated therein.
Section 3.That this resolution shall take effect immediately from and after
its passage.

INDEPENDENT CONTRACTOR AGREEMENT
THIS INDEPENDENT CONTRACTOR AGREEMENT (hereinafter referred to as the
“Agreement”) is made and entered to be effective the 1st day of February, 2022, by and between
the CITY OF THE COLONY, TEXAS (hereinafter referred to as the “City”), a Texas home-rule
municipality, and Diane Baxter (hereinafter referred to as “Contractor”), both of which parties
hereto understand and agree as follows:
WITNESSETH:
WHEREAS, it is the desire of the City of The Colony, Texas, to engage the services of
Contractor in order to assist in the promotion of the City and the event known as The Volunteers
of America LPGA Texas Classic (hereinafter referred to as the “Event”).
NOW, THEREFORE, for and in consideration of the mutual covenants and agreements
herein contained, and hereinbefore stated, the parties hereto agree as follows:
A. Term
This Agreement shall take effect on February 1, 2022 and shall continue until January 31,
2023.
B. Scope of Work
Contractor shall serve as the liaison between the City and the Event organizers including
Outlyr Marketing Group, LPGA officials and Old American Golf Club in order to insure all needs
are met for a successful event. Contractor shall be responsible for coordinating staff for City
provided needs. Contractor will coordinate City staff meetings leading up to the Event as well as
a follow-up meeting at the conclusion of the Event to discuss the outcome. In addition, Contractor
will coordinate any meetings necessary between City staff and Outlyr Marketing Group, LPGA
officials and Old American Golf Club.
Contractor shall abide by all City rules, regulations and policies as detailed in the City
Charter, the Municipal Code, the City Code of Ordinances, state law and as reasonably directed
by the City.
C. Compensation
Contractor shall be compensated in the amount of thirty-three thousand dollars
($33,990.00) payable in monthly installments of two thousand eight hundred thirty-two dollars
and fifty cents ($2,832.50). The first payment shall be due and issued on February 28, 2022 with
each subsequent payment made on the last Friday of each month until the final payment is made
on January 29, 2023. In addition, the City agrees to pay Contractor a monthly stipend for cell
phone use at the rate of thirty-eight dollars ($38.00) per month.

NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS, THAT:
Section 1.The findings set forth above are incorporated into the body of this
Resolution as if fully set forth herein.
Section 2.The City Council of the City of The Colony, Texas, has duly reviewed and
considered the contract for a professional services by and between the City of The Colony, Texas,
and Infinity Lawn & Landscape, LLC, for the purpose of contractual services throughout the city.
Section 3.The City Council of the City of The Colony, Texas, does hereby approve
and authorizes the City Manager to execute the contract for a professional services by and between
the City of The Colony, Texas, and Infinity Lawn & Landscape, LLC, attached hereto as Exhibit
A, and is incorporated herein for all purposes.
Section 4.This Resolution shall take effect immediately from and after its passage.

Staff Analysis
Land Use Analysis
The proposed fire station is a government building and is allowed by the regulations of PD 18 –
Planned Development District.
Infrastructure Improvements
No new infrastructure improvements are anticipated at this time.
Circulation and Parking
The subject site will be accessed by an access drive with two points from Lebanon Road; each
access drive is inline with median openings. The westernmost access at Scotty’s Lake Lane is a
signalized intersection but will only facilitate emergency ingress/egress to the site.
Landscaping and screening
The Landscape Plan reflects large and small ornamental trees including Shumard and Southern
Live Oaks, Lacebark Elm, Sugar Maple and Crape Myrtle and shrubs such as pampas grass
Burford Holly and Wax Myrtles. These plantings are located within the landscape buffer and
interior to the site. The landscape buffer is designed with a large berm adorned with the
aforementioned plantings. A minimum 20% of landscape area is required per the Zoning
Ordinance; 84% of the site is dedicated to landscape area.
Exterior Building Materials
The proposed façade elevations reflect a contemporary fire station aesthetic. The proposed
building is designed with four-sided architecture containing an earth toned color palate with
vertical and horizontal articulations, divided windows, window headers, awnings, and canopies
and material and color changes offering depth and visual interest. The proposed elevations are
consistent with the architectural intents of the Planned Development 18 for the proposed use.
Development Review Committee Review
The Development Review Committee finds that the Development Plan meets requirements of the
Zoning Ordinance and therefore recommends approval.

Fire Station 5 – City of The Colony
Project Narrative
Halff Associates provided all surveying and complete engineering services for the design of
on-site improvements, a traffic signal, and offsite drainage improvements necessary for the
construction of The Colony’s Fire Station 5 located on 3.42 acres of land (Lot 1) as shown in
abstract 182 of the B.B.B & C.R.R. survey on W. Lebanon Road. The design of said improvements
will meet all local (City of The Colony) and state (TDLR & TCEQ) guidelines. This development
will meet all zoning ordinances. Halff Associates coordinated with the City of The Colony to
obtain record drawings of existing utilities near the site to properly design future improvements to
this site.
Proposed improvements include paving, drainage, water, and sanitary sewer improvements.

After determining that a quorum was present, the Planning and Zoning Commission of the City
of The Colony, Texas convened into Regular Session which was held on Tuesday, January 11,
2022 at 6:30 p.m. in the City Council Chambers located at City Hall, 6800 Main Street, The
Colony, Texas, at which time the following items were addressed:
Board Members Present: Karen Hames, Chairman; Brenda Armour; Randy Dull; Shannon

1.0 CALL REGULAR SESSION TO ORDER
Chair Hames called the regular session of the Planning and Zoning Commission meeting to order
at 6:30 p.m.

2.0 CONSENT AGENDA

Chair Hames read Consent Agenda Items 2.1 and 2.2 into the record.
Mr. Williams advised there was a correction to a plat easement on the packet item FP21 -0009.
The corrected plat easement was distributed to all members of the commission for consideration.
Commissioner Hebb made a motion to approve items 2.1 and 2.2 with the correction,
seconded by Commissioner Martin. The motion carried (6-0).
3.0 DISCUSSION ITEMS

Fire Chief Shannon Stephens introduced the project and offered historical context. Specifically
that previous consideration was development of a five-bay substation with a police substation
and jail. The current plan is to develop a two-bay station with a single engine company with fire
and paramedic personel. The station will have the ability to expand to ambulance service if
demand is present.
Commissioner Martin asked about the reduction to two bays and four staff.
Chief Stephens responded that the needs of the area will not require more than a single-engine
company with the possibility of an ambulance need in the future.
Commissioner Hebb asked questions: would there be no ambulance placed at the station at this
point, questioned the seven to twelve-minute ambulance response time, and asked about how the
decision is made to add the ambulance, and if the station would assist to multistation responses.
Chief Stephens responded that the station has three to four firefighter-paramedics capable of full
life support until ambulances come from other parts of the City. Also that regarding
considerations for an ambulance, demand and call volume reviewed by the Fire Chief City
Management and City Council would dictate that addition. Chief Stephens affirmed that the new
station would add to the system response.
Chain Hames, asked what the new station would do to response times.
Chief Stephens responded regarding fire response time would be reduced. Also iterated the
response standards and the service time to area clubhouses and residences.
Commissioner Rainey asked about the intent to fire and ambulances stand-by for special events.
Chief Stephens responded affirmatively and stated that event personnel are off-duty fire personel
who do not reduce operating staff numbers. New fire station will have triage room at the new
station will serve special events.
Commissioner Hebb made a motion to approve with the correction to the easement as
presented by staff, seconded by Commissioner Rainey. The motion carried (7-0).
4.0 PUBLIC HEARING ITEMS
4.1 PDA21-0002 Live Oak Logistic Park – Planned Development Amendment
Conduct a public hearing, discuss and consider making a recommendation to City
Council for amendments to Planned Development-19 (PD-19) District, by modifying
Section II- Business Park Regulations to define and establish regulations for Storage,
open (visual screen) within the 97.55 acre tract of land for Business Park (warehouse
and light fabrication and assembly) uses. The subject site is located east of Standridge
Drive, north of Memorial Drive, west of Main Street and south of the Ridgepoint
neighborhood.

WHEREAS, the Planning and Zoning Commission and the City Council of the City of The
Colony, Texas, in compliance with the laws of the State of Texas, and the Code of Ordinances of the

and finds that

SECTION 1. That the findings set forth above are incorporated into the body of this
Ordinance as if fully set forth herein.
SECTION 2.That the City Council of the City of The Colony, Texas, does hereby
approve the Site Plan, Landscape Plan and Elevation [Façade] Plans copies of which are attached
hereto as, Exhibit A of this Ordinance.
SECTION 3.That it is hereby declared to be the intention of the City Council of the
City of The Colony, Texas, that the phrases, clauses, sentences, paragraphs and sections of this
Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this
Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases,
clauses, sentences, paragraphs and sections of this Ordinance, since the same would have been
enacted by the City Council without the incorporation of this Ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4. That any provision of any prior ordinance of the City whether codified or
uncodified, which are in conflict with any provision of this Ordinance, are hereby repealed to the
extent of the conflict, but all other provisions of the ordinances of the City whether codified or
uncodified, which are not in conflict with the provisions of this Ordinance, shall remain in full

SECTION 5. That this Ordinance shall become effective immediately upon its passage.

The applicant's request reflects the intent to develop the second and final portion of the second
Phase of a multi-building commercial development known as Live Oak Logistics Center. Phase
IIB contains approximately 242,400 square feet of warehouse and office space within two (2)
buildings.
Phase II consists of two lots totaling approximately 26.26 acres. Lot 1, Block B contains building
D and, Lot 3, Block A contains building E. Building D is approximately 126,480 square feet, and
Building E is about 115,920 square feet. The proposed development adheres to the updated
permitted land uses, buffering, parking, landscaping, overall phasing and timing of infrastructure
and utilities conceptually reflected in the amendments to Planned Development-19 (PD-19).

Staff Analysis
Land Use Analysis
The subject site is located within the Planned Development 19 (PD-19) zoning district. This
Planned Development is intended for uses categorized as light to heavy commercial, within the
context of a business park configuration. Phase IIB contains approximately 26.26 acres.
Phase IIB is the final Phase of the Live Oak Logistic Center. Phase I, included three buildings
totaling 331,000 SF on approximately 22.11 acres, phase IIA included two buildings totaling
535,530 SF on approximately 46.66 acres, and phase IIB is to have two buildings totaling
242,400 SF on approximately 26.26 acres. Overall Live Oaks Logistics center will contain about
1.2 million square feet of warehouse and office space on approximately 97 acres.
Building Elevations
The elevation plan reflects a contemporary warehouse aesthetic of tilt wall construction with
elevations consisting predominately of textured concrete and accented materials and colors.
Each non-loading facade contains horizontal and vertical articulations, fenestration and color
change to offer breaks of continuous and monotonous building elevation typical of large
warehouse buildings. Dock doors are reflected on the westward facing elevations and the doors
are screened by buildings and a permanent and mature vegetative buffer.
The elevation plan reflects an earth tone color pallet, which includes shades of gray. The color
selection and percentages of materials are consistent with the approved conceptual plan and the
Gateway Overlay District. The plan also reflects consistency with other similar development
types and development within the surrounding area.
Site Lighting
A mixture of wall pack and pole-mounted lights provides illumination to the site. No mounting
fixture height exceeds twenty-eight (28) feet, and the site illumination reflected on the
photometric plan is consistent with the planned development requirements.

Infrastructure Improvements
A Traffic Impact Analysis (TIA) was conducted and revealed the need for a Traffic Signal to be
installed at the intersection of Market Street and Memorial Drive as part of Phase IIB.
The TIA was submitted by the developer and reviewed by City Staff and a third party consultant.
Circulation and Parking
Phase IIB of the proposed development requires a total of 181 parking spaces to accommodate
the intended office and warehouse components. The site plan reflects a parking area containing
362 parking spaces, including twelve (12) ADA-accessible spaces. Each building provides large
truck docks and loading areas. A total of seventy-two (72) truck berths align with dock doors
between buildings D and E. Additionally, thirty-four (34) trailer parking spaces will serve in the
short-term cycling of cargo for building E. The site circulation is configured to provide internal
vehicular connectivity and eight (8) access points into Phase IIB. Perimeter parking areas,
including truck courts, are screened by buildings, building extensions (wing walls) or vegetation.
The proposed circulation and parking design is consistent with the approved conceptual site plan
and reflects adherence to the Vehicular Parking, Parking Lot, and On-Site Traffic Regulations of
the Zoning Ordinance and is consistent with the connectivity intent of the Gateway Overlay
District.
Landscaping and Screening
The Landscape plan reflects the planting of a variety of large trees, small ornamental trees,
shrubs, and ground cover consistent with development within the Gateway Overlay District and
in conformance with the approved conceptual landscape plans.

opinion and finds that Site Plan Application No. SP21-0006 for the development of a multi-building
commercial development on two tracts of land totaling approximately 26.26 acres, located west of
the northwest intersection of Live Oak Drive and Memorial Drive, within the Planned Development
19 (PD19) and Gateway Overlay District; shall be approved.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
SECTION 1. That the findings set forth above are incorporated into the body of this
Ordinance as if fully set forth herein.
SECTION 2.That the City Council of the City of The Colony, Texas, does hereby
approve the Site Plan, Landscape Plan, Elevation [Façade] Plans, and Photometric Plans copies
of which are attached hereto as, Exhibit A of this Ordinance.
SECTION 3.That it is hereby declared to be the intention of the City Council of the
City of The Colony, Texas, that the phrases, clauses, sentences, paragraphs and sections of this
Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this
Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases,
clauses, sentences, paragraphs and sections of this Ordinance, since the same would have been
enacted by the City Council without the incorporation of this Ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.

SECTION 4. That any provision of any prior ordinance of the City whether codified or
uncodified, which are in conflict with any provision of this Ordinance, are hereby repealed to the
extent of the conflict, but all other provisions of the ordinances of the City whether codified or
uncodified, which are not in conflict with the provisions of this Ordinance, shall remain in full
force and effect.
SECTION 5. That this Ordinance shall become effective immediately upon its passage.

ORDINANCE NO. 2022 - _______
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, READOPTING, RATIFYING, REPUBLISHING AND
EXTENDING CHAPTER 13, ARTICLE III, SECTIONS 13-31 THROUGH
13-37 OF THE CODE OF ORDINANCES FOR CURFEW HOURS FOR
MINORS IN THE CITY OF THE COLONY, TEXAS, FOR A PERIOD OF
THREE (3) YEARS; PROVIDING A REPEALING CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of The Colony, Texas, has previously passed
and adopted an Ordinance which provides for “Curfew Hours for Minors” establishing such curfew
hours and penalties for violations thereof; and
WHEREAS, such Ordinance has been codified in Chapter 13, Article III, Sections 13-31
through 13-37; and
WHEREAS, Section 370.002(a) of the Texas Local Government Code provides that
“[b]efore the third anniversary of the date of adoption of a juvenile curfew ordinance by a general-
law municipality or a home-rule municipality or an order of a county commissioners court, and
every third year thereafter, the governing body of the general-law municipality or home-rule
municipality or the commissioners court of the county shall: (1) review the ordinance or order's
effects on the community and on problems the ordinance or order was intended to remedy; (2)
conduct public hearings on the need to continue the ordinance or order; and (3) abolish, continue,
or modify the ordinance or order;” and
WHEREAS, prior to the expiration of such three-year period, the Police Department has
furnished records and reports indicating the need for such to remain in effect; and
WHEREAS, the City desires to continue the provisions of the Juvenile Curfew Ordinance
without any modifications, and schedule the same for review in February 2025.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS;
SECTION 1. That Chapter 13, Article III, Sections 13-31 through 13-37 is hereby
readopted, ratified, republished and extended from the date of its execution and shall remain in
effect through February 2025, unless otherwise terminated under the provisions of the State law.
SECTION 2. That all provisions of the Code of Ordinances of the City of The Colony,
Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all
other provisions not in conflict with the provisions of this ordinance shall remain in full force and
effect.

SECTION 3. That should any word, phrase, paragraph, section or phrase of this ordinance
or of the Code of Ordinances, as amended hereby, be held to be unconstitutional, illegal or invalid,
the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof
other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity
of the Code of Ordinances as a whole.
SECTION 4.That this Ordinance shall take effect immediately from and after its passage
and the publication of the caption, as the law and charter in such cases provide.
