The Regular Session of the City Council of the City of The Colony, Texas, was called to order
at 6:30 p.m. on the 3
rd day of November 2021, at City Hall, 6800 Main Street, The Colony,

Community Development Corporation.
4.4 Consider approving a resolution authorizing the City Manager to execute a seven-
year lease agreement with Stryker Sales, LLC for the provision of City of the
Colony Facility automatic external defibrillators (AEDS), The Colony Police
Department AEDS, and The Colony Fire Department monitor/defibrillators, Lucas
chest compression systems, and emergency patient transport devices in the amount
of $159,649.90.

4.5 Consider approving a resolution authorizing the City Manager to issue a purchase
order to Frazier Ambulance in the amount of $278,732.00 for the purchase of a new
ambulance to replace Medic 12 assigned to Fire Station #2.

4.6 Consider approving a resolution authorizing the City Manager to execute an
Engineering Services Contract in the amount of $67,780.00 with Birkhoff,
Hendricks & Carter, L.L.P., to prepare construction plans and specifications for the
Squires Drive 8-inch Waterline Replacement and Vaden Street 8-inch Waterline
Extension Project.

4.8 Consider approving a resolution authorizing the City Manager to accept a bid from
Next Gen Construction in the amount of $210,400.00 for the Police Department
Roof Recover Project.
RESOLUTION NO. 2021-073
5.0 REGULAR AGENDA ITEMS
5.1 Conduct a public hearing, discuss and consider an appeal of the Sign Board of Appeals
regarding a variance from Chapter 6, Section 6-258 [Prohibited signs] to allow an off-
premise LED digital sign [“Billboard”] at 3905 SH 121. The subject site is within the
Business Park (BP) zoning district and the Gateway Overlay District.
Senior Planner, Isaac Williams, provided Council with a brief overview concerning
the request to postpone the item.
The public hearing opened at 6:49 p.m., Dallas Cothum, 7201 Main Street, Suite
1280, Dallas, appeared in support of opposition of this agenda item. One individual
registered in support of opposition. There being no other speakers, the public
hearing closed at 6:53 p.m.
Motion to continue the public hearing in action until the December 7, 2021 meeting- Wade;
second by Boyer, motion failed with the following votes: McCourry, Boyer and Wade ayes;
Terre, Schrag and Marks nays.
Motion to overrule the Sign Board of Appeal's decision and to deny applicants request for the
billboard - Boyer; second by Schrag, motion carried with all ayes.
5.2 Discuss and consider approving a resolution authorizing the City Manager to issue
a purchase order to Axon Enterprise, Inc. in the amount of $231,139.85 for the
purchase of a Taser upgrade in the Police Department.
Police Chief, David Coulon, provided an overview on this item.
Motion to approve- Wade; second by Marks, motion carried with all ayes.

5.3 Discuss and consider approving a resolution authorizing the City Manager to
execute an Engineering Services Contract in the amount of $222,490.00 with Halff

Director of Engineering, Ron Hartline, provided an overview on this item.

RESOLUTION NO. 2021 - ________
WHEREAS,the City of The Colony has joined in the formation of a Denton Central
Appraisal District; and
WHEREAS, the Denton County Chief Appraiser has notified each taxing entity that
voting is in order for establishing a new five member Board of Directors; and
WHEREAS, the Denton County Chief Appraiser has notified the City of its voting
entitlement of eighty-one (81) votes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF THECOLONY, TEXAS:
That the City of The Colony votes are hereby cast for David Terre to serve on the
Denton Central Appraisal District Board of Directors.

THE STATE OF TEXAS §
§ THE COLONY PUBLIC LIBRARY
COUNTY OF DENTON §
INTERLOCAL COOPERATION AGREEMENT
FOR LIBRARY SERVICES
THIS AGREEMENT is made and entered into by and between Denton County, Texas
("the COUNTY"), and the City of The Colony, Texas ("the MUNICIPALITY"), and has an
effective date of October 1, 2021.
WHEREAS, the COUNTY is a duly organized political subdivision of the State of
Texas engaged in the administration of county government and related services for the benefit of
the citizens of the COUNTY; and
WHEREAS, the MUNICIPALITY is a duly organized municipality in Denton County,
Texas, engaged in the provision of library and related services for the benefit of the citizens of
the MUNICIPALITY; and
WHEREAS, the COUNTY has requested, and the MUNICIPALITY has agreed to
provide library services for all residents of the COUNTY; and
WHEREAS, the COUNTY and the MUNICIPALITY mutually desire to be subject to
the provisions of Chapter 791 of the Texas Government Code, the Interlocal Cooperation Act,
and Chapter 323 of the Texas Local Government Code, regarding County Libraries.
NOW, THEREFORE, the COUNTY and the MUNICIPALITY, for the mutual
consideration hereinafter stated, agree and understand as follows:
I.
The term of this Agreement shall be for the period from October 1, 2021, through
September 30, 2022.
II.
For the purposes and consideration herein stated and contemplated, the
MUNICIPALITY shall provide library services for the residents of the COUNTY without
regard to race, religion, color, age, disability or national origin. Upon proper proof of residence,
by an individual in the COUNTY, the individual shall be entitled issuance of a library card, at no
cost, to be used in connection with said library services.

The MUNICIPALITY shall develop and maintain through the Library one or more of
the following programs of service:
1. Educational and reading incentive programs and materials for youth.
2. Functional literacy materials and/or tutoring programs for adults.
3. Job training/career development programs and/or materials for all ages.
4. Outreach services to eliminate barriers to library services.
5. Educational programs designed to enhance quality of life for adults.
III.
The COUNTY designates the County Judge to act on behalf of the COUNTY and serve
as liaison officer for the COUNTY with and between the COUNTY and the MUNICIPALITY.
The County Judge or his designated substitute shall insure the performance of all duties and
obligations of the COUNTY herein stated and shall devote sufficient time and attention to the
execution of said duties on behalf of the COUNTY in full compliance with the terms and
conditions of this Agreement. The Count y Judge shall provide immediate and direct supervision
of the COUNTY'S employees, agents, contractors, sub-contractors, or laborers, if any, in the
furtherance of the purposes, terms and conditions of this Agreement for the mutual benefit of the
COUNTY and the MUNICIPALITY.
IV.
The MUNICIPALITY shall designate to act on behalf of the
MUNICIPALITY and to serve as liaison officer for the MUNICIPALITY with and between
the MUNICIPALITY and the COUNTY to insure the performance of all duties and obligations
of the MUNICIPALITY as herein stated and shall devote sufficient time and attention to the
execution of said duties on behalf of the MUNICIPALITY in full compliance with the terms
and conditions of this Agreement. ________________________ shall provide management of
the MUNICIPALITY'S employees, agents, contractors, sub-contractors, or laborers, if any, in
the furtherance of the purposes, terms and conditions of this Agreement for the mutual benefit of
the MUNICIPALITY and the COUNTY.
The MUNICIPALITY shall provide the COUNTY with a copy of the annual report
submitted to the Texas State Library and shall respond to the COUNTY'S annual questionnaire
as documentation of the MUNICIPALITY’S expenditures and provision of service.

V.
The MUNICIPALITY shall be solely responsible for all techniques, sequences,
procedures and coordination of all work performed under the terms and conditions of this
Agreement. The MUNICIPALITY shall insure, dedicate and devote the full time and attention
of those employees necessary for the proper execution and completion of the duties and
obligations of the MUNICIPALITY as stated in this Agreement and shall give all attention
required for proper supervision and direction of their employees.
VI.
The MUNICIPALITY agrees that its established library shall assume the functions of a
county library within Denton County, Texas, and to provide a librarian who meets the
requirements of the MUNICIPALITY’S job description.
VII.
The COUNTY and the MUNICIPALITY agree and acknowledge that each entity is not
an agent of the other entity and that each entity is responsible for its own acts, forbearance,
negligence and deeds and for those of its agents or employees. This Agreement does not and
shall not be construed to entitle either party or any of their respective employees, if applicable, to
any benefit, privilege or other amenities of employment applicable to the other party. The
MUNICIPALITY understands and agrees that the MUNICIPALITY, its employees, servants,
agents and representatives shall not represent themselves to be employees, servants, agents or
representatives of the COUNTY.
To the fullest extent permitted by law, the MUNICIPALITY agrees to hold harmless
and indemnify the COUNTY from and against any and all claims and for all liability arising
out of, resulting from or occurring in connection with the performance of the work hereunder,
including but not limited to, any negligent act or omission of the MUNICIPALITY, its
officers, agents or employees.
The COUNTY and the MUNICIPALITY acknowledge and agree that the COUNTY
does not waive any sovereign or governmental immunity available to the COUNTY under Texas
law and does not waive any available defenses under Texas law. Nothing in this paragraph shall
be construed to create or grant any rights, contractual or otherwise, in or to any third persons or
entities.

VIII.
This Agreement is not intended to extend the liability of the parties beyond that provided
by law. Neither the MUNICIPALITY nor the COUNTY waives any immunity or defense that
would otherwise be available to it against claims by third parties.
IX.
Any notice required by this Agreement shall be delivered, in writing, by either the
COUNTY or the MUNICIPALITY to the following addresses:

X.
For the full performance of the services above stated, the COUNTY agrees to pay the
MUNICIPALITY fees as described herein from current revenues available for such payment.
The COUNTY shall pay the MUNICIPALITY fees in the amount of THIRTY-SIX
THOUSAND FOUR HUNDRED AND NO/100 DOLLARS ($36,400.00), based upon North
Central Texas Council of Governments service population allocation figures provided to the
COUNTY by the Library Advisory Board, payable in equal quarterly installments to the
MUNICIPALITY commencing on October 1, 2021. The Allocation chart setting forth said
figures is attached hereto and incorporated herein for all intents and purposes as Exhibit “A.” In
addition, the COUNTY agrees to pay the MUNICIPALITY an amount not to exceed TEN
THOUSAND AND NO/100 DOLLARS ($10,000.00) in matching funds upon the following
conditions:
1. The MUNICIPALITY shall attempt to secure funding from sources other than
the COUNTY.
2. Upon receipt of additional funding, the MUNICIPALITY shall provide proof of
the receipt of such funds to the Denton County Auditor on a quarterly basis.

3. The COUNTY shall match the MUNICIPALITY'S additional funding in an
amount not to exceed $10,000.00.
4. Payment by the COUNTY to the MUNICIPALITY shall be made in accordance
with the normal and customary processes and business procedures of the
COUNTY and payment shall be satisfied from current revenues of the
COUNTY.
All funding by the COUNTY to the MUNICIPALITY is subject to the condition that
the MUNICIPALITY shall have in place technology protection measures (commonly referred
to as “filters”) with respect to any computers used by the public that have Internet access
which are designed to block access through such computers to visual depictions that are (1)
obscene, as defined by Section 43.21 of the Texas Penal Code, or (2) contain pornography.
The technology protection measures shall be in compliance with the Children’s Internet
Protection Act.
The MUNICIPALITY hereby certifies that its libraries have either installed and are
using the required technology protection measures during use of its computers that have
Internet access by the public at the present time or will have such protection measures in place
and operational by October 1, 2021.
XI.
This Agreement may be terminated, at any time, by either party b y giving sixty (60) days
advance written notice to the other party. In the event of such termination by either party, the
MUNICIPALITY shall be compensated pro rata for all services performed to the termination
date, together with reimbursable expenses then due and as authorized by this Agreement. In the
event of such termination, should the MUNICIPALITY be overcompensated on a pro rata basis
for all services performed to the termination date or be overcompensated for reimbursable
expenses as authorized by this Agreement, the COUNTY shall be reimbursed pro rata for all
such overcompensation. Acceptance of such reimbursement shall not constitute a waiver of an y
claim that may otherwise arise out of this Agreement.
XII.
This Agreement represents the entire integrated Agreement between the
MUNICIPALITY and the COUNTY and supersedes all prior negotiations, representations
and/or Agreements, either oral or written. This Agreement may be amended only by written
instrument signed by both the MUNICIPALITY and the COUNTY.

XIII.
The validity of this Agreement and any of its terms or provisions, as well as the rights
and duties of the parties hereto, shall be governed by the laws of the State of Texas. Further,
this Agreement shall be performable and all compensation payable in Denton County, Texas.
XIV.
In the event any portion of this Agreement shall be found to be contrary to law it is the
intent of the parties hereto that the remaining portions shall remain valid and in full force and
effect to the fullest extent possible.
XV.
The undersigned officers and/or agents of the parties hereto are the properly authorized
officials and have the necessary authority to execute this Agreement on behalf of the parties
hereto and each party hereby certifies to the other that any necessary orders or resolutions
extending said authority have been duly passed and are now in full force and effect.

A RESOLUTION OF THE CITY OF THE COLONY, TEXAS,
AUTHORIZING THE MAYOR TO EXECUTE AN INTERLOCAL
COOPERATION AGREEMENT BETWEEN THE CITY OF THE COLONY
AND DENTON COUNTY FOR THE PROVISION OF LIBRARY SERVICES
TO THE RESIDENTS OF DENTON COUNTY AS PROVIDED IN
ATTACHMENT “A”, WHICH IS ATTACHED HERETO AND
INCORPORATED HEREIN; AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:
Section 1.That the Mayoris hereby authorized and empowered to execute an Interlocal
Cooperation Agreement with Denton County for the provision of Library Services to the residents of
Denton County as defined in the Agreement, which is attached hereto and incorporated herein by

PROPOSED DEVELOPMENT
The applicants request reflect the intent to develop the first portion of the second phase of a
multi-building commercial development known as Live Oak Logistics Center. Phase 1 contains
approximately 331,000 square feet of warehouse and office space within three (3) buildings;
Phase IIA is contained within the 46.66 acres of Lot 2, Block A [1.65 acres are dedicated to
right-of-way].
The approved Concept Plan and narrative reflected an intent to develop the second and third
phase of the Live Oak Logistics center separate and sequentially to the completion of Phase 1.
The developer has updated the development schedule to establish Phase II (to encompase the
second and third phase) and subphases IIA and IIB.
Phase IIA consists of Building F and Building G. The amended planned development ordinance
reflected the intent to construct Buildings G, H and I as part of the third phase. The proposed
Phase II A site plan reflects the intent to consolidate and reconfigure the square footage of these
buildings into Buildings F and G. Building F containing approximately 395,000 , is reconfigured
to incorporate all of the square footage of Building H (189,000 square feet) and Building G
incorporates the square footage of Building I (112,500 square feet). The additional square
footage of each building prompts the overall reduction in the number of buildings.

The modified proposed development is still in accordance with the updated permitted land uses
buffering, parking, landscaping, overall phasing and timing of infrastructure and utilities
conceptually reflected in the amendments to Planned Development-19 (PD-19).
The applicant has indicated that to this point spe cific users are undefined.
DEVELOPMENT REVIEW COMMITTEE (DRC) REVIEW
The Development Review Committee (DRC) recommends approval. Staff finds that proposed
Site Plan is consistent with the approved concept plan of Planned Development (PD -19) and
meets the requirements of Zoning Ordinance where applicable.

Staff Analysis
Land Use Analysis
The subject site is located within the P lanned Development 19 (PD-19) zoning district. This
Planned Development is intended for uses categorized as light to heavy commercial, within the
context of a business park configuration. Phase IIA consists of 46.66 acres.
Building Elevations
The elevation plan reflects a contemporary warehouse aesthetic of tilt wall construction with
elevations consisting predominately of textured concrete and accented materials and colors.
Each non-loading facade contains horizontal and vertical articulations, fenestrat ion and color
change to offer breaks of continuous and monotonous building elevation typical of large
warehouse buildings.
The elevation plan reflects an earth tone color pallet, which includes shades of gray. The color
selection and percentages are consistent with the approved conceptual plan and the Gateway
Overlay District. The plan also reflects consistency with other similar development types and
development within the surrounding area.
Infrastructure Improvements
A Traffic Impact Analysis (TIA) was conducted and revealed the need for a deceleration lane at
the intersection of SH 121 and Market Street. This improvement be provided as part of the
development of Phase IIA. The TIA revealed the proposed development does not currently
trigger the establishment of a deceleration lane at the proposed entry from F.M. 423. If and when
warranted, the developer will be responsible for construction.
The proposed traffic signal at Market Street and Memorial Drive will be evaluated as part of the
site plan review of Phase IIB.
The TIA was submitted by the developer and reviewed by City Staff and a third party consultant.
Circulation and Parking
Phase IIA of the proposed development requires a total of 316 parking spaces. The site plan
reflects a parking area containing 474 passenger vehicle parking spaces including twelve (12)
ADA accessible spaces. The site will offer approximately 86 spaces sized for truck trailers
associated with the intended warehouse and office components. Each building provides large
truck docks and loading areas.
The site circulation is configured to provide internal ve hicular connectivity and five (5) access
points into Phase IIA. Perimeter parking areas including truck courts are screened by either
buildings, building extensions (wing walls) or vegetation.
The proposed circulation and parking design is consistent with the approved conceptual site plan
and reflects adherence to the Vehicular Parking, Parking Lot, and On -Site Traffic Regulations of
the Zoning Ordinance and is consistent with the connectivity int ent of the Gateway Overlay
District.

The Landscape plan reflects the planting of a variety of large trees, small ornamental trees,
shrubs, and ground cover consistent with development within the Gateway Overlay District and
in conformance with the approved conceptual landscape plans.

After determining that a quorum was present, the Planning and Zoning Commission of the City
of The Colony, Texas convened into Regular Session which was held on Tuesday, October 26,
2021 at 6:30 p.m. in the City Council Chambers located at City Hall, 6800 Main Street, The
Colony, Texas, at which time the following items were addressed:

1.0 CALL REGULAR SESSION TO ORDER
Chair Hames called the regular session of the Planning and Zoning Commission meeting to order
at 6:30 p.m.

Chair Hames opened the floor for citizen input at 6:30 p.m. No citizen came forward for input.
Citizen input was closed at 6:30 pm.

Chair Hames read Consent Agenda Items 2.1 and 2.2 into record.
Chair Hames made note of an error on Item 2.1. Minutes Item 3.1 was a Public Hearing and not a
Discussion Item.
Commissioner Hebb made a motion to approve with 2.1 correction, seconded by
Commissioner Dull. The motion carried (6-0).

Mr. Williams presented the report.
Chair Hames asked about the lighting during the winter in consideration of the landscape buffer.
Mr. Williams responded the photometric plan was reviewed with no adver se effects.
Commissioner Armour asked about the deceleration lane determinants.
Mr. Khan responded a TIA concluded a deceleration lane on FM 423 was not needed. TxDOT’s
pending review may require and if so, the developer would be responsible for construction.
Commissioner Hebb asked about a security fence where there is no retaining wall to discourage
crossing between uses.
Mr. Williams responded he would need to review the Phase I site plan in order to respond. The
applicant could respond to surveillance.
Commissioner Dull asked about Phase I’s and Phase II’s elevation difference between the road
and the truck dock.
Mr. Brian Strohl, 13727 Noel Road, Dallas, Texas, Link Logistics applicant, responded Phase I’s
trucks would sit about four feet lower than the road elevation. Phase II’s view from FM 423 is a
storefront design. The loading docks would not be visible. He also provided that tenants decide
their surveillance measures.
Mr. Gerald Green, 4017 Steepleridge Drive and resident. Mr. Green shared h is concern that this
could be catastrophic with truck traffic 24/7. Truck traffic could negatively affect nearby
residences and all access points to the city. He continued the traffic signal placement encourages
additional traffic. He shared aesthetic concerns. He shared traffic congestion and traffic safety
concerns. He asked for the number of trucks parking in the facility adding concern for increasing
street repairs. He loves living in The Colony.
Mr. Williams responded the operational hours are user specific.
Mr. Strohl responded they choose a smaller building design, which attracts showroom and
ecommerce users rather than large hub users. Smaller users typically do not operate 24/7. He
added design intentionally minimizes possible views of trucks. Link Logistics also provided
landscaping beyond requirements. Link tends to invest in and manage their properties for the
long term. He added trucks prefer access from SH 121. He further explained, because this is a
public hearing, he is speaking in general adding no leases have been signed yet.
Mr. Green shared concern for Lewisville residents’ truck noise nuisance at night. He pointed out
Lewisville residents did not have an opportunity to provide input. He shared concern for
decreasing property values.
Commissioner Hebb asked about the public notification process.

Mr. Williams responded the case in consideration this evening does not require public
notification. The Planned Development Amendment approved by City Council was publically
noticed.
Commissioner Hebb asked for confirmation that City Council approved plans.
Mr. Williams responded with the approved use history of the property including public noticing.
Commissioner Hebb made a motion to approve, seconded by Commissioner Rainey. The
motion carried (5-1).
There being no further business to come before the Commission, Madam Chair Hames adjourned
the Regular Session of the Planning and Zoning Commission at 7:10 p.m.

PHASE IIA
LIVE OAKS LOGISTICS PARK
THE COLONY, TEXAS
PROJECT NARRATIVE
Phase IIA of Live Oaks Logistics Park is a continuation of the already under construction
commercial park. This second phase consists of 2 industrial/warehouse type buildings totaling
approximately 536,500 square feet to further serve the high demand for e -commerce, light
industrial and warehouse space in the DFW market.
The approximately 45-acre parcel will include the extension of the public road Live Oak Drive
from the end of Phase I all the way to Memorial Drive (1,230’), completing the roadway work
necessary to support the entire development. The site plan includes generous perimeter
landscape setbacks, a buffer along the adjacent Office Creek preserving the native vegeta tion
and natural water courses, and generous landscape setbacks along Memorial Drive and Main
Street. Beyond the primary access point at the intersection of Live Oak Drive and Memorial
Drive, a loop road will be extended around Phase IIA, including an ext ension and access to Main
Street at the approved curb cut location.
It is the intention of the development timeline to continue with the approval of Phase IIA
currently, while the submission for approval of IIB will follow shortly thereafter. Thus, both
submissions will be in for review at around the same time. Due to the high demand for Phase
IIA the design team focused on this submission to accommodate completion of these buildings
before October of 2022.

PHASE II A, LOT 2, BLOCK A OF THE LIVE OAK LOGISTICS PARK A
MULTI-BUILDING COMMERCIAL DEVELOPMENT ON AN
APPROXIMATELY 46.66 ACRE TRACT OF LAND, WEST OF THE
NORTHWEST INTERSECTION OF F.M. 423 (MAIN STREET) AND
MEMORIAL DRIVE, WITHIN THE PLANNED DEVELOPMENT 19 (PD-

WHEREAS, the Planning and Zoning Commission and the City Council of the City of The
Colony, Texas, in compliance with the laws of the State of Texas, and the Code of Ordinances of the
City of The Colony, Texas, and the City Council of the City of The Colony, Texas, is of the opinion
and finds that Site Plan Application No. SP21-0004 for Phase IIA Lot 2, Block A of the Live Oak
Logistics Park- a multi-building commercial development on an approximately 46.66 acre tract of
land, west of the northwest intersection of F.M. 423 (Main Street) and Memorial Drive, within the
Planned Development 19 (PD-19) and Gateway Overlay District should be approved.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
SECTION 1. That the findings set forth above are incorporated into the body of this
Ordinance as if fully set forth herein.
SECTION 2.That the City Council of the City of The Colony, Texas, does hereby
approve the Site Plan, Landscape Plan and Elevation [Façade] Plans copies of which are attached
hereto as, Exhibit A of this Ordinance.
SECTION 3.That it is hereby declared to be the intention of the City Council of the
City of The Colony, Texas, that the phrases, clauses, sentences, paragraphs and sections of this
Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this
Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases,
clauses, sentences, paragraphs and sections of this Ordinance, since the same would have been
enacted by the City Council without the incorporation of this Ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4. That any provision of any prior ordinance of the City whether codified or
uncodified, which are in conflict with any provision of this Ordinance, are hereby repealed to the
extent of the conflict, but all other provisions of the ordinances of the City whether codified or
uncodified, which are not in conflict with the provisions of this Ordinance, shall remain in full
force and effect.

SECTION 5. That this Ordinance shall become effective immediately upon its passage.

Discuss and consider approving a resolution authorizing the City Manager to execute a Construction Services
Contract in the amount of $210,880.80 with URETEC USA, Inc. for the Avondale Court and Kennoway Drainage
Improvement Projects. (Hartline)
Suggested Action:
Background:
City Council approved funding for the Tribute Residential Streets Drainage Improvement Project in the
2021/2022 CIP budget. Engineering staff received a complaint from residents on both Avondale Court and
Kennoway indicating that large areas of standing water remain in-place on the roadway in front of their homes
after rain events and the areas don't drain properly. City staff visited the sites and confirmed that large water
ponding areas were located on both of these streets that need to be repaired (see attached photos). The two
roadways are part of the larger roadway drainage improvements project that will address pavement settlement
areas in the Tribute subdivisions. The city has teamed with the Tribute Homeowners Association to address
these areas and half of this project cost will be reimbursed by the Tribute HOA upon completion of the work by
the City.
To attempt to save the street and avoid major reconstruction costs, City Staff met with URETEK USA, Inc.
(URETEK) to determine if their firm could lift these areas back into place and restore adequate street drainage.
URETEK reviewed the areas and indicated that they could lift the areas back into place. URETEK recently
performed similar lifting work on Alta Oaks Lane for the city.
City staff received a proposal from URETEK USA, Inc., a BuyBoard Purchasing Cooperative vendor to lift the
settled areas of these streets. The work includes all of the necessary materials and equipment needed to
complete the drainage improvements necessary at these locations. The proposal is for soil densification to
strengthen base and sub-base soils under the concrete pavement by furnishing and injecting URETEK 486
STAR polymer polyurethane material into the foundation soils beneath the pavement through holes and/or
injection tubes. URETEK will drill out the top 2” of grout injection holes and fill with a non-shrink cementitious
grout and will provide a two-year unconditional warranty against settlement of more than 1/2” of the injected
areas.
Recommendation:
URETEK USA recently performed work on Alta Oaks Lane and city staff was very satisfied with the work
completed. URETEK lifted the street over six inches in some areas during the project. City staff also checked
the references for this firm and received positive feedback from both the City of Garland and North Gate
Constructors and recommends approval of the contract with this company. With approval, the project is

RESOLUTION NO. 2021 - ________
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, AUTHORIZING THE CITY MANAGER TO
EXECUTE A CONSTRUCTION SERVICES CONTRACT BETWEEN THE
CITY OF THE COLONY AND URETEK USA, INC., FOR THE
AVONDALE COURT AND KENNOWAY DRAINAGE IMPROVEMENTS
PROJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council has determined that it is in the best interest of the citizens
to award a bid to URETEK USA, INC., for the Avondale Court and Kennoway Drainage
Improvements Project; and
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS, THAT:
Section 1.That the City Manager of the City of The Colony, Texas is hereby awards a bid to
URETEK USA, INC., in the amount of $210,880.80 for such work.
Section 2. That the City Manager or his designee is authorized to issue the appropriate
purchase order(s) in accordance with the bid award.
Section 3.This resolution shall take effect immediately from and after its adoption and it
is so resolved.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, THIS THE 16th DAY OF NOVEMBER 2021.
