Notice is hereby given of a REGULAR SESSION of the CITY COUNCIL of the City of The Colony,
Texas to be held at 6:30 PM on TUESDAY, APRIL 20, 2021 at CITY HALL and via VIDEO
CONFERENCE, 6800 MAIN ST., THE COLONY, TX, at which time the following items will be
addressed:

This portion of the meeting is to allow up to five (5) minutes per speaker with a maximum of
thirty (30) minutes for items not posted on the current agenda. The council may not discuss these
items, but may respond with factual data or policy information, or place the item on a future
agenda. Those wishing to speak shall submit a Request Form to the City Secretary.
3 WORK SESSION
The Work Session is for the purpose of exchanging information regarding public business or
policy. No action is taken on Work Session items. Citizen input will not be heard during this
portion of the agenda.

5.2 Conduct a public hearing, discuss and consider an ordinance regarding a zoning change from Planned
Development 20 (PD-20) to Planned Development 28 (PD-28) aka "Camey Place," to establish and
provide single-family development standards on an approximately 14.306 acre tract of land out of the
W. Bridges Survey, Abstract No. 112, The A. Robertson Survey, Abstract No. 405, The B.B.B. &
C.R.R. Survey, Abstract No. 174, and the B.B.B. & C.R.R. Survey, Abstract No. 172 City of The
Colony, Denton County, Texas. The subject site is located at the northeast intersection of South Colony

5.3 Discuss and consider an ordinance amending the Code of Ordinances by amending Chapter 6, Article
XI, entitled "Signs", by amending Section 6-253, entitled "Definitions", by amending the definition of
"Billboard". (Williams)
6 EXECUTIVE SESSION
6.1 A. Council shall convene into a closed executive session pursuant to Section 551.071 of the Texas
Government Code to seek legal advice from the city attorney and Section 551.087 of the Texas
Government Code to deliberate commercial or financial information the City has received from a
business prospect, and to deliberate the offer of a financial or other incentive to a business prospect –
Nebraska Furniture Mart - LMG Ventures, LLC, and TXFM, Inc.
B. Council shall convene into a closed executive session pursuant to Section 551.071 of the Texas
Government Code regarding contemplated litigation, including commencement of Chapter 54 of the
Texas Local Government Code cause of action, concerning 7413 Water’s Edge Court.
C. Council shall convene into a closed executive session pursuant to Section 551.087 of the Texas
Government Code regarding commercial or financial information the city has received from a business
prospect(s), and to deliberate the offer of a financial or other incentive to a business prospect(s).

EXECUTIVE SESSION NOTICE
Pursuant to the Texas Open Meeting Act, Government Code Chapter 551 one or more of the
above items may be considered in executive session closed to the public, including but not limited
to consultation with attorney pursuant to Texas Government Code Section 551.071 arising out of
the attorney’s ethical duty to advise the city concerning legal issues arising from an agenda item.
Any decision held on such matter will be taken or conducted in open session following the
conclusion of the executive session.

The Regular Session of the City Council of the City of The Colony, Texas, was called to order
at 6:40 p.m. on the 6

Mayor McCourry called the meeting to order at 6:40 p.m.

Pastor Boston White Smith with First United Methodist Church delivered the
invocation.
1.3 Pledge of Allegiance to the United States Flag
The Pledge of Allegiance to the United States Flag was recited.
1.4 Salute to the Texas Flag
Salute to the Texas Flag was recited.
1.5 Proclamation of appreciation for city workers in support of the winter storm of
2021.
Mayor read a proclamation expressing appreciation to city employees, Horizons
Church staff, members, volunteers, and The Colony Next Steps organization for
their rapid and successful response during the February winter storm.
1.6 Items of Community Interest
1.6.1 Receive presentation from Parks and Recreation regarding upcoming events and
activities.

Mayor provided statistics related to COVID-19 for Denton County and The
Colony. He announced that both Texas and the City of The Colony is open for
business. Although masks aren’tmandated by Governor Abbott's emergency order,
Mayor ask that everyone be respectful of an establishments wishes if they require
patrons to wear a mask. Mayor added that vaccinations are now available for
persons over sixteen years of age. Please register online with your county for a
time and location.
2.0 CITIZEN INPUT

3.0 WORK SESSION
3.1 Discuss Public Information Requests Quarterly Report as presented for Council review.
No discussion on this item.
3.2 Continuation of discussion regarding recent utilities cost due to the winter storms.
Assistant City Manager, Tim Miller, stated this item was a continuation from the
last Council meeting. Mr.Miller reported the following updates: due to pipe breaks
there were nine (9) leak adjustment; waiving all late fees during the month of the
storm the city’s arrearage is $41,000; and in regards to COVID response, the City
will not shutoff a residence water or sewer until they are four months behind.
3.3 Discuss City Council 2021 Retreat date and location.
City Manager, Troy Powell, reported that plans are underway for the May 2021
City Council Retreat. Mr. Powell said this year’s retreat would be held in The
Colony.
3.4 Discussion on continuing video conference meetings.
Council is to continue video conference meetings while monitoring updates from
the Legislature.
3.5 Receive a Legislative Session Update.
Mayor Pro Tem Richard Boyer reported on this item.
Members of the Council and the City Attorney provided discussion on this item.

4.5 Consider approving a resolution authorizing the City Manager to execute an
agreement for Construction Manager at Risk services with Steele and Freemen, Inc.
for City of The Colony Firehouse #5 in the amount of $403, 895.00 and 3.75% of
the projects Guaranteed Maximum Price.

4.6 Consider approving a resolution authorizing the City Manager to execute an
Engineering Services Contract in the amount of $ 267,230.00 with Halff
Associates, Inc. to prepare construction plans and specifications for the Phase 11
Residential Street Reconstruction project.

execute a contract with Paddle EZ, LLC for self-service water sports equipment
rentals at Stewart Creek Park.
Recreation Manager, David Swain, presented the proposed resolution to
Council. Joshua Jackson, Account Manager with Paddle EZ, LLC addressed
questions from Council.
Motion to approve- Marks; second by Wade, motion carried with all ayes.
RESOLUTION NO. 2021-025
5.2 Discuss and consider approving a resolution authorizing the City Manager to award
a bid for the annual maintenance and seasonal mowing services of parks, medians,
right of ways and other municipal grounds in the amount of $239,140 to SLM
Landscape and Maintenance to be funded from the Parks Fund, Aquatics Fund,
Lake Parks Fund and Community Development Corporation Fund.
Parks Manager, Jackie Kopsa, presented the proposed resolution to Council.

5.3 Discuss and consider approving a resolution authorizing the City Manager to
execute the supplemental allocation for the LPGA Community event.

RESOLUTION NO. 2021-027
5.4 Discuss and consider approving a resolution authorizing the City Manager to
approve a grant in the amount $56,362.00 for the City’s local share portion in a
request for a State of Texas Events Trust Fund Grant. The State of Texas will match
the local share by 6.25:1 ratio.

Suggested Action:
Local Government Code requires 45 days notice in the paper of record before debt issuances. This bond will
not exceed $9.1 million to provide for 2020-21 approved CIP assets and projects.

RESOLUTION NO. 2021 - ______
A RESOLUTION OF THE CITY OF THE COLONY, TEXAS
APPROVING AND AUTHORIZING PUBLICATION OF
NOTICE OF INTENTION TO ISSUE CERTIFICATES OF
OBLIGATION.
WHEREAS, the City Council of the City of The Colony, Texas (the “City”), has
determined that certificates of obligation should be issued under and pursuant to the provisions of
Texas Local Government Code, Subchapter C of Chapter 271, as amended, for the purpose of
paying contractual obligations to be incurred for (i) constructing, improving and renovating streets,
alleys, culverts and bridges, including drainage and erosion control, landscaping, screening walls,
curbs, gutters, sidewalks, lighting, signage and traffic signalization incidental thereto and the
acquisition of land and rights-of-way therefor, (ii) constructing, improving and equipping the
City’s waterworks and sewer system and the acquisition of rights-of-way therefor, (iii)
constructing drainage improvements and the acquisition of equipment and rights-of-way therefor,
(iv) renovating, improving and equipping existing municipal buildings and (v) professional
services rendered in connection therewith; and
WHEREAS, prior to the issuance of such certificates, the City Council is required to
publish notice of its intention to issue the same in a newspaper of general circulation in the City,
said notice stating (i) the time and place the City Council tentatively proposes to pass the ordinance
authorizing the issuance of the certificates, (ii) the maximum amount proposed to be issued,
(iii) the purposes for which the certificates are to be issued and (iv) the manner in which the City
Council proposes to pay the certificates;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS:
SECTION 1: That the City Secretary is hereby authorized and directed to cause notice to
be published of the City Council’s intention to issue certificates of obligation, in one or more
series, in the principal amount not to exceed NINE MILLION TWO HUNDRED FIFTY
THOUSAND DOLLARS ($9,250,000) for the purpose of paying contractual obligations to be
incurred for (i) constructing, improving and renovating streets, alleys, culverts and bridges,
including drainage and erosion control, landscaping, screening walls, curbs, gutters, sidewalks,
lighting, signage and traffic signalization incidental thereto and the acquisition of land and rights-
of-way therefor, (ii) constructing, improving and equipping the City’s waterworks and sewer
system and the acquisition of rights-of-way therefor, (iii) constructing drainage improvements and
the acquisition of equipment and rights-of-way therefor, (iv) renovating, improving and equipping
existing municipal buildings and (v) professional services rendered in connection therewith; such
certificates to be payable from ad valorem taxes and a limited pledge of the surplus net revenues
of the City’s waterworks and sewer system. The notice hereby approved and authorized to be
published shall read substantially in the form and content of Exhibit A hereto attached and
incorporated herein by reference as a part of this resolution for all purposes.

SECTION 2: That the City Secretary shall cause the notice described above to be
(i) published in a newspaper of general circulation in the City, once a week for two consecutive
weeks, the date of the first publication to be at least forty-six (46) days prior to the date stated
therein for the passage of the ordinance authorizing the issuance of the Certificates and (ii) posted
continuously on the City’s website for at least forty-five (45) days before the date stated therein
for the passage of the ordinance authorizing the issuance of the Certificates.

NOTICE OF INTENTION TO ISSUE
CITY OF THE COLONY, TEXAS
CERTIFICATES OF OBLIGATION
TAKE NOTICE that the City Council of the City of The Colony, Texas, shall convene at
6:30 p.m. on June 15, 2021, at its regular meeting place in City Hall located at 6800 Main Street,
The Colony, Texas, and, during such meeting, the City Council will consider the passage of an
ordinance authorizing the issuance of certificates of obligation, in one or more series, in an amount
not to exceed NINE MILLION TWO HUNDRED FIFTY THOUSAND DOLLARS ($9,250,000) for
the purpose of paying contractual obligations to be incurred for (i) constructing, improving and
renovating streets, alleys, culverts and bridges, including drainage and erosion control,
landscaping, screening walls, curbs, gutters, sidewalks, lighting, signage and traffic signalization
incidental thereto and the acquisition of land and rights-of-way therefor, (ii) constructing,
improving and equipping the City’s waterworks and sewer system and the acquisition of rights-of-
way therefor, (iii) constructing drainage improvements and the acquisition of equipment and
rights-of-way therefor, (iv) renovating, improving and equipping existing municipal buildings and
(v) professional services rendered in connection therewith, such certificates to be payable from
ad valorem taxes and a limited pledge of the surplus net revenues of the City’s waterworks and
sewer system. In accordance with Texas Local Government Code Section 271.049, (i) the current
principal amount of all of the City’s outstanding public securities secured by and payable from ad
valorem taxes is $116,380,000; (ii) the current combined principal and interest required to pay all
of the City’s outstanding public securities secured by and payable from ad valorem taxes on time
and in full is $149,696,553.55; (iii) the estimated combined principal and interest required to pay
the certificates of obligation to be authorized on time and in full is $12,900,000; (iv) the maximum
interest rate for the certificates may not exceed the maximum legal interest rate; and (v) the
maximum maturity date of the certificates to be authorized is August 15, 2041. The certificates
are to be issued, and this notice is given, under and pursuant to the provisions of Texas Local
Government Code, Subchapter C of Chapter 271, as amended.

Suggested Action:
Summary of Request: Consider approval of a resolution authorizing the City Manager to sign a Construction
Services Contract in the amount of $2,071,434.00 with Quality Excavation, Ltd. for the Eastvale Asphalt Street
Reconstruction Phase 2 Project.
Background:
City Council approved funding for the construction of the Eastvale Asphalt Street Reconstruction Phase 2
Project in the 2021 budget.
The scope of work consists of the reconstruction of eight (8) asphalt streets in the Eastvale subdivision and the
construction of an asphalt parking lot at 7605 West Shore Drive that consists of ten (10) parking spaces for the
future West Shore Park. The streets to be reconstructed are listed below and shown on the attached
construction phasing plan.

8.West Shore Drive Cul-De-Sac
The scope of work includes mobilization, general site preparation, traffic control, full depth asphalt street
replacement including 6-inch thick flex base subgrade, 4-inch Type B asphalt, 2-inch Type D asphalt, and utility
adjustments where required. Additionally, the project includes water and sanitary sewer service line installations
for any undeveloped lots that don’t currently have utility services. No drainage work will be performed during
this construction project; only subgrade repairs and asphalt resurfacing are included in this construction project.
This project was advertised for bid and the bids were opened on March 23, 2021. The low bidder was Quality
Excavation, Ltd. at a cost of $2,071,434.00. Halff Associates received positive feedback from the County of
Denton, City of Richardson, Teague Nail and Perkins and Birkhoff, Hendricks and Carter and recommends
approval of the contract with this company. The Engineering Recommendation letter is attached for review.

Recommendation:
Staff recommends approval of a Construction Services Contract for the Eastvale Asphalt Street Reconstruction
Phase 2 Project with Quality Excavation, Ltd. With approval, the project is anticipated to start construction in
May 2021 with an estimated completion in December 2021.
Suggested motion:
I move to recommend approval of a resolution authorizing the City Manager to sign a Construction Services
Contract in the amount of $2,071,434.00 with Quality Excavation, Ltd. for the Eastvale Asphalt Street
Reconstruction Phase 2 Project.

Dear Mr. Hartline:
Bids were opened on the above-referenced project on Tuesday, March 23, 2021, at the City of The
Colony. Three (3) bids were received, and they ranged from a high bid of $2,540,208.07 to a low
bid of $2,071,434.00. Quality Excavation, Ltd. was the low bidder. To verify Quality Excavation s
qualifications, we have contacted the County of Denton, Teague Nall and Perkins, the City of
Richardson, and Birkhoff, Henricks and Carter who all have awarded and worked with Quality
Excavation on similar projects. Additionally, Quality has successfully completed several projects
for the City of The Colony within the last few years.
In a conversation with Mr. Robert White an Engineer with the County of Denton concerning
performance on their Canyon Oaks asphalt paving construction project, Mr.
White stated that Quality did an outstanding job on the project. He stated that their workmanship
on the asphalt pavement was excellent and left them with no complaints. Mr. White also elaborated
on their ability to resolve issues and concerns with great conduct and in a swift manner. He stated
they worked well with residents and city inspectors and always conducted interactions with great
professionalism. In terms of scheduling and deadlines, he stated all deadlines were met and work
was completed in in a timely manner even with a fast-tracked schedule. In the end, Mr. White
stated he looks forward to working with Quality Excavation again.
We spoke with Jeff Sears an Engineer from Teague Nall and Perkins, Inc. concerning
on their Pruitt Road asphalt paving project. Which consisted of full depth asphalt paving, bar
ditches, and storm drain. Mr. Sears stated that Quality s paving performance was some of the best
work he has seen. Stating that there was no pavement cracking and no issues with bar ditch
maintenance, or storm drain installation. Mr. Sears stated that there was no outstanding problems
or issues that arose during the project and deadlines were met. Mr. Sears stated there were a few
change orders, however they were standard practice because additional work was added. Finally,
Mr. Sears stated that Quality Excavation was always able to work with the Residents, Business
Owners, and City Inspectors in a professional manner.

We also spoke with Michael Grove working with the City of Richardson with regards to the
various projects Quality Excavation has completed for the City. Mr. Grove stated that Quality was
able to complete all the work with acceptable approval. In our conversation, Mr. Grove also stated
that Quality was consistent on meeting project deadlines and expectations. Finally, he mentioned
that if any issues or problems arose during construction that Quality took responsibility and would
correct the issues at no additional cost.
Finally, we spoke with Justin Ivey an Engineer working with Birkhoff, Henricks and Carter with
regards to their Ridgeway Drive Roadway and Water Line Replacement project. Mr. Ivey stated
that this project consisted of asphalt pavement repair and placement of a new twelve-inch water
line. Overall, Mr. Ivey stated that the work was accepted and approved by the City and that the
minor issues that arose were at no fault to the contractor and due to pre-existing site conditions.
Mr. Ivey stated that Quality was always able to meet the project deadlines and remained on
schedule throughout, while always working with Residents and City Inspectors in a professional
and cooperative manner. In conclusion, Mr. Ivey stated he also looks forward to working with
Quality Excavation in the future and that their work speaks for itself.
Section 252.043 in the Local Government Code states if competitive sealed bids are received, the
contract must be awarded to the lowest responsible bidder or to the bidder who provides goods or
services at the best value for the municipality. After considering the purchase price, reputation of
past work experience with the City of
The Colony, Halff Associates has determined that Quality Excavation Ltd. is the lowest
responsible bidder.

WHEREAS, the City Council has determined that it is in the best interest of the citizens
to award a bid to Quality Excavation, Ltd., for the Eastvale Asphalt Street Reconstruction Phase 2
Project; and
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS, THAT:
Section 1.That the City Manager of the City of The Colony, Texas is hereby awards a bid to

PROPOSED REQUEST
The applicant requests a zoning change for approximately 14.306 acres from Planned
Development 20 (PD-20) to Planned Development 28 (PD-28). The applicant proposes to
provide single-family development standards and establish an 80-lot single-family home
development.
PRIOR ACTION/REVIEW (Council, Boards, Commissions)
On January 12, 2021 The Planning and Zoning Commission voted (7-0) to recommend approval
of the zoning change request from Planned Development 20 (PD -20) to Planned Development 28
(PD-28).
An accompanying Engineering Manual Variance to Table II -7-C Minimum Distance from
Driveway to Intersection was considered by the Planning and Zoning commission on January 12,
2020. This variance facilitated a design where the proposed Memorial Drive entrance was located
to the furthest east extent within the site. The Planning and Zonin g Commission voted (7-0) to
recommend approval of the Engineering Manual Variance to the City Council. The Engineering
Manual Variance was subsequently considered by the City Council on February 2, 2021; the City
Council voted (7-0) to deny the variance request discussing concern of the proposed Memorial
Drive entrance to an existing entrance on the adjacent LISD Aquatic Center site.

Denial of the variance necessitated a re -evaluation of the proposed site layout of the Camey Place
development, therefore the City Council voted (7-0) to remand the zoning request back to the
Planning and Zoning Commission for further study.
After consideration of the concerns discussed at the February 2, 2021 City Council meeting, the
applicant revised the development layout . The proposed Memorial Drive entrance was shifted
further to the west and addresses both the Engineering Design Manual and Fire Code standards;
no variance or deviation from code is necessary to accommodate this entrance location.
On April 13, 2021 The Planning and Zoning Commission voted (7-0) to recommend approval of
the remanded zoning change request from Planned Development (PD -20) to Planned
Development 28 (PD-28)
DEVELOPMENT REVIEW COMMITTEE (DRC) REVIEW
The Development Review Committee recommends approval of the zoning change request from
Planned Development 20 (PD-20) to Planned Development 28 (PD-28).

Staff Analysis
Land Use Analysis
The subject site is within th e existing 24.813 acres of the Planned Development 20 (PD -20)
zoning district. Planned Development 20 is developed with a 10.507 acre Lewisville Independent
School District (LISD) Aquatic Center. The remaining 14.306 acres was contemplated as a LISD
middle school site. In February of 2019, the LISD board of trustees approved a resolution
designating the subject property as “surplus” and authorized the district staff to take action in
regard to the sale of the properties. The sale of the property indicated that no future educational
purposes are anticipated on the site and is no longer necessary for district operations. LISD has
submitted a letter stating, the undeveloped 14.306 -acre property is not required for the district's
future needs.
The applicants request establishes zoning and development standards for an approximately 14.306
acre single-family development plan containing 80 home sites (trails and a pocket park). The
development will consist of traditional, single-family detached dwelling units with an
approximate density of 5.59 single-family units per acre. The proposed Planned Development 28
is within an area recommended for “Low-Density Residential” development according to the
Future Land Use Map (FLUM) of the City. A “Low-Density Residential” area is primarily
intended for traditional, single -family detached and or attached (duplex) dwelling units . The
proposed development is consistent with the recommendation of the Future Land Use Map.

The proposed single-family development is also consistent with surrounding single -family
residential properties of Planned Development 14 (PD -14). Planned Development 14 (PD -14)
also known as The Legends neighborhood contains a phase of development with nearly identical
development standards.

Camey Place will vary from the adjacent development, with the in corporation of larger minimum
size homes, front-loaded garages, and a reduced rear setback. However these elements are found
within other single-family development in the City [The Tribute and Austin Waters
neighborhoods].

The developer offers architectural standards in the development ordinance and the Covenant,
Controls, and Restrictions (CC&Rs) of the homeowners association (HOA). Within Camey
Place, no houses shall have the same front elevations within five homes of each other on the sam e
side of the street and each home will incorporate a minimum of four (4) from a list of eight (8)
architectural elements. The elements include:
1) Shutters,
2) Dormers,
3) Corbels,
4) Brackets,
5) Brick details,
6) Coach lights,
7) Divided light windows,
8) Exterior specialties such as decorative
adornments and ornamentation.
The developer has indicated that the CC&Rs will require that façade content shall be 90% brick,
natural stone, cast stone, stucco, or cementitious fiberboard in horizontal "lapboard', vertical o r
with a decorative pattern.
Circulation and Access
The proposed plot plan reflects two (2) access points to the development. One access is from
South Colony Boulevard the other from Memorial Drive. The South Colony Boulevard includes
a center median cut provides southbound access from the development. A left-turn lane
accompanying the median cut provides access to Camey Place from southbound South Colony
traffic. The site’s Memorial Drive is a right -in/right-out only access. This entrance provides
primary westbound access, and secondary southbound [left turn] and eastbound access [U -turn] at
the south Colony and Memorial traffic light.
The Memorial Drive entrance is located approximately 140 feet from the adjacent LISD Aquatic
Center entrance. It is anticipated that this proximity will offer adequate visibility and negotiation
time for westbound traffic exiting the Aquatic Center.
The development will provide internal and perimeter pedestrian accesses. Five -foot (5) wide
sidewalks provide pedestrian access throughout the development, and the six -foot (6) wide
Memorial Drive public sidewalk will be upgraded to a ten -foot (10) wide trail.
Buffering, landscaping, and common areas
The homeowners association will develop and maintain a small 3,746 sq uare-foot pocket park
containing trees, shrubs, seating, mail facilities, pet waste facility, and open space. A twenty -foot
(20) landscape buffer will be constructed along Memorial Drive and South Colony Boulevard.
The landscape buffer will include curvilinear plantings of eighteen (18) canopy trees, thirty-seven
(37) ornamental trees, as well as thirty-four (34) shrubs and ornamental grasses. The selection and
orientation of the plantings are similar to surrounding buffers.
Adjacent to the landscape buffer, the homeowners association will construct and maintain a six -
foot (6) tall masonry screen wall along Memorial Drive and South Colony Boulevard. The
existing sidewalk along South Colony shall remain. The HOA will also build and maintain a
double-sided six-foot (6) tall wooden fence along the common property line with the LISD
Aquatic Center and alley facing The Legends community. Wooden fences along alleys are
consistent with surrounding development.

Notification and Response
The Zoning Ordinance requires newspaper notification a minimum of fifteen (15) days prior to
the City Council meeting for a zoning change. Notice for this Public Hearing was published in
The Dallas Morning News on January 15, 2021. In addition, the Zoning Ordinance also requires
notification of property owners located within 200 feet of the subject property a minimum of
fifteen (15) days prior to the public hearing. Notices were mailed on January 14, 2021 to fifty-
four (54) property owners. No comments either for or against the zoning change request were
received from individual homeowners as of the printing of this packet. Staff has received letters
of support from the Lewisville Independent School District and the Legends Home Owners
Association.
Development Review Committee Review
The Development Review Committee recommends approval of the zoning change request from
Planned Development 20 (PD-20) to Planned Development 28 (PD-28).

1. A homeowner’s association shall be established prior to issuance of residential
building permits. The property owner’s association will be responsible for the
improvement and maintenance of all private common areas and/or common
facilities contained within the area of the Development Plan.

NARRATIVE LETTER
Camey Place is a proposed single-family detached planned development
neighborhood located on a 14.3-acre infill parcel at the northeast corner of South
Colony Blvd and Memorial Drive. The neighborhood will consist of eighty single-
family detached homes situated on forty-five-foot-wide lots. Arcadia Realty
purchased the subject property after being selected by the Lewisville Independent
School District through an open competitive bid process.
One of the major contributing factors to Arcadia Realty’s selection was that
we are proposing a single family detached neighborhood as opposed to a
commercial or multifamily development. Additionally the proposed Camey Place
neighborhood conforms to the future land use plan designated for the subject
property of low-density single family residential. Subsequent to purchasing the
property we have worked closely with both the engineering and planning staff while
engaging with both the Lewisville Independent School District and The Legends
Home Owners Association to gain their support for Camey Place.
The target buyer demographics for Camey Place are envisioned to be
younger professional dual income first time move up homebuyers who will take
advantage of the convenient split commute access to Sam Rayburn Tollway, and
empty nesters who already live nearby who are looking to downsize. Home sizes
will range from 1,800-3,500 square feet with the lower half of the range comprising
of the single-story plans and the upper range consisting of two-story plans. We do
anticipate that the average home square footage will fall within the 2,600-3,000
square foot range.
Home prices are projected to range from the upper $300’s to the upper
$400’s. Camey Place will be complimentary to our adjacent residential neighbors,
namely The Legends and Village at the Point, which are comprised of mainly larger
3,500 – 4,000 square foot single-family detached homes and townhomes
respectively. Camey Place is positioned as an on-ramp and off-ramp for homebuyers
looking to potentially move up from the Village at the Point townhomes or downsize
from the larger single-family homes in The Legends neighborhood. Camey Place will
provide an option for current homeowners in the surrounding area who want to
right-size their home without leaving the community they love.
The Camey Place neighborhood will have a professionally managed
Homeowners Association that will enforce the covenants, conditions, and
restrictions as well as administer the maintenance of landscaping and perimeter
screening. The CC&R’s for the neighborhood will enforce the requirement that
facades of homes will be comprised of ninety percent brick, stone, masonry, or
cementitious material. Additionally, the Camey Place HOA will also require that one
shade tree is planted and maintained in the front yard of each home. These trees will
be chosen from a list of approved tree types stipulated in the governing documents.
Through stakeholder input and careful planning alongside the city planning
and engineering staffs, we have designed a neighborhood that will seamlessly fold
into the fabric of the existing community and backfill two much-needed housing
types.

and The B.B.B. & C.R.R. Survey, Abstract No.172, City of the Colony Texas, and more particularly
described in in Exhibit A of this Ordinance, which is attached hereto and is incorporated herein for
all purposes, be amended from Planned Development 20 (PD-20) to Planned Development-28 (PD-
28) establishing a single-family development plan and development standards in accordance with
Planned Development 28 (PD-28), Ordinance No. 2021-xxxx; and
WHEREAS,the Planning and Zoning Commission of the City of The Colony, Texas, and
the City Council of the City of The Colony, Texas, in compliance with the laws of the State of Texas,
have given the requisite notices by publication and otherwise, and have held due hearings and afforded
a full and fair hearing to all property owners generally and to all persons interested, and the City
Council of the City of The Colony, Texas, is of the opinion and finds that said changes should be
granted and that the Comprehensive Zoning Ordinance should be amended; and
WHEREAS,this change of zoning is in accordance with the adopted Comprehensive Plan
of the City of The Colony, Texas, as amended.

SECTION 1. FINDINGS INCORPORATED
That the findings set forth above are incorporated into the body of this Ordinance as if fully set forth
herein.
SECTION 2. REZONE OF PROPERTY
That the Comprehensive Zoning Ordinance and Map of the City of The Colony, Texas, duly
passed by the governing body of the City of The Colony, Texas, as heretofore amended, be and
the same is hereby amended to grant a change in zoning on an approximately 14.306 acre tract of
land out of the W. Bridges Survey, Abstract No. 112, The A. Robertson Survey, Abstract No. 112,
The A. Robertson Survey, Abstract No. 405, The B.B.B. & C.R.R. Survey, Abstract No.174, and The
B.B.B. & C.R.R. Survey, Abstract No.172, City of the Colony Texas, and more particularly described
in in ExhibitA of this Ordinance, which is attached hereto and is incorporated herein for all purposes,
be changed from Planned Development 20 (PD-20) to Planned Development-28 (PD-28) establishing
a single-family development plan and development standards, providing for screening walls and
landscape in accordance with Planned Development 28 (PD-28)Exhibits B through Exhibit J,
Ordinance No. 2021-xxxx.
SECTION 3. ENROLLMENT OF ORDINANCE
The City Secretary is directed to engross and enroll this Ordinance in the Code of Ordinances of
the City of The Colony and to reflect this change of zoning on the official zoning map of the City
of The Colony, Texas.
SECTION 4. PENALTY CLAUSE
Any person, firm, or corporation violating any of the provisions or terms of this Ordinance shall
be guilty of a misdemeanor and upon conviction, shall be fined a sum not to exceed $2,000.00 for
each offense, and each and every violation or day such violation shall continue or exist, shall be
deemed a separate offense.
SECTION 5. SEVERABILITY CLAUSE
It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences,
paragraphs and sections of this Ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this Ordinance shall be declared unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of this Ordinance, since the same
would have been enacted by the City Council without the incorporation of this Ordinance of any
such unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 6. EFFECTIVE DATE
This Ordinance shall become effective immediately upon its passage and publication as required
by law.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, AMENDING THE CODE OF ORDINANCES BY

WHEREAS,Chapter 216 of the Texas Local Government Code authorizes the City of
The Colony, Texas, to regulate signs within the City of The Colony, Texas; and
WHEREAS,the Sign Board of Appeals of the City of The Colony, Texas, recommended
approval of said changes to Chapter 6, Article XI, entitled “Signs” as reflected in this Ordinance;
and
WHEREAS,the City Council of the City of The Colony, Texas, is of the opinion and
finds that said changes to Chapter 6, Article XI, entitled “Signs” as reflected in this Ordinance
should be granted, and that the Code of Ordinances should be amended.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:
SECTION 1.That the findings set forth above are incorporated into the body of this
Ordinance as if fully set forth herein.
SECTION 2.That the Code of Ordinances of the City of The Colony, Texas be, and the
same is, hereby amended by amending Chapter 6, Article XI, Section 6-253, definition of
“Billboard” which shall read as follows:
“Sec. 6-263. Definitions.
. . .
Billboard. A large freestanding sign, generally supported by a metal frame, and generally
consisting of two (2) parallel sign faces which are oriented in opposite directions, used for the
display of posters, printed, digital, or painted advertisements. The term “billboard” excludes other
signs further defined in this Article.”
SECTION 3.If any section, article paragraph, sentence, clause, phrase or word in this
Ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional
by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining
portions of this Ordinance; and the City Council hereby declares it would have passed such

remaining portions of this Ordinance despite such invalidity, which remaining portions shall
remain in full force and effect.
SECTION 4.That any person, firm or corporation violating a provision of this Ordinance,
upon conviction, is guilty of a misdemeanor and shall be subject to a fine in the sum not to exceed
Two Thousand Dollars ($2,000.00) for each offense and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.
SECTION 5. This Ordinance shall become effective from and after its date of passage in
accordance with law.
