HomeMy WebLinkAbout11/22/2016 P&ZMINUTES CITY OF THE COLONY PLANNING AND ZONING COMMISSION NOVEMBER 22, 2016 After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into Regular Session which was held on Tuesday, November 22, 2016 at 6:30 PM in the City Council Chambers located in City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: Board Members Present: Detrick DeBurr, Vice Chairman, Shannon Hebb, Brian Buffington, Janece Pool and Shawn Rockenbaugh. Board Members Absent: Karen Hames, Chairman and Cesar Molina Jr. City Council Liaison: David Terre, City Council Place 4 Staff Present: Gordon Scruggs, P.E. Director of Engineering and Development Services, Surupa Sen, AICP, Senior Planner, and Ed Voss, City Attorney. 1.0 J CALL REGULAR SESSION TO ORDER Chairman DeBurr called the meeting to order at 6:30 p.m. 1.1 1 CITIZEN INPUT No citizen came forward for input. 2.0 CONSENT AGENDA 2.1 Consider approval of the minutes of the October 25, 2016 Regular Session. Chairman DeBurr read the Consent Agenda item into the record. Commissioner Hebb moved to approve Item 2.1 Commissioner Pool seconded the motion. Motion carried (5-0). 3.0 _ 3.1 PUBLIC HEARING ITEMS SI14-0018 — Automobile Rental land use and Special Events definition Conduct a public hearing, discuss and consider making a recommendation to City Council on amendments to Appendix A, Zoning Ordinance, Section 10-100, Schedule of Uses by District, by adding "Automobile Rental" land use, Section 10-300, Definitions and Explanations Applicable to the Use Schedule, Section 25, Definitions; and Section IOD -700 "Temporary Use Definitions and Section IOD -2800, Special Events. Chairman DeBurr read the public hearing item 3.1 into record. Ms. Sen presented the staff report. Commissioner Rockenbaugh asked compared to what was presented to the Commission before, the changes in recommendation are additions of the other commercial zoning districts for this land use. Ms. Sen answered that originally staff had suggested including this land use as "permitted by right" in only Light Commercial (LC), High Commercial (HC) and Industrial (I) zoning district. City of The Colony :November 22, 2016 Planning and `boning Commission :Meeting Minutes Page 2 of 4 Now with Council recommendation staff is proposing to add the Automobile Rental land use to the zoning districts of Shopping Center (SC), General Retail (GR), Business Park (BP), Light Commercial (I.C), high Commercial (HC) and Industrial (I) zoning districts and with a SUP. Commissioner Hebb asked why electric cars haven't been included in the definition. Chairman DeBurr opened and closed the public hearing at 6:35 p.m. with no one wishing to speak. Commissioner Hebb moved to approve Item 3.1 Commissioner Buffington seconded the motion. Motion carried (5-0). 3.2 PDA 16-0003, Amendment to Planned Development District No. 25 Conduct a public hearing, discuss and consider making a recommendation to City Council on request for amendments to Planned Development 25 (Ordinance :No 2011- 1927), adding Sub Section D to Section III: Off -Street Parking and Loading Regulations and amending Table 1. Chairman DeBurr read the public hearing item 3.2 into record. Ms. Sen presented the staff report. Commissioner Hebb askes what type of alternate pavement is being requested by the applicant. — -- Mr. Scruggs stated a crushed granite pavement is being requested. Ile also stated that there is one location currently within Tribute at the golf course where this type of alternate pavement was used. He stated that the alternate pavement had to match equivalent strength of concrete and ended up costing more than a concrete pavement. Commissioner Pool asked for clarification in terms of where within Tribute this alternate pavement was used. Mr. Scruggs responded that at the Old American golf course this pavement was utilized. Commissioner Pool asked if the crushed granite paving used on trail -heads are the same type of pavement that is being requested here. Mr. Scruggs stated that the trail -heads do have crushed granite and they are designed to withhold occasional smaller fire safety vehicle access, maintenance vehicle and not for regular vehicular access. Commission Hebb mentioned that he is concerned as how this alternate pavement will meet equivalent strength of concrete. Mr. Scruggs stated that he doesn't remember exactly what design was used, but they had to install a honeycomb system, plan drainage all around, and also had a geo-textile underneath the granite system. Commissioner Ilebb asked whether there would be future transit stop along the railroad. He also — - - mentioned that the PD 25 land use table doesn't mention transit. Mr. Scruggs stated that the City and the developer will keep that in mind for future. Commissioner Hebb asked if the parking requirement is being reduced or increased. City of The Colony November 22, 2016 Planning and Zoning Commission Meeting Minutes Page 3 of 4 Ms. Sen stated that the parking count of one per four seats is a standard requirement where assembly or entertainment theaters are involved. Chairman DeBurr opened and closed the public hearing at 6:49 p.m. with no one wishing to speak. Commissioner Hebb moved to approve Item 3.2 Commissioner Buffington seconded the motion. Motion carried (5-0). 14.0 DISCUSSION ITEMS , 4.1 SP16-0014 Truck Yard and Quincy's Chicken Shack Development Plan Discuss and consider making a recommendation to City Council on a request for Development Plan for Truck Yard and Quincy's Chicken Shack restaurants, located on part of Lot 1, Block 11, Grandscape Addition Phase II, near Destination Drive. Chairman DeBurr read the discussion item 4.1 into record. Ms. Sen presented the staff report. Commissioner Buffington asked what the distance is from the stage to the railroad or the homes and how the noise generated will affect the homes across the railroad. Ile reminded the discussion that the Commission had when Lava Cantina was presented in terms of the potential noise generated by that venue. Ms. Sen answered that she did not know the exact distance; it might be around 2 miles. This stage is much smaller compared to the Lava Cantina. So acoustically the noise generated will be much less and the usage is very sporadic for small occasional special events. So the impact will not be similar to Lava Cantina. The railroad and existing tree buffer can also negate the noise level in this area. Ms. Sen requested applicant Justin Gilmore if he would add something to this discussion. Mr. Gilmore with Level 5 Design group approached the Commission and stated that generally noise generated by this stage will be less than 85 DB whereas the train tracks with the freight train generates around 120 DB. Ile also added that the outdoor seating area and the stage is at a lower level surrounded by the buildings and parking. This level different will also aid in reducing the noise escaping the site. Commissioner Buffington asked how the food trucks will be permitted and will there be concrete pavement where these food trucks will stay. Ms. Sen stated that the food trucks will be on a concrete pad. They will be permitted through the City like any mobile food vendor. They will have an annual permit reviewed and approved by the Health Inspectors. Commissioner Hebb asked if there are restrooms available for the food trucks. Mr. Gilmore stated that currently the plan is to have community restrooms at the two restaurants. Commissioner Hebb stated that he is concerned for handicap access. He asked if there will be a convenient access for people using wheel chairs or do they have to go through the sidewalk on the access drive and come down the main entrance to get to the Truck Yard. Mr. Gilmore stated that both buildings have split level access and they can be accessed from the roadway directly through the upper floor levels. City of The Colony November 22, 2016 Planning and "Zoning Commission Meeting Minutes Page 4 of 4 Commissioner Hebb stated that there are handicap parking spaces near the Quincy's but to access the Truck Yard some will have to go a long way for accessibility. Mr. Gilmore stated that they can add few handicap spaces on the parking lot closer to Truck Yard and have better access. Commissioner Buffington moved to approve Item 4.1 Commissioner Hebb seconded the motion. :Motion carried (5-0) with Commissioner Hebb voting against.
