HomeMy WebLinkAbout04/07/2016 CDCApril 7, 2016 MINUTES OF THE REGULAR SESSION OF THE COMMUNITY DEVELOPMENT CORPORATION APRIL 7' 2016 The Special Session of The Community Development Corporation of the City of The Colony, Texas, was called to order at 6:33 p.m. on the 7t day of April 2016, at City Ball, 6800 Main Street, The Colony, Texas, with the following roll call: Stephen Sohn President Present Pam Nelson - Staff Kathy Braby Vice President Present Eve Morgan - Staff Donna Cole Secretary Absent Kathy Neal - Staff Don Beckel Treasurer Present Jackie Kopsa - Staff Lisa Leary Member Present Richard Boyer, Council Liaison Dan Mahle Member Present Allen Harris Member Present And with all board members present a quorum was established and the following items were addressed: 1.0 ROUTINE ANNOUNCEMENTS, RECOGNITION'S Call to Order Pledge of Allegiance to the United States Flag Salute to the Texas Flag Announcements of upcoming civic events and activities 1 - Drive in movie at Stewart Creek Park - ` Jurassic World" will be shown at Stewart Creek Park on Friday, April e at 8: 30pm. Kids Chase by the Lake — The Parks & Recreation Dept. and The Colony Roadrunners Club are hosting this annual event at Stewart Creek Park on Saturday, April le at 8: 00a.m. for children age 5-11. Festival of Flight This event is on Saturday, April 30`h at the Prestwick STEMAcademy. There will be kite flying and demonstrations, binding demonstration, paper airplane contest, and at the conclusion of the event the movie "Tangled" will be shown. Citizen Input - None. 2.0 1 CONSENT AGENDA 2.1 Consider acceptance of the CDC financial reports for March 2016. 2.2 Consider approval of minutes of the March 17th Special Session. 2.3 Consider approval of canceling the April 14th regular session CDC Board meeting. Motion to approve the consent agenda - - Mahle; second Braby; motion passes. April 7, 2016 3.0 REGULAR AGENDA ITEMS 3.1 Receive presentation, discuss and gather public input regarding development of an updated Trail and Bike Route :Master Plan — Eve introduced Lenny Hughes from Ilalff Associates. Lenny explained why an update is needed - • Connect to other communities • Provide another source of transportation • Connect to established parks • A lot of new development has occurred • Provide more access to the lake Lenny explained the process he and his associates will use to update the Master Plan - • Idents how the trails will be used - recreation, transportation • Idents the users of the trails • Determine the types of trails • Establish priorities • Conduct an inventory of the current trails and consider what can be done now and in thefuture • Develop standards - design trails that are low maintenance • Demographic analysis - meet with the public to get their input and also have an online questionnaire available for people to complete • Identify funding - • Recognize the challenges that have to be addressed - Main St. widening, potential lake level fluctuations, aging infrastructure, limited right-of-way Citizen Input - Jan Partin, 4548 Highridge Dr., The Colony She uses the shoreline trail and would like to see more water fountains and lighting on the trail and more access to the restaurants. John Daugherty, 5500 Phoenix Dr., The Colony - The Park Loop Trail connects to the Legends trail. There is a section of the trail that runs through the greenbelt that the HOA paid to build, clean up, and rebuilt the trail when Atmos tore it up. They use the trail for bike riding; on the north the trail connects to Slay/Baker Park and then goes to North Colony, but on the south end it stops. There is the potential to connect the land at Hawaiian Falls so you can get to Five Star. They would like to have a connection on the south end. Tim Eorgan, 3833 Acacia Trail, The Colony - Ile is a member of The Colony Road Runners Club. The city has done a great job with the trail. Ile too would like to see more access to the restaurants - Stans & Angelinas - and would like to see the trails interconnected so you can stay on them for longer distances when cycling or running. PJ McGuire, 3804 Red Oak Trail, The Colony - Ile is also a member of The Colony Road Runners. Ile would like to see the trail connect to the Meridian and Lelac, he likes the new trail connection at BB Owen into Frisco, he would like to see a bike route to Rock N Brews as crossing HWY 121 is challenging. He asked if it is possible to put a tarp on the trail when it floods so it doesn't have to be rebuilt, and asked where can he see the plans and budget for the next steps. 2 April 7, 2016 Jonathan Brashear, 6424 Maple Dr., The Colony - He asked if the Main St. extension was going to be separate from the road or a route along the road and Pam replied that it will be separate. He also appreciates the current trail. His main issue at this time is North Colony & Main; though there are separate bike lanes to the west and east of Main, he still has to merge with traffic to comply with state law, so he wants to know if there is a way to mingle the lanes with the current expansion. He would like to see more options to get out of The Colony; he suggested a connection from Dave Cowan Park to Teal & Legacy, as these streets are the most used by cyclists. He would like to see the shoreline trail extended to the north and the south to East Hill Park and asked if more trees could be planted along the shoreline trail to provide more shade from May through September. Greg Tonian, 6500 Stewart Blvd., The Colony -- He is the president of The Colony Road Runners Club; he is on the trail every day and commended the cityfor the trail. He would like to see the shoreline trail extended to Pier 121 and have a connection to Main Street and then up to the Tribute. The biggest problem for cycling is crossing Main Street; a safe route to go east and west is needed. He would like to see a buoyed area off the beach area so it is more obvious to boaters. Indigo Hitt, 4548 Crooked Ridge Dr., The Colony - She likes the Main St. idea with having bike lanes on both sides. It's hard to get around the city, but the trails are good since there is not a bus system. Janette Klein, 5404 North Colony Blvd., The Colony - Access to the lake was a huge reason for her to move from Addison to The Colony. She is an avid road and mountain cyclist and wants to know if there are plans for a dedicated mountain bike trail; she travels to other cities that offer a variety of features. .She drives her car 2 miles - --- to access the trail because it's too dangerous to ride on the road. She thinks that inner connectivity and collaboration with other communities is key for trail development. Anu Rao, 5628 Big River Dr., The Colony - She is a long distance runner and likes the shoreline trail but would like to see water fountains along the trail, better traffic signals to indicate that there are people running and get more share the road signs on the roads. The survey will be available at the Rec. Center and on the city and CDC website through the first week in May. 3.2 Discuss and consider approval of a bid from Wall Enterprises for construction of the dog park - Eve told the board 2 bids were received; the project budget is $380, 000 and $35, 000 in image enhancements were added which makes the project cost $415, 000. After a meeting with Wall Enterprises, the budget was reduced by removing some items from the bid that the city could purchase at a cheaper cost. There is also a possibility that dirt from the construction of the wastewater treatment plant can be used, but it will have to be tested first and we hope to have those test results before the City Council meeting on April 19th. The project cost after the reduction of the construction cost, consultant fees and the items the city is going to purchase is $430,011 resulting in a $15,000 shortfall, but Pam thinks that shortfall can go away if we are able to use the dirt from the wastewater treatment plant and - - there are funds left from other completed projects that can also be used. April 7, 2016 Motion to approve the bid from Wall Enterprises for construction of the dog park - Leary; second - Mahle; motion passes. 3.3 Discuss possible joint work session with City Council regarding the 2016-2017 budget and capital improvement projects - Pam told the board that Council recently had their retreat and they are going to form some committees and they want some CDC Board members to be on them, so that in addition to the budget and capital improvement projects will be discussed at the joint work session. The board is offering to meet with them on April 260', May 2"`, May 9th or May 16th; if May 9" is chosen, the CDC regular May meeting will be rescheduled to May Vh. 3.4 Receive update from staff and discuss the following items: Trees at Lions Club Park -- New trees have been planted by the parking lot, pavilion and playground and irrigation will be installed within the next week. Swings at Ridgepointe Park - The uprights for the impression swing have been installed and the swing will be up next week. Park Loop Trail - Eve told the Board our consultant, Dunkin Sims & Stoffels, has received the survey from RDelta for spot elevations, but it was missing some spot elevations, so it was sent back to them to get them so they could put them on the survey. Our consultant just received the GeoTech report for the bridge location, but Eve has not seen it yet. Roughneck Ultimate Professional Frisbee League - This league is playing their games on the football field at Five Star and that field will be their home field for their games. They are family oriented and draw large crowds to their games. They brought in grandstand bleachers and had a beer garden at their first game at Five Star, and concessions were provided by one of the local youth leagues. They stream the games on their facebook page and their games go from April -- early July. 3.5 Board to request items to be placed on future meeting agendas - Updates on the Trail Master Plan were requested. 4.0 1 EXECUTIVE SESSION 4.1 Board shall convene into a closed executive session pursuant to Section 551.071 of the Texas Government Code to seek legal advice from the city attorney regarding pending or contemplated litigation -- Atlantic Colony Venture 1, LLC and Atlantic Colony Venture II, LLC v. City of The Colony, Texas, The Colony Local Development Corporation, The Colony Economic Development Corporation, and The Colony Community Development Corporation, Cause No. 16-02219-442. The Board convened to executive session at T-50p.m. Executive session was adjourned at 8:35p. m. The Board reconvened to the regular session at 8:36p. in. April 7, 2016 4.2 Action to be taken as a result of the Executive Session regarding pending or contemplated litigation — Atlantic Colony Venture 1, LLC and Atlantic Colony Venture 11, LLC v. City of The Colony, Texas, The Colony Local Development Corporation, The Colony Economic Development Corporation, and The Colony Community Development Corporation, Cause No. 16-02219-442 -- No action was taken. Pursuant to the Texas Open :Meeting Act, Government Code Chapter 551 one or more of the above items may be considered in executive session closed to the public, including but not limited to consultation with attorney pursuant to Texas Government Code Section 551.071 and Section 551.074 arising out of the attorney's ethical duty to advise the city concerning legal issues arising from an agenda item. Any decision held on such matter will be taken or conducted in open session following the conclusion of the executive session.
