HomeMy WebLinkAboutOrdinance No. 2016-2203CITY OF THE COLONY, TEXAS ORDINANCE NO. 201& 7 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, AMENDING PLANNED DEVELOPMENT 11 OR PLANNED DEVELOPMENT ORDINANCE NO. 01, BY AMENDING SECTION 4, ITEM 5, ROOF SLOPE, FROM MIMINUM 12:12 TO 5:12 ROOF SLOPE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF A FINE NOT TO EXCEED TWO THOUSAND DOLLARS (52,000) FOR EACH AND EVERY OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE, WHEREAS, Section 211.006(a) of the Texas Local Government Code ralulres the City of The Colony, Texas, to publish notice of public hearing concerning a ming amendment before the IS" day before the date of the public hearing; and WIIEREAS, Appendix A,Swnon24-101(d)oftbe CodeofOrdhtanmesofNe Cityofne Colony, Tows, provides the following, "A public hearing shall be held by city council before adopting my proposal smma ment, supplement or change. Notice of such hearing shall be given per the publicafion policy of the city, swung the note and place of such hearing, and shall be published animation of 15 days priorro thedate ofthe public he imee' and WHEREAS, the planning and Zoning Commission and the City Council of the City of The Colony, Texas, in compliance with the laws of the State of Texas, and the Code ofCodinaram of the City of The Colony, Texas, have given the rawitisite notices by publication and otherwise, and have held due hearings and afforded a full and fav hearing an all property owners generally and to all persons interested, and the City Council of the City of The Colony, Texas, is of the opinion and finds that said changes should be Started, aM that the Code ofOnGnences should be amended. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. The findings set forth above are inwryomtd into the body of this ONinance w iffully set froth herein. SECTION 2. Section 4, Item 5 shall be amended as follows: 5. Roof Slope: A minimum of 5:12 roof slope shall be provided on each individual structure. SECTION 3. SECTION I. Any person, for, or corporation violating any of the provisions of this Ordinates shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of The Colony, Texas, shall he punished by a fine not to exceed the sum of Two Thousand Dollen ($2,000.00) for each offense. Every day a violation occurs shall constmte a separate oDense. SECTION 6. This Ordinance shall become effective fmm and after iu date of passage in accordance with law.
