HomeMy WebLinkAboutResolution No. 2015-088 CITY OF THE COLONY, TEXAS RESOLUTION NO. 2015- p A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF CONTRACT AMENDMENT NO. 8 BY AND BETWEEN THE CITY OF THE COLONY AND AUSTIN BRIDGE & ROAD, L.P. FOR REVISION AND ADDITION OF ROADSIDE AND OVERHEAD SIGNAGE, AND OTHER ADDITIONAL WORK FOR PHASE 1 OF THE SOUTH COLONY BOULEVARD GRADE SEPARATION AT S.H. 121, INCORPORATED HEREIN AS EXHIBIT "A"; RATIFYING A CONTRACT INCENTIVE FOR EARLY COMPLETION; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT AMENDMENT; PROVIDING AN EFFECTIVE DATE WHEREAS, the City and Contractor have entered into an agreement such that the Consultant is to provide the following services: revision and addition of roadside and overhead signage and other additional work; and WHEREAS, the original Construction Contract authorized an early opening incentive to Contractor in the amount of$506,000.00 if the deadline of March 2, 2015 was met, which was met; and WHEREAS,the City has determined that it is in the best interest of the City to enter into the Contract Amendment No. 8 with AUSTIN BRIDGE & ROAD, L.P. which is attached hereto and incorporated herein by reference as Exhibit "A," under the terms and conditions provided therein, and agrees to fund the early opening incentive; and WHEREAS, with this Contract Amendment the City of The Colony is agreeing to pay the sum not to exceed $319,604.04 for such work as described on Amendment No. 8, plus the early opening incentive of $506,000.00 with funding available through TIRZ No. 1, NCTCOG/RTR, and city right-of-way acquisition. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,TEXAS THAT: Section 1. The Contract Amendment, which is attached and incorporated hereto as Exhibit "A", having been reviewed by the City Council of the City of The Colony, Texas, and found to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all things approved in the amount of$319,604.04; plus the early opening incentive in the amount of $506,000.00 for a total of $825,604.04; the City Manager is hereby authorized to execute the Contract Amendment on behalf of the City of The Colony, Texas. Section 2. Change Order Pricing Documentation 2.1 Items 416-6018, 416-6022, 416-6023, 650-2025,650-2031 2.2 Force Accounts#11 thru #22 2.3 Credit Items 1 .1 - Change Order #8 - Description and Signatures CHANGE ORDER#8 CITY OF THE COLONY DENTON COUNTY,TEXAS ENGINEERING DEPARTMENT Proposed State Highway Improvement at S.Colony Blvd, City of the Colony TxDOT CSJ 0364-03-095 CONTRACT AMENDMENT—EXHIBIT"A" DATE:October 18,2015 Contract Amendment No.8 to the Contract Dated June 46`,2013 between the City of The Colony(Owner)and Austin Bridge&Road,LP(Contractor)as shown below. Pursuant to the provisions of Texas Department of Transportation Standard Specifications for Construction and Maintenance of Highways,Streets,and Bridges 2004,Item 4,Special Provision 004-017,Article 4,4,this Supplemental Agreement,when fully executed,shall constitute the authority to change the work of the project as follows,including quantities and total dollars: Contract Amendment Explanation: • To replace four of the existing balance tee overhead sign structures in the median of the SRT(SH 121). This includes removing existing signage and constructing new drill shafts,tower,truss and replacing the sign panels to identify the new overpass constructed under this contract. New and revised plan sheets have been issued under this change order that detail this work. Changes to the roadside large signs and small signs are also included within the new and revised plan sheets. • To delete the 65 feet bridge span overhead sign structure along the SBFR. The drill shafts for the vertical support along the ROW could not be constructed due to the abundance of existing utilities. Pot holing was performed which determined the bridge span would have to be replaced with a COSS structure. This change order includes the new and revised sheets that show this work. • To add a pay item for Force Account#11 —Rail and deck repair damaged by the traveling public. • To add a pay item for Force Account#12—Extra I-beams on existing COSS structures to support new sign panels according to the design standard sheets. • To add a pay item for Force Account#13—Concrete traffic rail foundation. These foundations were not shown in the plans for the two runs of rail along the outside shoulder of both NB and SB SRT. The rail protects the new bents adjacent to the SRT for the South Colony Boulevard(SCB)bridge structure. a To add a pay item for Force Account#14—54"drill shaft for large signs. This shaft was needed for the new COSS#4 added by this change order. • To add a pay item for Force Account#15—90 linear feet temporary concrete traffic barrier. This run of barrier was requested by the City to protect the newly constructed SSTR rail and signage on the SCB bridge structure. The City is now the owner of these three pieces of barrier. • To add a pay item for Force Account#16—Potholing for large roadside signs and two roadway illumination pole foundations. This work was required in order to determine the exact location of the existing utilities. Minor adjustment was made to these foundations after determining the exact location of the utilities. The two roadway illumination foundations had to be dug using the vac truck due to the close proximity of existing utilities. One of the roadway illumination poles was moved across the SBFR in order to find a place without utility conflict. This was approved by the electrical design engineer with the concurrence of the City and NTTA. • To add a pay item for Force Account#17—Raising existing sanitary sewer manhole. This work was required in order to raise the MH ring and cover about 5 feet to make it flush with the new finished grade. • To add a pay item for Force Account#18—LDS Panels. This work was added in order to delineate the temporary traffic barrier and permanent barrier for traffic using the SBFR to SCB ramp. • To add a pay item for Force Account#19—Video RCP lines. This work was required to determine the condition of the RCP lines before the City turns this over to the NTTA for maintenance. The plans did not show this work except for the retaining wall underdrain pipe. • To add a pay item for Force Account#20—35'COSS. This COSS was added to replace the 65 feet bridge span OH structure described in the second contract amendment explanation paragraph. • To add a pay item for Force Account#21—Temporary sign for SBFR to SCB ramp. This sign was required in order to designate this new ramp prior to opening to traffic in early March 2015. The permanent sign was not ready during opening to traffic day. • To add a pay item for Force Account#22—Additional bracket and sign on SBFR to SCB ramp. This work was added to provide additional advisory signage to the traveling public. • To add a credit item for not stamping the concrete raised median on SCB bridge as shown in the plans. The City requested not to stamp the concrete. • To add a credit item for not conventionally drilling two eight foot deep roadway illumination foundations. This credit was required because these two foundations were drilled by the vac truck previously described in this change order. • This change order adds 163 calendar days to the contract to allow completion of work items that could not be completed due to unavailability of block sod in May through September 2015. It has been mutually agreed between all parties of this contract that no Contractor overhead costs will accrue or be charged to the owner for the addition of these calendar days. Contractor and Construction Manager's office were de-mobilized June 2015. These additional days also allowed completion of all contract bid items and added work as stipulated in Change Order#5 and added under this Change Order. Attachment#1 describes the adjusted and added pay items attributed to this Change Order. Attachment#2 describes the added and revised plan sheets attributed to this Change Order. The described sheets within this attachment will be added to the existing contract set of plans. TOTAL CONTRACT AMENDMENT NO.8: $ 319,604.040 Original Amount of Contract $ 19,999,737.45 Contract Amount after Amendment No. 7 $ 21,010,064.50 Total Amount after Amendment No. 8 $ 21,329,668.54 Requested Additional Number of Calendar Days to Be Considered Prior to the Final Payment: 163 Calendar Days.The Contract Start Time and Notice to Proceed for this project is November 7,2013. With approval of Contract Amendment No.8, 163 Calendar Days will be added to the revised contract time project schedule of 548 days. The original contract time was 435 Calendar Days. Amendment No.2,Amendment No.4 and Amendment No.7 added 113 Calendar Days Total to the contract. The total revised Contract Time with approval of Amendment No. 8 shall now be(548+163)711 Calendar Days. Please sign and return the Contract Amendment to the Engineering Department as soon as possible so future payments, if any, may be processed. Thank you.
