HomeMy WebLinkAbout04/14/2015 P&Z MINUTES CITY OF THE COLONY PLANNING AND ZONING COMMISSION APRIL 14,2015 After determining that a quorum was present, the Planning and Zoning Commission of the City of The Colony, Texas convened into Regular Session which was held on Tuesday, April 14, 2014 at 6:30 PM in the City Council Chambers located in City Hall, 6800 Main Street, The Colony, Texas, at which time the following items were addressed: Board Members Present: Karen Hames, Chairman; Cody Hall, Vice Chairman; Cesar Molina, Jr.; Detrick DeBurr; Brian Buffington; Janece Pool and Shannon Hebb. Board Members Absent: None. Staff Present: Mike Joyce, AICP, Planning Director, Gordon Scruggs, P.E., Engineering Director; Surupa Sen, Senior Planner, Edwin Voss, City Attorney; and Brian Mcnuelty, Technical Assistant. 1.0 CALL REGULAR SESSION TO ORDER Chairman Hames called the meeting to order at 6:30 PM. 1.1 CITIZEN INPUT No citizens came forward during Citizen Input. 2.0 CONSENT AGENDA 2.1 Consider approval of the minutes of the March 24,2015 Regular Session. Chairman Hames read the Consent Agenda item into the record. Commissioner Hebb moved to approve Item 2.1. Commissioner Buffington seconded the motion. Motion carried (7-0). 3.0 PUBLIC HEARING ITEMS 3.1 S114-0018, Vehicle Rental Uses Conduct a public hearing, discuss and consider making a recommendation to City Council regarding amendments to Appendix A the Zoning Ordinance, Section 10-100, Schedule of Uses by District, and Section 10-300, Definitions and Explanations Applicable to the Use Schedule, and by adding a new use entitled "Vehicle Rentals" to establish regulations for this new land use. Ms. Sen presented the staff report. Commissioner Molina asked why vehicle rental uses are proposed to be allowed by right in General Retail (GR) zoning district whereas vehicle rental uses are proposed to have an SUP for other high intensity zoning districts. Ms. Sen stated that the vehicle rental use is similar in nature to General retail uses. Mr. Joyce clarified that this use will also encompass heavy vehicle, equipment or pickup truck rental. 1 Minutes of Planning and Zoning Commission April 14, 2015 Page 2 Commissioner Hall asked if RV rental will be allowed under this use. Mr. Joyce mentioned that they will be allowed in high intensity zoning districts and not low intensity zoning districts. Ms. Sen asked if Commissioners would prefer the vehicle rental use to be permitted by SUP only in GR zoning district as well. Commissioner Hall and Commissioner Molina agreed to that suggestion. Commissioner DeBurr enquired if this use will include boat rental. Mr. Joyce clarified that boat rentals are not considered under this use as this is automobile rental use only. Commissioner Hebb enquired if leasing of vehicle is allowed under this definition. Ms. Sen answered that leasing is allowed under this use. Commissioner Hebb asked what the definition of light load vehicle is and suggested there needs to be a definition clarifying the difference of light load vehicles. Mr. Joyce mentioned that the item can be continued to the next meeting and staff can bring back a different definition. Commissioners discussed further on the definition. Since there were no further questions from the Commission, Chairman Hames opened the public hearing at 6:40 pm. No comments were received. Chairman Hames kept the public hearing open and called for a motion. Commissioner Hall moved to table Item 3.1. untill April 28, 2015 meeting Commissioner Molina seconded the motion. Motion carried (7-0). 3.2 S114-0019,Zoning Ordinance Text Amendments Conduct a public hearing, discuss and consider making a recommendation to City Council regarding a text amendment for revisions to Section 13-100, "Off-Street Parking Schedule"to revise the required parking ratios for certain land uses. Ms. Sen presented the staff report. Commissioner Buffington enquired if existing businesses will be grandfathered if these changes are approved. Ms. Sen and Mr. Joyce answered affirmative. 2 Minutes of Planning and Zoning Commission April 14,2015 Page 3 Commissioner Molina stated his concern on the hospital parking ratio proposed to be difficult to enforce. Commissioner Hall added that hospitals have to have a 4.85 employee per bed ratio so for hospitals it will not be difficult to assess the number of employees per shift. Chairman Hames asked how the High School ratio will be determined. If it is the combined number of the gymnasium, auditorium, assembly place parking requirement put together? Ms. Sen clarified that it will be the largest of any of the assembly places in the facility. Commissioner Molina and Commissioner Hall suggested that it will be useful to see how many parking spaces will be required under the proposed ratio for The Colony High School and if that number is less than or more than the current parking present at The Colony High School. Commissioner Hebb asked how this change in parking ratio process started, is it based on developer request or some other reason. Ms. Sen answered that developers and applicants have been complaining that restaurants parking ratio is much higher for The Colony. Also convenience store ratios are high as mentioned by applicants and clients and also compared to other cities. Since there were no further questions from the Commission, Chairman Hames opened the public hearing at 7:06 pm. No comments were received. Chairman Hames kept the public hearing open and called for a motion Commissioner Hall moved to table Item 3.2. until May 26, 2015 Commissioner Hebb seconded the motion. Motion carried (7-0). 3.3 SUP15-0002, Service King SUP Conduct a public hearing, discuss and consider making a recommendation to City Council on a request for Specific Use Permit to allow for a Service King, an automobile body shop located on Memorial Drive, west of Budget Suites, north of existing Firestone. The property is zoned Business Park (BP) and is part of Lot 1, Block A, East Oak Wood Village subdivision. Ms. Sen presented the staff report. Commissioner Hall asked if there will be any barbed wire or razor wire on top of the 6' tall masonry wall. Applicant Matt Moore, Clay Moore Engineering responded that there will be no barbed wire or razor wire fence. He also clarified to Commissioner Hebb's question what the material of the fence will be. It will be masonry product not necessarily brick. 3 Minutes of Planning and Zoning Commission April 14,2015 Page 4 Commissioner Hall enquired what type of security measure will be taken. Mr. Moore responded that in other areas around the nation the 6-foot tall masonry screening wall has provided sufficient security. Since there were no questions from the Commission, Chairman Hames opened the public hearing at 7:15. No comments were received. Public hearing was closed at 7:16 pm. Since there were no further discussion, Chairman Hames called for a motion. Commissioner Deburr moved to recommend approval of Item 3.3. Commissioner Pool seconded the motion. Motion carried (7-0). 3.4 SUP15-0004,Allegiance Tattoo Parlor Conduct a public hearing, discuss and consider making a recommendation to City Council regarding the approval of a Specific Use Permit (SUP) to allow a tattoo parlor as a primary use, Allegiance Tattoos, located at 4716 E. Lake Highlands Drive, Suite 110, within a Light Commercial (LC)zoning district. Ms. Sen presented the staff report. - -- - --- - Commissioners wanted clarification if it is a new application or the same applicant moving the location. Ms. Sen clarified that it is the same applicant moving to a different suite. Since there were no questions from the Commission, Chairman Hames opened the public hearing at 7:20 pm. No comments were received. Chairman Hames closed the Public Hearing at 7:21 pm. Sincere there were no further discussion, Chairman Hames called for a motion. Commissioner Molina moved to approve Item 3.4. Commissioner Hebb seconded the motion.
