HomeMy WebLinkAboutResolution No. 2015-029CITY OF THE COLONY, TEXAS RESOLUTION NO. 2015- 6� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, OPPOSING SENATE BILLS 434 AND 558 AND ANY OTHER LEGISLATION WHICH WOULD ERODE THE AUTHORITY OF GOVERNMENTAL BODIES TO EFFECTIVELY ENGAGE IN ECONOMIC DEVELOPINIENT NEGOTIATIONS WITH BUSINESS PROSPECTS; PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, Senate Bill 434 proposes the repeal of the executive session exception to the Texas Open Meetings Act chapter 551 of the Texas Government code, for economic development discussions'. and WHEREAS, Senate Bill 558, in part., proposes the repeal of the exception to disclosure of information for economic development discussions under the Texas Public Information Act, chapter 552 of the Texas Government Code; and WHEREAS, the City Council for the City of The Colony, Texas, recently utilized both economic development provisions for the Nebraska Furniture Mart of Texas retail project located within the City of The Colony. Texas: and WHEREAS, the Nebraska Furniture Mart of Texas retail project is a subsidiary of Berk -shire Hathaway. and WHEREAS, recently on February's, 2015, in a Fox Business Network interview Warren Buffet with Berkshire Hathaway indicated his belief the Nebraska Furniture Mart of Texas retail store would generate Sl billion dollars in annual sales: and WHEREAS, the State of Texas recei\,es 6.25 percent in sales tax revenue for every SI dollar in sales; and WHEREAS, 8I billion dollars in annual sales would generate $62,500.1000.00 in annual sales tax revenue for the State of Texas; and WHEREAS, neither Senate Bill 434 nor Senate Bill 558 currently has a fiscal note attached to either bill, and WHEREAS. the City Council for the City of The Colony, Texas, believes the Texas Legislature has 62,500,0,00 reasons why they should not pass either bill. moreover a fiscal note should be attached to both bills. NO'"', THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL GFTHE CITY GF THE COLONY, TEXAS THAT: SECTION 1. The City Council of the City of The Colony strongly opposes Senate Bill 434 (2015) and Senate Bill 558 (2015) and any legislation that would erode the ability of governmental bodies to engage in economic development negotiations. SECTION 2. This opposition to Senate Bill 434 (2015) and Senate Bill 558 (2015) and similar legislation be communicated to members of the Texas Legislature and the Texas Governor's office. SECTION 3. This Resolution shall become effective from and after its date of passage in accordance with law'.
