A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, OPPOSING SENATE BILL 182 AND HOUSE BILL
365 AND ANY OTHER LEGISLATION CONCERNING THE
CALCULATION OF THE AD VALOREM ROLLBACK TAX RATE;
PROVIDING FOR AN ENITTUEDIATE EFFECTIVE DATE.
WHEREAS, Senate Bill 182 (2015) and companion bill House Bill 365 (2015) would
lower the property tax rollback rate from eight percent (8"/"'0') to four percent (4%). with an
exception for a city located in an area declared a disaster area by the governor or president of the
LJnited States during the current tax year, and
WHEREAS, Senate Bill 182 and companion bill..House Bill 365 would also require a
city to hold a ratification election to adopt a tax rate which exceeds the four percent W1116)
rollback rate, and
WHEREAS, current law, only requires an election on a tax rate which exceeds the
rollback tax rate if a petition is signed by seven percent (70) of the registered voters of the City
of The Colony, Texas-, and
WHEREAS, the City Council for the City of The Colony, Texas, has reduced its
property tax rate for nine (9) consecutive fiscal ycars-, and
WHEREAS, the City Council for the City of The Colony. Texas, further plans to reduce
its property tax rate again for fiscal year 2015-2016- and
WHEREAS, nonetheless., the City Council for the City of The Colony, Texas. believes
in local control and that it is its City officials and citizens of the City of The Colony, Texas,
which are in the best position to determine the needs of the City.
NOW1 THEREFORE, BE IT RESOLNT ED BY THE CITY COUNCIL OF THR
CITY OF THE COLONY, TEXAS THAT:
SECTION 1. The City Council of the City of The Colony. Texas., strongly opposes
Senate Bill 182 (2015) and House Bill 365 (2015) and any legislation which reduces the property
tax rollback rate from eight percent (81/1'0) to four percent (40,"o) and which requires a ratification
election to adopt a tax rate which exceeds the four percent (4%) rollback rate.
SECTION 2. This opposition to Senate Bill 182 (2015) and House Bill 365 (2015) and
similar legislation be communicated to members of the Texas Legislature and the Texas
Governor's office.
SECTION 3. This Resolution shall become effective from and after its date of passage in
accordance with law.
