A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS, AUTHORIZING THE MAYOR TO
EXECUTE A TERMINATION OF DECLARATION OF
BUILDING SETBACK AREA, RECORDED ON AUGUST 19,2004
IN THE DENTON COUNTY RECORDS AS DOCUMENT 2004-
110475; PROVIDING AN EFFECTIVE DATE
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY,TEXAS:
Section 1. That the City Council of the City of The Colony, Texas, hereby
authorizes the Mayor to execute a Termination of Declaration of Building Setback
Area, previously executed for the benefit of the City of The Colony, and as requested by
the property owners Crow-Billingsley UMF Plano, Ltd.
Section 2. That it is determined that there is now a desire to terminate the
Declaration as there is no benefit to the City or the property owners to continue with the
Building Setback Area.
Section 3. That a true and correct copy of the Termination of Declaration of
Building Setback Area is attached hereto and incorporated herein as "Exhibit A".
Section 4. That the Mayor is authorized to execute said Termination of Declaration
of Building Setback Area.
Section 5. That this resolution shall take effect immediately from and after its
passage.
PASSED AND APPROVED by the City Council of the City of The Colony,
Texas, this 211d day of December, 2014.

TERMINATION OF DECLARATION OF BUILDING SETBACK AREA
This:Termination Of Declaration of B uilding Setback Area (this "Agreement") is made
this a' day of Q22.e!evnatza014 by CROW-BILLINGSLEY UMF PLANO, LTD.,
a Texas limited partnership, PBC 14 AR LAND, LTD., a Texas limited partnership, and AR1
LAND, LTD., a Texas limited partnership (collectively, the owners of the Building Setback
Area the "Owners") and the City of The Colony, Texas, a Texas home-rule municipality
(the "City"), as follows:
WITNE S SETH:
WHEREAS, Crow-Billingsley UMF Plano, Ltd., a Texas limited partnership, entered
into that certain Declaration, for the benefit of the City, of Building Setback Area,
dated August 13, 2004, recorded on August 19, 2004, under Document Number: 110475 in
the Official Records of Denton County, Texas ("Declaration");
WHEREAS, the Owners and the City now desire to terminate the Declaration as there
remains no benefit to the City or the Owners to continue with the Building Setback Area;
THEREFORE, for and in consideration of Ten and No/l00 Dollars ($10.00), and other
good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged
and confessed, Owners and the City hereby agree and terminate as follows:
1. Owners and the City hereby terminate the Declaration and the Declaration shall
hereafter be of no further force or effect.
2. This Agreement may be executed in multiple counterparts, each of which shall
constitute an original, but all of which shall constitute one document.
